A RESOLIITION GRANTING

VARIANCES TO
MUNICIPAL ZONING COD$
SECTION 10.25, SDBDIVISION 5 (B) AND __
SBCTION 10.22, SIIBDIVISION 2

WHER$AS, George & Theresa Bloom (hereinafter "the
applicants") are the owners of the property located at 1374 Rest
Point Road within the City of Orono (hereinafter "City") and
legal ly described as Lot 1, Block 1, Rest Point, Hennepin County, y
Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.22, Subdivision 2
to al low the construction of an attached garage resulting in an
increase of 660 square feet of structural hardcover within the
75-250' setback area with the simultaneous removal of 45 square
feet of non-structural hardcover within the 0-75' setback area
• and 598 square feet of non-structural hardcover in the 75-250'
setback area resulting in a final total of 38.6� of hardcover on
the property, and per Section 10.24, Subdivision 5 (B) seeks
approval of a 32' street setback for the garage where a 35'
setback is required resulting in a 3' or 8$ setback variance.
NOW, THEREFOR$, BE IT RE�SOLVSD by the City Council of
Orono, Minnesota:
FINDINGS
l. This application was reviewed as Zoning File #1451.
, 2. The property is located in the LR-1B Single Family
Lakeshore Residential Zoning District requiring 1 acre or
43,560 square feet in area. The property consists of .66
acres or 28,850 square feet.
3. The Orono Planning Commission reviewed this application
on September 6, 1989, and recommended approval of the
proposed variances based upon the following findings:
A) The property is served by municipal sewer.
B) One-third of the total area of this property is
located within the 0-75 ' setback area.

C) The existing drainage pattern of the property
provides for positive drainage to the lake over
extensive grassed yard areas.
D) The proposed improvement of the property wi 11 not
result in an increase in total hardcover.
E) The current residence does not have a garage nor a
basement area to provide additional storage area.
F) The proposed street setback for the attached garage
will prevent the cutting into the existing root system
of a group of trees well over 100 years old located in
the east yard area.
4. The City Council has considered this application
including the findings and recommendations of the Planning
Commission, reports by City staff , comments by the
applicants and the effect of the proposed variances on the
health, safety and welfare of the community.
" • 5. The City Council finds that the conditions existing on
this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
variances would not adversely affect traffic conditions,
� light, air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the applicants , but is necessary to
alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive P lan of the
City.
CONCLDSIONS, ORDSR AND CONDITIONS
Based upon one or more of the findings noted above, the
Orono City Council hereby grants variances to Municipal Zoning
Code Section 10.22, Subdivision 2 and Section 10.24, Subdivision
5 (B) that would permit the const'ruction of an attached garage
based on the simultaneous removal of existing non-structural
hardcover on the property as noted above, subject to the
following conditions:
1. Applicants shall remove all hardcover as proposed in
amended plan (Exhibit K) at the time of the footing
• ' inspection for the proposed garage addition.

'' uthorities granted by this resolution run with the
property not with the applicants, but are permissive only
and must be exercised by application for a building permit
within one year of the date of Council approval, or this
variance will expire on that date (September 25, 1990).
3. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicants have read, understood and
hereby agree to the terms of this resolution and on behalf
of themselves, their heirs, successors and assigns, hereby
agree to the recording of this resolution in the chain of
title of the property.
Adopted by the City Counci 1 of the City of Orono,
Minnesota at a regular meeting held on the 25th day of September,
1989.
