A RBSOLIITION VACATING
A IITII�ITY EASEMENT �
WITHIN LOTS 1 AND 2, BLOCR 3, FOX HILL
SECTION 10, TOWNSHIP 117, RANG$ 23 •
IN THE CITY OF ORONO, HENNEPIN COIINTY, MINNESOTA
FILE NO. 1413
WH$REAS, the City of Orono is a municipal corporation
organized and existing under the Iaws of the State of Minnesota;
and
WH$REAS, on May 24, 1989, Daniel A. Hoffman and Jorgen
Viltoft filed a petition with the City of Orono requesting the
vacation of a utility easement orginally dedicated within the
plat of Foxhill and legally described as follows:
A utility easement, being 5' on each side of the lot
• line between Lots 1 and 2, Block 3, Foxhill, according
to the recorded plat thereof , Hennepin County,
Minnesota and runs from the easterly line of said Lots
1 and 2, a distance of 20 feet westerly.

WHEREAS, after due published and posted notice, a
public hearing was held before the Pl.anning Commission on
June 19, 1989 regarding said vacation and all interested persons
were given an opportunity to be heard; and
WHEREAS, after due standing and consideration, the
� Planning Commission voted to recommend approval of the requested„
vacation and this Council of the City of Orono finds that said
vacation as proposed is in keeping with the public interests and ,
in consideration of the fol lowirig findings: �
l. The 20 feet length portion of the utility easement
serves no public purpose.
2. The location of the utility easement within Lot l, Block
3, Foxhill, as amended by a recent subdivision of a lot line
rearrangement finds the above-described utility easement to
place severe restrictions on the building envelope.
NOW, THEREFORE BE IT R$SOLVED, that the petition of
Daniel A. Hoffman and Jorgen Viltoft is hereby granted by the
• Council of the City of Orono and that the portion of the
dedicated utility easement legally described above is hereby
vacated.

Minnesota at a regular meeting held on the 13th day of November,
1989.
