Zoning Code Section 10.22, Subdivision 2 to permit the construction of room additions to the existing residence, such additions constituting hardcover in the 75-250' lakeshore setback zone in excess of the 25$ hardcover normal Yy al.�.owed, and a variance � to Section 10.23, Subdivision 6 (B) to a1.1.ow construction of an entryway addition located 25' from the side I.ot line where a 30' side setback is normaXly required. 1 NOW, THEREFOR$, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS l. This application was reviewed as Zoning Fi1:e #1594. 2. The property is I.ocated in the LR-lA Singl.e Famil.y Lakeshore Residential Zoning District. 3. The Orono P1.anning Commission reviewed this appl.ication on October 15, 1990 and recommended approval. of the proposed variances based upon the folxowing findings: . a) The orient�tion of the neighboring residence to the east is such that the proposed 25' side setback f or the entry wi�. l not tend to increase the visual density of tha neighborhood nor wiZl it have significant effect on the neighboring property. b) AXthough hardcover on the property a�.ready exceeds the 25$ limitation, appXicants have demonstrated that they can • easil.y remove equivalent amounts of hardcover in the 75-250! The City Counci�. has considered this appXication inc�uding ; the findings and recommendations of the P1.anning Commission, reports by City staff, comments by the appl.icant and the effect of the proposed variance on the heal.th, safety and wel.fare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not appl.y genera�.l.y to other property in this zoning district; that granting the variance wouXd not adversel.y affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; woul.d not merely serve as a convenience to the applicant, but is • necessary to alXeviate a demonstrable hardship or difficulty; is necessary to preserve a substantial. property right of the applicant; and wouXd be in keeping with the spirit and intent of � the Zoning Code and Comprehensive Pl.an of the City. CONCLIISIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Counci� hereby grants a variance to the MunicipaJ. Zoning Code Section 10.23, Subdivision 6 (B) to permit the construction of an entryway addition located 25' from the side 3.ot I.ine where a 30' setback is normal.I.y required, and grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to al�.ow hardcover of 37.8g in the 75-250' I.akeshore setback zone where only 25� hardcover is normalXy a1.Yowed, subject to the foxl.owing conditions: 1. AppXicant is advised that hardcover on the property in the 0-75 ' and 75-250�' zones may not exceed the amounts and percentages as shown on the survey and table attached as Exhibit B. Any future proposaXs to increase hardcover on the property in those zones wil1. not be alxowed, but might be approved only in conjunction with concurrent removals of existing hardcover, yielding no net hardcover increase.
