Background The property at 2389 Blaine Avenue consists of part of Lot 5 of Langdon Park(0.68 acre) and Outlot A Navarro (0.42 acre). The Langdon Park part of the properly is zoned Retail Sa1es Business B-l. The Navarro part of the property is zoned Lakeshore Residential LR-1 C-1. . The Landon Park portion of the property is occupied by the buildings and parking. The Navarro portion is mostly vacant. Navarro is the development of twin homes along Lyric Avenue and Livingston Avenue west of Blaine Avenue. It was approved in 1982 as a Planned Residential Development. The development property had frontage on Blaine Avenue north of the City water tower property and on Shoreline Drive. Two accesses were desired. To avoid an access to Shoreline Drive the City obtained Outlot A from the developer and exchanged it for part of the original 2389 properly. This provided right of way for Lyric Avenue and additional right of way for Blaine Avenue. As part of the exchange the City is to rezone the property to Retail Sales Business B-1. The impetus for this rezoning is the development of the City's Geographic Information System(GIS)program. GIS involves linking data bases (such as zoning district, zoning information, existing use, sewer or septic status, easements, etc) to parcels of land. It is much easier to do if each parcel has only one zoning classification. GIS will make it easier to generate maps and provide information via the City's website. .. . FILE 09-3401 V April 20,2009 Page 2 of 2 Discussion There was staff turnover when at the time the development was approved. This may be the reason the rezoning was not done at that time. While.residents of the Navarro development may be surprised, the rezoning was part of the original plan for the development. It is a specific condition of the property exchange contract. If the properly was redeveloped or the existing building expanded the code would require a 35 setback for the building and a 15 foot setback for parking lot adjacent to the residential lot to the west. A six foot fence or evergreen screen would also be required along this lot line. Lot Width: 149 feet • . � Application Summary: In order to change replace the flat roof with a pitched roof the the applicant requests a variance to enlaxge a two-car garage that is located closer to the street than the house, when the code does not allow accessory structures to be located closer to the street than the rinci al structure. An 1898 map of Hennepin County shows a road in the approximate location of Tonkaview Lane. Garden Lane was dedicated by the Tonkaview Gardens plat but was not improved unti12000. The house was constructed in 1990 to replace an older house. The detached garage was retained. Its age is unknown. It shows up on the oldest aerial photos in the City's possession, from the mid 1950's. Until an attached garage was added to the house in 2000 this garage was the only gaxage on the property. It is constructed of concrete block but has wood siding to match the house. The applicant proposes to construct a gable roof with the ridge parallel to Garden Court. The house is setback about 130 feet from Garden Court. The garage is set back about seven feet from the right of way and 21 to 22 feet from the roadway itself. . Issues for Consideration What sort of hardship exists in this situation? The difficulties of maintaining a flat roof in Minnesota have been the part of the basis for granting similar variances. If the garage had wood framed walls like a typical garage it probably would have collapsed years ago or have been removed when the house was constructed. The Commission may want to consider the unattractiveness of the building as a contributing factor. Is the variance necessary to make reasonable use of the property? The attached garage is 480 square feet. This garage is 624 square feet. There are no other accessory structures on the properly. Staff suggests the proposed roof is more compatible with the neighborhood than the flat roof. While there is one nearby house with a flat roof, the inconsistency between the house roof and the garage roof is conspicuous. There are large trees north of the garage and south of the driveway that should help soften the additional mass. � Are there any other issues or concerns with this application?
