I haven't received the City Engineer's review of the grading plan. I will be leaving here shortly and not returning until
December 31. If I receive it before I go I will forward it to you. You will need to get it to Mark Gronberg. My experience
is that is more effective than me emailing it to him. I will check my email this evening and forward it to you if I have
received it. Bonestroo will be closed after today until lanuary 4. I'll occasionally check my email after this evening but if
it doesn't come today, I wouldn't expect it until January. Becky may not be able to reach John Smyth before then either.
Once the comments are received the survey/grading plan needs to be revised to:
• reflect the engineer's comments,
• include the 1,000 foot line from Lydiard Lake (property doesn't drain to Hadley Lake so 1,000 foot line in that
direction is not necessary
• to show any road easement along the south edge of the property(although I could live without this for the
building permit but would like the question answered before the CO so we can have an accurate survey)
Depending on the Engineer's comments it may need to go back for a second formal review or it may be reviewed by the
Engineer in our office. Once we know what is going on with the wetland we will send out the escrow forms for the
owners to sign. (There is a standard escrow of$2,500 and could be a wetland escrow in addition.)
While we will attempt to keep the process moving I think nothing will happen now until lanuary. If the owners are
upset, the probable presence of the wetland was noted on the form they signed (and were given a copy of) before the
old house was demolished.

I thought I would give you an update of what I have found out this week.
I spoke with Becky at MCWD yesterday and she said that she has no objections to our getting going on the
project. She wants to have a conversation with John Smyth to make sure that he is OK with everything but has
not received a call back from her message to him last Friday. She is out on vacation until next Monday and will
try him again then.

Steve:
If the house does not have to be relocated to achieve the 50' impervious surface setback
from the wetland, the zoning review turned up only two issues:
1�°� Buildings in Orono are limited to two stories plus a defined half story. For a
v� � basement to not be considered a story it must be no more than six feet from the
�fP�'� proposed first floor elevation to existing grade for at least 50 percent of the perimeter
of the basement. As proposed the basement would not be considered a story.
��� ��> However, the proposed future addition shown on the survey could not be built as
� existing grade is more than six feet below the �rst floor elevation for its entire
perimeter and the basement would then have to be counted as a story. (This would
be true even if the addition only had a basement and the first story.)
Driveways are limited to 20 feet wide where they cross the property line and 30 feet
wide where they meet the pavement of the road.
The northwest part of property is subject to hardcover regulations because it is within
1,000 feet of Lydiard Lake and within the drainage area of that lake. (The easterly part of
the property may be within 1,000 feet of Hadley Lake but is not within its drainage area so
is not subject to hardcover regulations.) The hardcover zone(s) should be shown on the
survey and hardcover calculations prepared. (It appears this area will be allowed 35%
hardcover so it is unlikely to be an issue.)
Once the wetland has been delineated and the delineation accepted by the MCWD it too
must be added to the survey. The 50 foot wetland buffer and the 20 foot building setback
from the buffer must also be shown. See the "construction near a wetland" information

Mark Gronberg is familiar with hardcover and wetland buffers. Be sure to remind him that
separate legal descriptions are required for the wetland and for the buffer.
This is about all we can do until we receive the updated survey. It will then be sent to the
City Engineer for review, which takes about a week. Then the building code review will be
done.

The septic review has been completed. I started the zoning review but find no wetland
delineation in the file or with your application. Our maps indicate there is a wetland in the
southeast corner of this property and on adjacent property near the northerly boundary of
this property. Please provide a copy of the delineation and the MCWD acceptance. If a
delineation found there was no wetland, I still need a copy of the report and the MCWD
acceptance.
I would guess you are anxious to get the house started before the ground freezes. However
the wetland in the southeast corner of the property requires a 50' foot impervious surface
setback. Because it is possible that the location of the house will change I stopped my
review. No further review will be done on your application until the wetland information is
received.
You can drop off the delineation and acceptance letter at city of�ces or email them to me.
