A RESOLUTION GRANTING
VARIANCES TO
MUNICIPAL ZONING CODE
SECTION 10.22, SUBDIVISION 1,
SECTION 10.22, SUBDIVISION 2, AND
SECTION 10.24, SUBDIVISION 5 (B)
FILE #1664
WHEREAS, William H. Bockmann (hereinafter "the
applicant") is the owner of the property located at 1090 Loma
Linda Avenue within the City of Orono (hereinafter "City") and
legally described as follows:
Lot 9, Loma Linda, Hennepin Cbunty, Minnesota (hereinafter
"the property"); and
WHEREAS, the applicant has applied to the City for
\ variances to Municipal Zoning Code Section 10.22, Subdivision 1
to construct a deck located nearer the lakeshore than the defined
average lakeshore setback line past which no structural
,encroachment is normally allowed, and a variance to Section
'10.24, Subdivision 5 (B), to allow such deck to have a side
setback of 8.9' where a side setback of 10' is normally required,
and a variance to Section 10.22, Subdivision 2 to allow hardcover
in excess of the 25% normally allowed in the 75-250' zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1664.
2. The property is located in the LR -1B Single Family
Lakeshore Residential Zoning District.
3. The Orono Planning Commission reviewed this application
on July 15, 1991, and recommended approval of the proposed
variances based upon the following findings:
A) The house has only two exits, the second being a
door which would exit onto the proposed deck. A
platform and stairway would be necessary in this
location for safety purposes due to the grade of the
site.

convenience to the applicant, but is necessary to alleviate
a demonstrable hardship -or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.

6. The undersigned applicant has read, understood and
hereby agrees to the terms of this resolution and on behalf
of himself, his heirs, successors and assigns, hereby agrees
to the recording of this resolution in the chain of title of
the property.
Adopted by the City Council of the City of . Orono,
Minnesota at a regular meeting held on the 12th day of August,
1991.
