Mulvanny (hereinafter "the applicant") is the owner of the property located at 559 Park Lane within the City of Orono (hereinafter "City") and legally described as follows: Lots 9 and 10, Block 6, Minnetonka Summit Park, Hennepin County, Minnesota (hereinafter "the property"); and WH$REAS, the applicant has applied to the City for variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 to permit the construction of a room addition which will result in hardcover on the property in excess of the 25g hardcover normally allowed in the 75-250' zone, and which addition wi�l encroach 8' past the defined average lakeshore • setback line where no encroachment is normal ly allowed. NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono, Minnesota: . � FINDINGS 1. This application was reviewed as Zoning File #1459. 2. � The property is located in the LR-1B Single Family Lakeshore Residential Zoning District. 3. The Orono Planning Commission reviewed this application on September 19, 1989, and recommended approval of the proposed variance based upon the following findings: A) The 8' average lakeshore setback encroachment has no significant impact on lakeviews enjoyed by neighboring property owners. Furthermore, the proposed addition is located approximately 100 ' from the shoreline. B) Hardcover in the 75-250' zone will decrease by 30 s.f., from 34.76� down to 34.51�, as a result of this proposal. The significant areas of hardcover on the property are general ly necessary for functional use of • the property. . Th�e City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Counci 1 f inds that the conditions existing on this property are peculiar to it and do not apply generaZly to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alZeviate a demonstrab].e hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLIISIONS, ORDffit AND CONDITIONS • Based upon one or more of the findings noted above, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.22 , Subdivisions 1 and 2 to permit the construction of a room addition on the lake side of the. house, which addition will encroach 8' past the defined average lake- shore setback line where no encroachment is normally allowed, and � which addition will result in hardcover in the 75-250' zone in the amount of 34.51� where on�y 25� hardcover is normally allowed, subject to the fol lowing conditions: � 1. Hardcover in the 75-250' zone shall not exceed 34.51$ � per the survey/site plan and hardcover documentation attached to this resolution as Exhibit A. The applicant is placed on notice that any proposals for future hardcover on the property will not be approved, but might be approved only in conjunction with concurrent removals of pre-existing hardcover resulting in no net increase of hardcover on the property. 2. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shal 1 automatical ly terminate any authority granted herein, and shall be punishable as a misdemeanor: 5. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
