Harris (hereinafter "the applicant" ) is the owner of property at 3850 Watertown Road located within the City of Orono (hereinafter "City") and legally described as Lot l, Block l, Hillaway Farm, Hennepin County, Minnesota, (hereinafter "property"), and WHEREAS , per Municipal Zoning Code Section 10.03 , Subdivision 19, the applicant has applied to the City of Orono for a Conditional Use Permit to permit the installation of a pond 100' in diameter and 4' deep. • NOW, THEREFORE, BE IT R$SOLVED by the City Council of Orono, Minnesota: � FINDINGS l. This renewal application was reviewed as Zoning File #1740. 2. The property is located in the RR-lA, Rural Residential Zoning District requiring 5 acres in area. The property consists of 10+ acres. 3. On June 15, 1992, the Orono Planning Commission reviewed the application as proposed and recommended approval based on the following findings: A. The City Engineer has confirmed that the installation � of the pond wi 11 have no negative impact upon the ' drainage to the west nor the south. B. The installation of the pond will have a positive impact on the drainage in the area providing greater • retention within the limited watershed. C. The City Counci 1 f inds that granting a conditiona 1 use permit to allow the installation of a pond as proposed will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor � pose a fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use of the property wili be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by staff and comments of the applicant and the affect of the proposed use on the health, safety, and welfare of the community. CONCLOSIONS, ORDER AND CONDITIONS • Based upon one or. more of� the above findings, the Orono City Council hereby grants a Conditional Use Permit per Municipal Zoning Code Section 10.03, Subdivision 19 to permit the installation of a 100' diameter pond at a 4' depth as shown on the survey by Coffin and Gronberg, Inc. dated March 17, 1989, subject to the following conditions: 1. Banks of the pond are to be installed at a 3:1 slope to facilitate the regrowth of vegetation. 2. � Vegetation to be restored upon completion of the final land alteration. 3. Applicant to provide a drainage easement over the retention pond and upon the final recommendation of the City Engineer, hereby agrees to grant the City additional drainage easements over existing underground tiles that drain to the southern boundaries of the property. 4 . Applicant to apply for a land alteration permit from the City prior to any land alterations. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be � ; completed within one year of the date of Council approval or � the specia 1 conditions of this reso lution wi 11 expire on � that date (June 22, 1993 ). ! 6. Violation of or non-compliance with any of the terms and � conditions of this resolution shall constitute a violation of the Zoning Code, shall automatically terminate any � authority granted herein, and shall be punishable as a misdemeanor. 7 . The undersigned owner has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the � property. • Adopted by the Orono City Council on this 22nd day of June, 1992.
