' Melanie Curtis From: Courtney Hall [Chall@minnehahacreek.org] Sent: Tuesday, January 06, 2015 4:20 PM To: Melanie Curtis Subject: 625 Ferndale-Orono Hi Melanie, The work proposed at 625 Ferndale does not appear to trigger an MCWD permit as the proposed addition disturbs less than 5000 sq feet of land and less than 50 cubic yards of material.According to the District's FAW,there are two wetlands on site.The proposed work does not appear to trigger the District's Wetland Protection Rule as there are no proposed impacts to the wetland and the proposed addition does not trigger the District's Stormwater rule or the District's Waterbody Crossing Rule. I have not received an application for a request for wetland boundary and type concurrence for the subject property and therefore cannot officially approve the boundary. However, I did receive datasheets from a delineation that was conducted outside of the growing season. On Wednesday, December 31, 2014, MCWD staff was on site to review the flagged boundary.The boundary could not be field verified as there was snow on the ground at the time of review. Review of the datasheets and figures received on December 18, 2014 suggest that the boundary flagged is representative of the wetland boundary. Please let me know if you have any questions. See City Code Section 78-1605. I understand a wetland delineation was completed, but not submitted to the MCWD for their approval within the growing season. According to the MCWD the delineation cannot be approved at this time. City staff does not have the ability to administratively waive this requirement. I told you last week we can review and approve the two (north and northwest additions) because they appear to be more than 150'from the wetland. The third project(south addition) must be on hold until Spring when the wetland delineation can be to and approved by the MCWD. Let me know how you want to proceed. If I would have known this I would not have paid $2,000 to get it completed ASAP. Either way from the delineation we had completed and surveyed we are 69'from the wetland setback of 35' & the only reason the watershed district is involved is because Orono needed us to get the wetlands delineated within 150'of addition. I would understand if we were a couple of feet away but we are 69'away.. The watershed does not require us to get any approvals from them to complete the project. Please let me know what you think. I'm willing to meet out there anytime. My homeowner is not happy since we planned to start construction December 1St. We are hoping to get rolling ASAP&take advantage of this crazy weather we are having. Thanks again for your help! Following are my comments for City consideration: 1. Silt fence should be indicated on the plan immediately down gradient from proposed work where land will be disturbed. The silt fence should be installed and inspected by the City prior to any land disturbing activities. The Contractor must provide a minimum 24 hour notice prior to inspection. 2. A financial security of$2,500 from the Applicant is recommended for erosion control and engineering oversight.
