RESOLUTION OF THE CITY COUNCIL

A RESOLUTION AMENDING
RESOLUTION NO. 2960,
FILE NO. 1626
WHEREAS, Eric and Kristal Wilson (hereinafter "the
applicants") are owners of the property located at 2683 North Shore
Drive within the City of Orono (hereinafter "City") and legally
described as follows:
Tract B, Registered Land Survey No. 1373, Hennepin County,
Minnesota (hereinafter "the property"); and
WHEREAS, on May 13, 1991 the City Council of the City of
Orono granted variances to Municipal Zoning Code Section 10.23,
Subdivision 6 (B) for lot area, lot width and side yard setback to the
previous owners, Tim and Beth Traff, for a new residence, portions of
which were to be constructed 24.5' from the east side lot line where a
• 30' setback is normally required; and
WHEREAS, the applicants have proposed a different house and
different site plan than that approved for Mr. and Mrs. Traff; and
WHEREAS, on October 21, 1991 the Orono Planning Commission
reviewed the site plan attached to this resolution as Exhibit A, and
recommended approval of the revised proposal on a vote of 4 to 2; and
WHEREAS, the revised proposal locates portions of the
proposed garage and house as near as 27' to the east side lot line,
but proposes the equivalent square footage of footprint encroachment
of the 30' required side yard as was approved with the Traff variance
request; and
WHEREAS, the City Council finds that this proposed
structure/site plan meets with the original intent of the approval
granted in Resolution No. 2960.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:

1. Resolution No. 2960 of the City Council is hereby amended by
allowing the construction of the new residence per the site
plan attached to this resolution as Exhibit A, allowing a
27' east side lot line setback where a 30' side setback is
normally required, subject to conditions 1-3 of Resolution
No. 2960.
2. Authorities granted by this resolution run with the property
not with the applicants, but are permissive only and must be
exercised by application for a building permit within one
year of the date of original Council approval of Resolution
No. 2960, or this variance will expire on that date (May 13,
1992).
3. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicants have read, understood and hereby
agree to the terms of this resolution and on behalf of
themselves, their heirs, successors and assigns, hereby
agree to the recording of this resolution in the chain of
title of the property.
