A RSSOLUTION VACATING AN
UNDSVELOPBD ALLEY WITHIN THE PLAT OF
RL�ARRA1�iGEMENT OF LOT 1, RITCHFL'S SDBDIVISION OF
GOV$RNir!$NT LOTS 5 AND 6 (S$CTION 22, TOWNSHIP 117, RANGB 23)
HENNEPIN COONTY, CITY OF ORONO, MINNESOTA

WHBREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
i�HBRBAS, on June 20, 1991, Thomas A. Judcl, an authorized
representative of Big Island, Inc., filed a petition with the City of
Orono requesting the vacation of an unimproved alley at a 20' width,
legally described as follows:
A 20 ' platted a11ey dedicated within the plat of the
rearrangement of Lot 1, Ritchel's Subdivision of Government Lots
5 and 6 (Section 22, Township 117, Range 23 ) , Hennepin County,
Minnesota; and
WH$REAS, after due published and posted notice, a public
hearing was held before the Planning Commission on July 15, 1991
regarding said vacation and all interested persons were given an
opportunity to be heard; and
- � T�THEREAS, after due standing and consideration, the Planning
Commission voted to recommend approval of the requested vacation and
the Counci 1 of the City Orono f inds that said vacation, as proposed,
is in keeping wi_th the public interest in consideration of the
following findings:
� 1. Existing 20' width of right-of-way would not meet current
standards for development of a public road.
2. Based on the pattern of development in current ownership,
there is no use of right-of-way for access purposes.

NOW, THERSFORE BE IT RESOLVED, that the petition of Thomas
A. Judd, an authorized representative of Big Island, Inc. , is hereby
granted by the Council of the City of Orono and that the unimproved
right-of-way legally described above is hereby vacated. The granting
of the petition is subject to the condition that upon vacation the
app.licant shall execute a special lot combination with the City to
ensure the two properties are legally defined as one since current

by �iennepin County.
Adopted by the City Council of the City of Orono, Minnesota
at a regular meeting held August 26, 1991.
