& WAIVER OF DAMAGES WITHIN

WH$REAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHLR$AS, on June 23, 1989, Clifford Otten of Otten
Brothers Nursery filed a petition with the City of Orono
requesting the release and termination of any rights it may have
in Outlot A, Ringerswood resulting from or created by that
certain Flowage & Conservation Easement and waiver of damages
dated April 2, 1982, and filed December 8 , 1982 as Document
#1492901.
• WHEREAS, after due published and posted notice, a
� public hearing was held before the Planning Commission on October
21, 1989 regarding said vacation and al 1 interested persons were
given an opportunity to be heard; and
_ WHLREAS, after due standing and consideration, the
Planning Commission voted to recommend approval of the petition
and the Council of the City of Orono finds that said request as
proposed is in keeping with the public interest, in consideration
of the following findings:
l. The proposed petition is part of� a comprehensive
• replatting of Outlot A, Lots 1 and 2, Block 3, Ringerswood.
The subdivision of a replat of the 3 properties will provide
drainage easements and appropriate conservation and f lowage
easements as required by the subdivision regulations of the -
City of Orono.
2. The portion of the conservation and f lowage easement as
it exists in the replat of Outlot A serves no public
purpose. Replatting of Outlot A, Ringerswood will provide
drainage easements over drainageways and detention ponds as
required by- the subdivision regulations of the City of
Orono.

NOW, THEREFOR}3 BS IT RESOLVED, that the petition of
Cliff Otten of Otten Brothers Nursery is hereby granted by the
Council of the City of Orono and that the conservation and
�lowage easement as described above is hereby released and
terminated.
Adopted by the City Counci 1 of the City of Orono at a
regular meeting held on this 23rd day of April, 1990.
