HomeMy WebLinkAboutResolution 3015r i O O O CITY of ORONO RESOLUTION OF THE CITY COUNCI L S'40 NO. 3015 A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A PLAT AT 700 OLD CRYSTAL BAY ROAD NORTH FILE NO. 1668 WHEREAS, the City of Orono (hereinafter "the applicant") on July 25, 1991 filed a formal subdivision application for approval of a 2 lot residential plat of property legally described as Lot 2, Block 1, Willow Properties Addition, Hennepin County, Minnesota, (hereinafter "the property") and; WHEREAS, after due published and mailed notice in accordance with Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and Platting Codes, the Orono Planning Commission held a public hearing on August 19, 1991 at which time all persons desiring to be heard concerning this application were given the opportunity to speak • thereon; and WHEREAS, at their regular meeting held on September 9, 1991 the Orono City Council considered the subdivision application as proposed, noting the following findings of fact: 1. The property is located within the RR -1B Single Family Residential Zoning District requiring a minimum of 2 acres of contiguous dry buildable land within each newly created lot. 2. The property contains a total of 16.5 acres. .9 acres consists of wetland areas located at or below the 1017.7 elevation. 3. The proposed plat contains 2 lots each exceeding the 2 acre minimum lot area requirement. 4. The property will be served with municipal sewer and water and still be developed at current RR -1B standards. 5. Lot 1, Block 2 may be developed under B-6 zoning based on directives of Comprehensive Plan Amendment No. 2. Current PUD ordinance Section 10.53 for Highway 12 corridor would not allow development of Lot 1, Block 2 as a PUD as property does not meet 5 acre requirement. If property is to be developed under a PUD, future owner must acquire additional contiguous land. Page 1 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 3015 6. Each lot meets the standards of the existing RR -1B zoning district. Required Improvements Owner of property shall construct an access road with temporary cul-de-sac at east border. Such road shall meet all required standards for a public road at 9 ton capacity. Owner and applicant shall be responsible for extension of sewer and water to both properties. NOW, THEREFORE BE IT RESOLVED, that based upon either one or more of the above findings, the City Council of the City of Orono hereby approves the preliminary plat for the City of Orono at 700 Old Crystal Bay Road North per the survey dated July 26, 1991, revised • August 29, 1991, by Mark S. Gronberg of Coffin and Gronberg, Inc., subject to the following conditions: 1. Owner to dedicate Outlot A as a public road to the east lot line. A temporary cul-de-sac to be installed at the east end per approved plans. Owner shall grant temporary access and utility easements over portions of temporary cul-de-sac not located within 60' road outlot. 2. Owner to grant flowage and conservation easement over wetlands designated at 1017.7 elevation. 3. Outlot A Willow Properties Addition shall be redesignated as a public road. The City of Orono to maintain once construction is completed and approved by the City. 4. Access to Lot 1, Block 1 shall be provided from Outlot A. This property shall be limited to one other additional curb cut along Old Crystal Bay Road based on length of frontage adjacent to roadway. Lot 1, Block 2 shall achieve access only from Outlot A, the future public roadway. No direct access onto U.S. Highway 12 shall be allowed. 5. Notice to applicant and owner that any alterations of the existing wetlands designated at the 1017.7 elevation or within 26' of that wetland shall require a separate • conditional use permit and variance application with the City. O� O� O a CITY of ORONO RESOLUTION OF THE CITY COUNCIL Slio NO. 3 015 FINAL PLAT SUBMITTALS The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month: A. RECORD PLAT drawings in the form of two (2) mylar copies and one (1) copy reduced to 1"=2001. Drawing to include: a) Lot lines platted per preliminary survey by Mark S. Gronberg of Coffin and Gronberg, Inc. dated July 26, 1991, revised August 29, 1991. b) Dedication of "drainage and utility easements" 10' wide along all perimeter property lines and 5' each side of internal property lines. • c) Designation and dedication of a drainage easement within Lot 1, Block 1 over the wetland area at or below the 1017.7 elevation. The drawing should also show 20' wide drainage easement to northeast (at 1017.9 elevation outlet) and east (at 1017.7 elevation outlet). d) Outlot A Willow Properties Addition and newly designated Outlot A shall be shown as a future public road not as an outlot. The City will name roadway prior to final plat approval. B. LEGAL DOCUMENTS required: a) Title opinion addressed to the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. b) The applicant must provide certified copies of all recorded easements currently affecting the property. c) Signed and executed Drainage Easement document for the wetland area (1017.7) and drainageways as shown on • staff sketch within Lot 1, Block 1.
