A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 75-350 (B) AND 78-1288 (B)
IFILE NO. OS-3150
WHEREAS, Kevin J, Grell, a sin�le person (hereinafter "the applicant")
is tlie o��ner of the propei-ty located at 194� FaQerness Point Road within the City of
Orono (hereiilafter the "City") and legally described as follows:
Lot 2, Blocic 1; FAGERNESS GREEN, includin� the accretions to said Lot 2
lying between the southerly line of tTNDER THE LINDEi�,T AVENUE as sho�7i
on the plat of FAGER.I�tESS and the shoreline of Lalce Minnetorilca and between
the southerly extensions of the Easterly and Westerly line of said Lot 2 to said
shoreline according to the recorded plat thereo£ Heiinepin County, Minnesota
(hereinafter the "property"); and
V6��IEl�AS, the applicant has made application to the Ci�� of Orono for a
rear yard setback variance and 7�'-2�0' zone hardcover variance to Orono Municipal
Zoning Code Sections 78-350 (B) and 78-1288 (B) to allow construction of a 14' a 38'
decic 13.6' from the rear property line where 30' is normally allowed and 13.6' currently
exists and a hardcover variance to pernlit 26.3% hardcover within the 75'-2�0' zone
where 25% is normally allowed, 31.7% currently exists, and 28.6% was previously
approved by a 1997 variance resolution.

3. The Plaiuiing Conunission reviewed this application at a public hearing
held on September 19, 200� and recommended approval of the variances
based on the followin�tindinas:
a. The existinD home maintains a 13.6' rear yard setback and the
proposed decl: would not be located any closer than the e�istin�home.
b. The deck will be accessed by an existin� door that requires a landin�
and which already encroaches on the required 30' rear yard setback.
c. The findinas and conditions of variance resolution #3888 approved in
1997 remain in place and valid, W�11CI1 approved 28.6% hardcover
witlun the 75'-��0' zone.
d. City records indicate the deck «�as permitted and conformin� in June
of 1981.
e. A reduction of 396 s.f. of hardcover within the 75'-250' is proposed
which reduces the hardcover beyond the 28.6% approved level in
1997.
4. The City Council has considered this application includina the findin�s
and recommendation of the Plaruling Coinmission, reports by City staff;
coinrnents by the applicant and the public, and the effect of the proposed
variances on the health, safety and welfare of the community.
5. The City Council finds that the conditions e�istii7� on this property are
peculiar to it and do not apply �enerally to other property in this zoning
district; that granting the variances would not adversely affect traffic
conditions, libht, air nor pose a fire hazard or other danaer to neighborin�
propert�-; would not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant: and would be in
lceeping with the spizit and intent of the Zonin� Code and Comprehensive
Plan of the City.

CONCLiTSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
crants a rear yard setbacl: variance and 75'-2�0' zone l�ardcover variance to Orono
Municipal Zoning Code Sections 78-350 (B) and 78-1?88 (B) to allow construction of a
14' x 38' deck 13.6' from the rear property line ��°here 30' is nomzally allowed and li.6'
currently eaists and a hardcover variance to pernlit 26.3% hardcover within the 7�'-?�0'
zone where 25% is nornlally allowed, 31.7°�o currently eaists, and 28.6% was previously
approved by a 1997 variance resolution, subject to the followin� conditions:
1. Council approval is based on the site plan submitte.d by the applicant ai�zd
annotated by Cit}r staff, attached to this Resolution as Exhibit A. Any

require further Planning Conunission and City Council review.
2. Hardco��er in the 75-2�0' zone shall be limited to 4,534 s.f. or 26.�% per the
proposed plan and hardcover allowance summary as depicted on E�hibit A.
Applicant is advised that any future requests to increase hardcover or change the
nature of existina/approved hardcover shall require City approval, and increases
in hardcover will not likely be approved tiuithout concun�ent reduction in e�istin�
hardcover.
3. Applicant shall remove all plastic or fabric liner material fi-om the decorative
landscape beds on the property to ensure their pernleability as non-hardcover
surfaces.
4. The shed located in the northwest corner of the property must be removed prior to
a footin� inspection on the proposed deck.
�. Authorities ai'allted by this resolution run �vith the property not with the applicant,
but are pernzissive only- and must be e�ercised by obtainin� a buildina permit for
the ne�� construction ��-ithin one year oT ihe date of Council approval, or the
variances will expire on that date (September 26, 2006 j.
5. Violation of or non-compliance with any- of the tezms and conditions of this
resolution shall constitute a vioiation of the zonina cocte, shaii automaticaliy
ternlinate any authoritv aranted herein, and shall be punishable as a misdemeanor.
