WHEREAS, Alan G. Carlson (hereinafter "the subdivider")
on August 24, 1989 filed � formal subaivision �pplication with
the City for �pproval of � 17 lot residential plat of property
legally described �s follows:
Exhibit A, �tt�ched (herein�fter "the property" ) �nd;
WHEREAS, after due published and mailed notice in
�ccordance with Minnesot� St�tues 462.358 et. seq. �nd the City
of Orono Zoning �nd Pl�tting Codes, the Orono Pl�nning Commission
held public he�rings on September'-18, 1989 �nd Janu�ry 16, 1990
�t which times �11 persons desiring: to be he�rd concerning this
�pplic�tion were given the opportunity to spe�k thereon; �nd ,
• WAEREAS, at their regul�r meeting held on March 12,
1990 the Orono City Council considered the �mended subdivision
�pplic�tion of 16 lots, noting the following findings of f�ct:
1. The property is loc�ted within the RR-1B Single F�mily
Rur�l Residenti�l Zoning District requiring � minimum of 2.0
. acres of contiguous dry build�ble l�nd within e�ch newly
cre�ted lot.
2. The subdivision �s �mended from the origin�l 17 lot
propos�l finds th�t each lot meets or exceeds the 2.0 �cre
minimum dry contiguous lot �r.ea st�nd�rds.
3. E�ch of the 16 lots meets the required lot width to the
re�r of the 50 ' front street setb�ck line.
4. All of the 16 lots sh�ll �chieve �ccess vi� � network of
interior priv�te ro�dw�ys. No direct �ccess onto W�tertown
Ro�d wi11 be �llowed for �n individual lot owner.
5. In his report d�ted J�nu�ry 8, 1990, Glenn Cook, City
' Engineer, found the revised 16 lot pl�t to be except�ble �nd
recommended �pprov�l subject to fin�l �pprov�l of the
Watershed District.

. ' The Minneh�h� Creek W�tershed District gr�nted
condition�l permit �pprov�l (89-167) of the dr�in�ge,
grading �nd erosion control pl�ns of the Indi�n Creek pl�t
at their Febru�ry 15, 1990 meeting.
7. In memos d�ted Janu�ry 8, 1990 and March 7, 1990,
Michael P . G� ffron , Assist�nt Pl �nning & Zoning
Administr�tor, confirmed that �11 16 lots h�d been tested
�nd found to h�ve suit�ble � re�s for on-site septic
development.
8. The proposed configur�tion �nd over�ll design of the
lots within the pl�t finds th�t each lot s�tisfies the lot
stand�rds of the RR-1B zoning district requiring no
v�ri�nces with the gr�nting of the �pprov� l of this
subdivision. E�ch lot c�n be developed �s � residenti�l
unit without the need for future v�ri�nces.

9. The Orono�Council �ccepts the findings of the Pl�nning
• Commission in �pproving � vari�nce to Section 10. 55 ,
Subdivision 8 that would prohibit �ny l�nd �lter�tions
within � defined protected wetl�nd. The following findings
were noted by the �pplic�nt and �ccepted by the Pl�nning
Commisson:
A) Incre�sed h�rdcover from � ro�d 2-3 times longer
would cre�te more storm w�ter run-off �nd environment�l
burden on surrounding l�nd. The use of 1/2 �cre of the
wooded �re� will have less environment�l imp�ct on the
surrounding �re�. In addition, �pplic�nt will provide
repl�cement for further retention to off-set �ddition�l
filling.
B) Loss of m�jor portions of trees if � peripher�l
ro�d is constructed outside of the wetl�nd �re�s.
C) Major visu�l �nd �esthetic imp�ct on �dj�cent
properties to the e�st �s there �re no pl�ntings to
provide screening from ro�dw�y �nd the lower elev�tions
�long the e�st lot line.
D) The n�ture of the wetl�nds h�s ch�nged over the 30
ye�rs since it w�s origin�lly design�ted �s � protected
�re�. M�ture trees now occupy wh�t w�s once cl�ssified
�s � marsh l�nd. There is no obvious sign of flooding
• or retention of flood w�ters �s � ditching system h�s
dried out the �re� �nd �llowed the trees to flourish.

) Subdivider is not asking for a redesignation of
wetlands for building sites and septic development,
only to be allowed to construct a roadway.
F) The wetland area is not considered a protected DNR
wetland and is classified as a Type 6/7 wetland
referred to as a shrub and wooded swamp wetland.
10. The subdivider has provided future access corridors to
the east and west and shall be responsible for developing
the east corridor through the wetlands. The improvement
shall consist of a 24' wide gravel road bed with ditches and
a 16' wide paved surface per City's specifications.
NOW, THEREFORE BE IT RESOLVED, that based upon one or
more of the findings noted above, the City Council of the City of
Orono hereby approves a variance to Section 10.55, Subdivision 8
and the preliminary plat of Indian Creek per plat survey dated
most revised February 23 , 1990 by Edward A. Sunde, a registered
land surveyor under the laws of the State of Minnesota of Sunde
• Land Surveying, Inc., subject to the following conditions:
1. All access to the 16 lot plat must be via the interior
plat road. No curb cuts for the proposed lots shall be
approved off of the adjacent roadway.
2. Prior to any land alterations for dr�inage or road
purposes, the following septic sites must be staked with
fencing. Such fencing to be installed 20 ' from the
boundaries of each drainfield test site, as follows:
Lot l, Block 1
Lot 5 , Block 1 �
Lot 1, Block 4 ( septic site located in SW corner only)
Lot 6, Block 4 �
Lot 7, Block 4
3. Subdivider to grant underlying road and utility easement
over all private road outlots (Outlots A, D and E).
4. Outlot A shall be installed per engineering road plans
dated 12/19/89, revised 1/9/90 for a 28' roadway with curb.
Outlot D shall be installed by the subdivider through the
� wetlands area as a rural 24' wide gravel roadway with
ditches and a 16' wide paved surface. Outlot B, the 16' wide
. private driveway serving Lots 1 and 2, Block 2 shall be
installed as a roadway with ditch areas per that same plan.

5. � Subdivider to gr�nt Conserv�tion �nd Flow�ge Easements
over �11 wetl�nd/flood pl�in �re�s defined at or below the
970' elev�tion. The subdivider sh�ll �lso gr�nt dr�inage
easements over dr�in�gew�ys �nd storm sewers not loc�ted
within right-of-w�y of ro�d outlots.
6. Bituminous flumes will be required where water is to
discharge into wetl�nd �re�s.
7. Subdivider' to execute priv�te coven�nts for the shared
cost �nd m�inten�nce and upkeep of priv�te ro�d. The
subdiv'ider m�y wish to use the st�nd�rd form used by the
City for inclusion in the priv�te covenants. In �ddition,
the City will expect priv�te coven�nts to �ddress
" m�inten�nce �nd protection of dr�in�gew�ys �nd retention
�re�s by priv�te property owners. Upon prelimin�ry �pprov�l
, of the pl�t, the subdivider is to dr�ft �ppropri�te priv�te
coven�nts to be submitted to the City prior to the. City
gr�nting �pprov�l of the fin�l pl�t.
. 8. Subdivider to execute a dr�infield covenant to be filed
" ag�inst the ch�in of title of e�ch of the 16 lots within the
pl �t in order to ensure future owner' s knowledge �nd
�w�reness of the special limitations on the septic
c�p�bilities of the rur�l lots �nd the need to protect
existing septic test sites. The following �ddition sh�ll be
m�de to the coven�nt proposed by �pplic�nt. The following
sentence is to be added between sentences 1 �nd 2: "In most
c�ses, these �re the only two fe�sible sites on each lot,
�nd must not be disturbed. The existing n�tural topsoil
must rem�in in pl�ce �nd must not be sub�ect to an� traffic
which will c�use even the slightest comp�ction."
9. The subdivider shall m�int�in �dequ�te erosion control
(per �pproved pl�ns most revised d�te Febru�ry 23, 1990 by
Ger�ld M. Sunde) throughout the construction of the ro�d,
dr�in�ge improvements �nd until �11 ground cover disturbed
on the property is restored.
10. The developer to cre�te e�sements in favor of the
homeowners �ssociation over Lots 1, Block l, �nd Lot 1,
Block 4 for the purpose of m�inten�nce and upkeep of the'
� monuments. The City �pproves the monuments proposed on
plans dated December 19, 1989, revised J�nu�ry 9, 1990 by
• Ger�ld M. Sunde entitled "Typical Monument Det�il" th�t
defines � 5 1/2' high, 10 line�l feet in length, 3' wide
monuments to be inst�lled on e�ch side of the entrance of
the pl�t ro�d.

11. All fin�l gr�ding, dr�in�ge �nd ro�d pl�ns shall be
done in �ccord�nce with the directives of the Minnehah�
Creek W�tershed District permit �nd the fin�l report of the
City Engineer before �ny l�nd alterations or construction
c�n begin. The subdivider sh�ll execute � developer's
agreement th�t sh�ll include �11 required improvements not
completed by the filing of the fin�l pl�t. The subdivider
shall �lso provide � letter of credit to be written to the
�mount of 150$ of the cost of �11 outst�nding improvements
to ensure their completion. The letter of credit must �lso
be submitted prior to fin�l pl�t approv�l by the City. The
subdivider is hereby �dvised that building permits sh�ll not
be issued upon fin�l pl�t approv�l until gr�vel ro�d b�se
hds been �pproved by the City Engineer �nd required dr�in�ge
ponds �nd controls h�ve been inst�lled �nd �pproved by the
City Engineer.
12. The subdivic�er must submit an �pprov�l/permit from the .
Army Corp. of Engineers for proposed l�nd �lterations within
• � wetl�nd/flood pl�in �re�. This permit approv�l must be
submitted before �ny gr�ding takes pl�ce on the property.
FINAL PLAT SUBMITTALS �
The following list of fin�l submitt�ls must be submitted to
- the Zoning Administr�tor two weeks prior to the regul�rly
scheduled Council meeting on the second �nd fourth Mond�ys of the
month:
