HomeMy WebLinkAboutResolution 3169 .. _ �. 0 � � _ O O � � � `�b= � � CITY of ORONO ,� ., �, � ti� RESOLUTION OF THE CITY COUNCIL ' �'� �j� NO. 316 9 �kESIIO�' A R$SOZDTION D$TSRMINING T7iAT SANITARY SEWER SSRVICS WILL NOT HE PROVIDED TO VACANT PROPERTY LOCATED AT '3320' BAYSIDE ROAD RNOWN AS LOT 9, BLOCR 6, BAYSIDE ADDITION TO LAKE MINNETONRA WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the Stubbs Bay Sewer Project was initiated by the City to solve existing on-site sewage treatment problems in the Stubbs Bay area, within which Lot 9, Block 6, Bayside �, . Addition to Lake Minnetonka, is located; and WHEREAS, the aforementioned Lot � is described for tax record purposes as PINS number 05-117-23 14 0047, and is under • single separate ownership, not owned in common with any other abutting or nearby property; and WHEREAS, all adjacent lots are occupied; and WH$REAS , the total acreage of the parcel is approximately 0.19 acres, of which approximately 0.09 acres is dry land and 0.10 acres is considered as f lood plain area and is transected by a creek; and WHEREAS, the total dry land area of 0.09 acre is extremely substandard as compared to the existing regulation of the LR-lA zoning district requiring 2.0 acres per buildable site; and WH$R$AS, said parcel is not buildable without many variances from the existing zoning code; and , WH$REAS, construction of a single family residence on :the parcel could not be done according to al 1 zoning performance standards of the LR-lA zoning district in which said Lot 9 is located, and therefore would be contrary to the intent of the Community Management Plan; and WH$REAS, said Lot 9 has been valued and assessed for • tax purposes at a rate reflecting the non-buildability of the property; and _ Page 1 of 2 . w , �. .�,-• . NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of the City of Orono, Minnesota that sewer service will not be provided to Lot 9, Block 6, Bayside Addition to Lake Minnetonka, finding that said lot is too substandard in area to be considered as a buildable site. � Adopted by the City Council of the City of Orono, Minnesota on this lOth day of August, 1992.
