WHEREAS, William A. Grierson and Robin W. Grierson, husband and
wife (hereinafter "the applicants") axe the owners of the property located at 1989
Fagerness Point Road within the Ciry of Orono (hereinafter the "City") and legally
described as follows:
Attached as Exhibit A and hereinafter the "property"; and
� WHEREAS, the applicants have made application to the City of Orono
for. a variance to Orono t�Iunicipal Zoning Code Sections 78-1279 and 78-1288
Subdivision A to allow construction of an addition to the western portion of the home to
extend into the 0 -7�' setback from the OHWL of Lake Minnetonl:a; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-�288 Subdivision B to allow
hardcover within the western 0 - 7�' setback zone of 4% or 420 s.f. where 0% is normallv
allowed and 7.3 % or 7�� s.f. currently exists, and to allow hardcover within the 75-��0'
setback zone of �l% or ?,4�� s.f. where 43% or ?,046 s.f. currentiv exists in order to
constn�ct a covered front entr�� anG a western ;al:e vard addition to the existing home.
NOW, THEREFORE BE IT RESOLVED b�� the Cit�� Council of
Orona Mirulesota:
FINDINGS
l. This application was reviewed as Zonin� File #04-3061.
2. The property is located in the LR-1C, Sin�le Familv Lakeshore
Residential Zonin` District which requires a minimum lot area of 0.5 acre
and a minimum lot width of 100'.

3. The Planning Commission reviewed this application at a public hearin�
held on October 18, 2004 and recommended approval of variances to
Municipal Zoning Code Section 78-1288 Subdivision B based on the
followina findin�s:
a. The property has 0.48 acre or ?l,?17 s.f. in area and 130' at the lake
and 135' at the 7�' setback on the western I��keshore side and 69' at
the lakeshore and 104' at the 7�' setback on the eastern lalceshore side.
b. The property is located on FaQerness Point Road and has 0-7��
lakeshore on two sides.
c. There is no additional land available for acquisition by the applicants
to make the property conforming. �
d. The proposal will not have a ne�ative impact on li�ht, air or open
space within the nei�hborhood. y
e. The proposed additions are not out of character for the immediate
neiahborhood.
f. A portion of the western side of the existing home is located within
7�' of the OHWL of Lake Minnetonl:a.
g. A hardcover variance in the 75-2�0' zone is supported by the
followina hardships:
i. The proposal will result in a net reduction of 0-75 hardcover
on the western portion of the property of 3?7 s.£ ar 3%.
ii. There is no additional hardcover that can be reasonablv
removed from the 7�' —?�0' setbacl: zone.
h. Each of the proposed additions will be constructed in a conforming
location.
4. The PlanninQ Commission reviewed this application at a public hearing
held on October 18, ?004 and recommended denial of a variance to
Municipal Zonin� Code Sections 78-1?79 and 78-1?88 Subdivision A to
allow construction of an addition within the westerly 0-7�' setback zone
based on the following findings:

a. The PlanninQ Commission did not find siynificant hardship to allow
new construction within 7�" of the OHWL as the additions could be
constructed in conforming locations.
�. The City Council has considered this application including the findinas
and recommendation of the Planning Commission. reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the communitv.
6. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neiahboring
property; would not merely serve as a convenience to the applicants, but is �
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property ri�ht of the applicants; and would be in
keepinQ with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findin�s, the Orono City Council hereby
�rants variances to Orono Municipal Zoning Code Section 78-1288 Subdivision B to
allow hardcover within the western 0-75 setback zone far 4?0 s.f. or 4°/o where 7�� s.f.
or 7.3% currently exists and 0% is normally allowed and within the 75'-250' setback
zone for 2,448 s.f. or �l°/o hardcover where 2,046 s.f. or 43% currently exists and 2�% is
normallv allowed and denial of variances to Orono Municipal Zoning Code Sections 78-
1?79 and 78-1?88 Subdivision A to allow construction of home additions to encroach
into the 0-75 setback from the OHWL. subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit B. Any
amendments to the site plan which are not in conformity with City codes will
require further Plannin� Commission and City Council review. �
2. Hardcover in the western 0-75' zone shall not increase above the level of 4% or
4?0 s.£, and hardcover in the eastern 0-75' zone shall not increase above the level
of?6% or 1,431 s.£ (not including 864 s.f. of driveway which serves the property
to the south). Hardcover in the 75-250' zone shall be limited to �.448 s.f. or 51%

per the proposed plan and hardcover allowance sumrnarv as depicted on Exhibit
B. Applicants are advised that any future requests to increase hardcover or
change the nature of existina/approved hardcover shall require City approval. and
increases in hardcover will not likely be approved without concurrent reduction in
existina hardcover.
3. Applicants shall remove all plastic or fabric liner material from tl�e decorative
landscape beds on the property to ensure their permeability as non-hardcover
surfaces.
4. Required removals of structure and hardcover shall be completed by the footing
inspection.
�. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zonina code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
This resolution supersedes Resolution No. �249.
