A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONIi�'G CODE SECTIOv 78-420(b) FILE NO. 06-3226 WHEREAS, Edward and Nancy Biei7nan, husband and wife, (hereinafter "the applicants") are owners of the property located at 505 Ferndale Road North within the City of Orono (hereinafter "City") and legally described as Lot 2 Block 1 Faiitivay View, Hemiepin County, Miiulesota (hereinafter "the property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-420 to allo�v a side setback of 21 feet �vl�en 30 feet is reqtiired; and WHEREAS, after due published notice and mailed notice in accordance with Miiulesota Statutes and the City of Orono Zoning and Plaiuling Codes, the Orono P1aiuling Commission held a public hearin� on October 16, 2006, at which times all persons desiring to be heard conceming this application were given the opportunity to speak thereon. T•it�d�, 'I'HE��'OR�, ��E IT �1ES03��JlCI) by the City Couzlcil of Orono, Miiulesota: FINDINGS l. Tl�is application was reviewed as Zoning File #06-3226. 2. The variance is requested for a house and attached Qarage that �vere constnicted in 19�1. The side setback of the attached garage is 21 feet. 3. The property is zoned LR-1B and was so zoned in 19�1. The required side setbacic is 30 Feet and was �0 feet in 1981. The building pei-mit survey indicates the side setbacic for the garage �vas to be 30 feet. 4. The house was constructed with a permit and proper inspections. There is no indication in the file that there ���as any question about the location of the side lot line. The applicaalts were not involved in construction of the house. They purchased it si� years after it «-as built with the espectation that the house ���as conforming or legally non-conformin�. b. To Urin� the �ara�e into confonnance with the setbacl: would require total reconstructiozz of the tlu�ee-car garage. Because of the anale between the gara�e ��ing and main portion c�f the i1GliS�, I'cCOI15tI'L1Ct1011 Of the adjacent utility room ���ould probably be necessary as well. c. Allowing the �arage to remain ��-here it is ��-ould not be detrimental to the surrounding properties. The house on the adjacent lot is over 180 feet fi•om the applicailts' Qarage so the reduced setbacic is not readily apparent. 5. The City Cotulcil has considered this application including the findin�s and recommendation of the Plarulin� Corrunission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the conuiiunity. 6. The Citv Council finds that the conditions existing on this property are peculiar to it and do not apply Qenerally to other property in this zoning district; that Qrantin� the variance �vould not adversely affect traffic conditions, li;ht, air nor pose a fire hazard or other danger to nei�hborin� �roperty; ��•ould not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty: is necessary to prese.rve a substantial property ri�ht of the applicants; and «ould be in keepinQ �vith the spirit aud intent of the Zonin� Code and Comprehensi��c Plan of the Cit�-.
