NO. 2 84 3 • - • • < i� A RBSOLIITION GI2ANTING AN AFTER-THS-FACT VARIANC$ TO MONICIPAL ZONING CODE .. SECTION 10.03, SDBDIVISION 15 (C) , .. FILE #1543 WH$RBAS, Richard C. Reed (hereinafter "the applicant") is the owner of property located at 1000 Old Long Lake Road within the City of Orono (hereinafter "City") and legally described as follows: Exhibit A, attached, (hereinafter "the property"); and • WHERSAS, the applicant has applied to the City for an after- the-fact variance to Municipal Zoning Code Section 10.03 Subdivision 15 (C) to permit the installation of 4 entrance monuments at a height � of 5' instead of the allowed 3 1/2' to be installed 10' from the travelled right-of-way of Old Long Lake Road. � NOW, TH$RBFORE, B$ IT RSSOLV$D by the City Counci 1 of Orono, Minnesota: ' i � FINDINGS ' 1. This application was reviewed as Zoning File #1543. 2. The property is located in the RR-1B Rural Residential Zoning District requiring 2 acres in area. The subject property consists of 2+ acres. 3. The Orono Council reviewed this application on July 9, 1990 and recommended conceptual approval of the proposed after-the- fact variance based upon the following findings: A) The proposed location of the entrance monuments will provide no hazard to the users of the adjacent public roadway, Old Long Lake Road. B) The monuments placed 10' off the traveled road will provide adequate area for snow maintenance purposes. C) The entrance monuments with lighting will provide no visual impact for the adjacent residential properties. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to al leviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the � applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLIISIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants an after-the-fact variance to . Municipal Zoning Code Section 10.03, Subdivision 15 (C) to permit the construction of 4 entrance monuments at a 5' height placed 10' from the traveled road subject to the following conditions: l. Fencing to be installed between the two inner entrance monuments shall not exceed a height of 3 1/2 ' . 2. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Counci 1 approva 1 , or this variance wi 11 expire on that date (July 23, 1991). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shal 1 automatically terminate any authority granted herein, and shal 1 be punishable as a misdemeanor. 4.
