The analysis contained within staff memos and the exh�ibits attached to the aforesaid memos, all minutes from the above mentioned meetings, and any and all othe�.materials distributed at these meetings�re hereby incorporated by reference. A2. The Property is located within the RR 1B Single Family Rura1 Residential District which requires a minimum lot a�ea of 2.0 acres and a minumum lot width of 200' for construction of a singte family residence. A3. The Property is 0.39 acres in area, being 100 fe�t in defined width, Thc pmperty is considered as legally nonconforniing with regard to lot area and lot width. A4. The Property is located within Storm Wa�ter Overlay District Tier 3 which allows 35% hardcover. The ptoposed resideace construc�ion will result in hardcover on the Froperty of approximately 15.5%,well below the ma�cimum batdcover allowance. A5. The Owners are pl8aning to cons�uct a n�,hOme o��vacant lot. The lot is just under 4/10 acre in the RR 1 B 2-acre zone, e� is a corner lot with the Arbor Stmet frontage defined as front. The Property has sewer available and was assessed for sewer in 1985, ��e�PertY was assumed to be buildable as a combinstion of two lots at that tizne, as evidenced by City Council Resolution No. 1797. The Property vvill be se�tyed by � private well. The pzoposed 2-story home incl�des an att�hed garage and has an overall footprint of approximately 1850 s.f.including deck and porches. '1$e house is proposed as a`lookout'rather than,a walkout due to the relative flatness of the lot,and as proposed will have e defined heiglYt of just over 26 f�eet,meeting the 30' limit. A6. The Ovvners are requesting a number of variances,as the buildable envelope under RR_�S sa'tback s�andards is app�oxi.mately 24 feet in width and 60 feet in lengtl� and would not allow sufficient footprint area for a reasonably sized home. A7. The Property at 100'wide and less than 1/2 acre in area is typical of lots in the Crystal Bay nei8hborhood,the majority of which was platted in 1909 and 1915. Over the past ce�y, individual lots as well as double lots and a few triple or largen�lots have been built on with single family homes. 'The RR_1$ zonin�g of the Crystal Bay neighborhood is a reflectian of the surrounding rural area,and hes nev�been revised to reflect the actual n�ighborhood lot sizes crea�teed 100 years ago, Rez.oning to more closely match the prevailing lot sizes has been discussed in the past but not acted upon. It is noted that Qrono°s %2_acre zone standards would allow for a 0.5 acre lot and 100' width,with setbacks of 30'front and rear, 1 U' sides,and 15' side stree� 2 ��� CI� oF ORorro x�soLVTTrnv oF�crrY covxcn, �� �•�' No- 6 6 5 9 � sHo�,� A8. The Qv�mers are praposing to meet the required 50' rear yard setback. The front setback varixnce is for a setback of 20.4 feet for the porch,with the bulk of the house being 26 feet from the street lot line. Tvis setback is generally in line with the e�cisting hous� to �he immediate north, and is typical of many other lots in the neighborhood, which l�eve front setbacics ranging from 17-18 feet to as much as 40-SQ feet. The n�d for the shortened setback is in part due to the topography of the lot and its relation to the `lookout' configuration. With regatd to the side setbacks of 25' snd 23', �ese pla�ce the house S��y��ed on the lot,which will avoid visual crowding in the neighborhood. It is noted thgt under%Z-acre standards these would be conforining sctbacks. A9. In considering this application for variances, the Council h$s considered the advice and recommendaxion of the Planning Comumission an�d the effect of the proposed variances upon the healtb, safety a� welfare of the community, existing and a�icipa�ed tra�'ic conditions, light and air, danger of fire,risk t�the public safety, and the effect on values of properiy in the surrounding area. VARIANCE ANALYSIS: B1. "Variances shall only be permitted when they are in harmony with the general purposes aad intent of the ordin�snc� . . . ." Smgle famiiy homes and the aseoCistted�uneni�ttes are permfitted osea in the RR 1B districk T6e reqa�variancea if granted would aaow construction of a smgle family home on the Property. The proposed reaidence is a Si�e family honie on a smnR tot in a neighborhood of 'simil:riy sixed lots with�imi�r eetbacks. B2. "Variances shall only be pernutted... wl�n the variances are consistent with the comprehensive plan." The praposed new residence $tractare ia consi8tent witb tLe comprehensive plan guiding of this and sarroanding pruperties for residentisl use. B3. "Variances may be graated when the applicant f�or the variance establishes tbst there are practical difficulties in canplying with the zoning ardinance. `Practical difficulties,' as used in conn�ion with the granting of a vatisnce,means that: i. The p�operty owner in question pmposes to use the propetty in a n:asonable menner, howevex,the praposed use is not permitted by the official co�d+ols.,, u. The plight of the landowner is due to circums�aces unique to his property not er�a� by the iandowner.,, iii.
