Grierson and Robin W. Grierson, husband and wife (hereinafter "the applicants") are the owners of the property located at 1989 Fagerness Point Road within the City of Orono (hereinafter the "City") and leQallv described as follows: Attached as Ethibit A and hereinafter the "property"; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zonin� Code Sections 78-1�79 and 78-1288 Subdivision A to allow construction of an addition to the western portion of the home to eXtend into the 0 -7S setback from the OHWL of Lake Minnetonka: and WHEREAS, the applicants have made application to the City of Orono far a variance to Orono Municipal Zoning Code Section 78-1?88 Subdivision B to allow hardcover within the western 0 - 7�' setbacic zone of 4% or 420 s.f. where 0% is normally allowed and 7.3 % or 755 s.f. currentiv exists, and to allow hardcover within the 7�'-��0' setback zone of �1% or ?,45� s.f. where 43% or �,046 s.f. currently exists in order to constract a covered front entr� and a��e�tern ia1:e yard addition to the existing home. The property is located in the LR-1 C, Single Family Lakeshore Residential Zonin� District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. The Planning Commission reviewed this application at a public hearing held on October 18, 2004 and recommended approval of variances to Municipal Zoning Code Section 78-1288 Subdivision B based on the followin` findin�s: a. The property has 0.48 acre or 21,?17 s.f. in area and 130' at the lalce and 135' at ihe 75' setback on the �Nestern lakeshore side and 69' at the lakeshore and 104' at the 7�' setback on the eastern lakeshore side. b. The property is located on Faaerness Point Road and has 0-7�" lakeshore on two sides. � c. There is no additional land available for acquisition by the applicants to make the property conformin�. d. The proposal will not have a ne�ative impact on li�ht, air or open space within the neiQhborhood. y e. The proposed additions are not out of character for the immediate nei�hborhood. £ A portion of the western side of the existing home is located within 7�' of the OHWL of Lake Minnetonka. g. A hardcover variance in the 75-250' zone is supported by the followina hardships: i. The proposal will result in a net reduction of 0-7�' hardcover on the western portion of the property of 3?7 s.f. or 3%. ii. There is no additional hardcover that can be reasonablv removed from the 7�' —��0' setbacl: zone. h. Each of the proposed additions will be constructed in a conforming location. 4. The Planning Commission did not find siynificant hardship to allow new construction within 7�' of the OHWL as the additions could be constructed in conforming locations. �. The City Council has considered this application including the findinas and recommendation of the Plannin� Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the communitv. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the va;riance would not adversely affect traffic conditions, li�ht, air nor pose a fire hazard or other danger to neiahboring property; would not merely serve as a convenience to the applicants, but is � necessary to alleviate a demonstrable hardship or difficultv; is necessary to preserve a substantial property ri�ht of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono Citv Council hereby �rants variances to Orono Municipal Zoning Code Section 78-1288 Subdivision B to allow hardcover within the western 0-7�' setback zone for 4?0 s.f. or 4% where 7�� s.f. or 7.3% currently exists and 0% is normally allowed and within the 75'-?�0' setback zone for 2,448 s.f. or �1% hardcover where 2,046 s.f. or 43% currentiv exists and 25°/o is normallv allowed and denial of variances to Orono Municipal Zonin� Code Sections 78- 1�79 and 78-1288 Subdivision A to allow construction of home additions to encroach into the 0-7�' setback from the OHWL. subject to the following conditions: l. Council approval is based on the site plan submitted by the applicants and annotated by City staff. attached to this Resolution as Exhibit B. .Anv amendments to the site plan which are not in conformity with City codes will require further Planning Commission and Citv Council review. � 2. Hardcover in the western 0-7�' zone shall not increase above the level of 4% or 420 s.f., and hardcover in the eastern 0-75' zone shall not increase above the level of 26% or 1,431 s.£ (not including 864 s.f. of driveway which serves the property to the south).
