A RBSOLDTION GRANTING
PRELIMINARY APPROVAL FOR A
2 IAT PLAT AT
2300 LONGVIEW CIRCLE
FILE NO. 1528
WHEREAS, Constance M. Scott (hereinafter "subdivider")
on April 26, 1990 filed a formal subdivision application with the
City for approval of a 2 lot residential plat of property legally
• described as Lot 5, Block 1, Longview, Hennepin County, Minnesota
_ (hereinafter "property"); and � �
� .
WH$REAS, after due published and mailed notice in
accordance with Minnesota Statues 462.358 et. seq., and the City
of Orono Zoning and Platting Codes , the Orono Planning
Commission held a public hearing on May 21, 1990 at which times
all persons desiring to be heard concerning this application were
given the opportunity to speak thereon; and
� WHERSAS, at their regular meeting held on June 11, 1990
� � the Orono City Cauncil considered the subdivision application of
Constance M. Scott, noting the following findings of fact:
l. The property is located within the RR-1B Single Family
Rural Resideritial Zoning District requiring a minimum of 2.0
acres of contiguous dry buildable land within each newly
created lot.
2. The property contains a total of approximately 4.0
acres, all af which is considered dry buildable lands. �
3. Each of the lots contain 2.0 acres of dry contiguous
land, and each meets the required 200' width to the rear of
the 5 0' f ront setback 1 ine.
4. On-site septic testing confirms adequate and suitable
areas for on-site septic development on the proposed new lot
(Lot 1) and adequate and suitable area for on-site septic
development for an alternate system on proposed Lot 2.
5. A11 existing improvements on proposed Lot 2 meet the
required setback from the newly proposed division line.
6. Each lot can continue to be developed for residential use
without the need for variances to the RR-1B zoning standards �
or on-site septic° code af -�he City.

NOW, THEREFOR$ B$ IT RESOLVED, that based upon one or
mare of the findings noted above, the City Council of the City of
Orono hereby approves the preliminary plat for Constance M. Scott
that proposes a 2 1ot Class III subdivision per the survey
undated by Theodore D. Remna of Schoell & Madsen Inc., subject to
the following conditions:
l. The future owner of Lot 1 must apply for a driveway
permit from the Public Works Department upan application for
a building permit.
2. The plat was filed prior to the May lst deadline for new
park dedication f ee schedule, subdivider need only make
payment of $200.00 for proposed Lot l. ,.
FINAL PLAT SUBMITTALS
The following list of final submittals must be submitted to
the Zoning Administrator two weeks prior to the regularly
scheduled Council meeting on the second and fourth Mondays of the
• month:
A. RECORD PLAT drawings in the form of two (2) mylar copies
and one (1) capy reduced to 1"=200'. Drawing to include:
a ) Lot lines platted per preliminary survey by
Theodore D. Kemna of Schoell & Madsen Inc. undated
(preliminary plans used for public hearing review on
May 21, 1990 ) .
b) Dedication of "drainage and utility easements" 5'
each side of the internal property lines.
c) Name p1at.
B. LEGAL DOCUMENTS required:
a) Tit1e opinion addressed to the City. A11 owners,
mortgage holders or others with property interest
indicated therein sha11 sign the plat and a11 other
documents affected by such interest.
b) The subdivider must provide certified copies of all
recorded� easements currently affecting the property.

c) Subdivider to provide appropriate documentation
insuring future owner of Lot 1's responsibility of
share in the cost of the upkeep of the private road
knawn as Longview Circle. This would also include
partial ownership of private road outlat.
C. FEES TO BE PAID: Total Due $425 .00 I
a) Park dedication fee per current schedule:
� Lot 1 @ $200. 00
b) Final plat fee = $150. 00
c) Legal review and filing fees of $75.00 •
