Dear Mr. and Mrs. Kramer:
Our records indicate you are the owners of the above referenced
property upon which a dock anci boat slips have apparently existed
since the early 1960' s. By way oi realtor inquiry each time a
property within the subdivision of t•laplegate Inlet is for sale, the
City has become aware tliat at some time in the past, easements may
have been created which purport to grant boat docking rights to off-
lake property owners in the Maplegate Inlet Subdivision .
While the City is not in a position at the moment to conclude whether
such easements are legitimate or legal, it is clear that this use has
continued for many years without the required Joint Use Dock license.
The requirement for a Joint Use Dock license has been in effect since
1963 . A copy of the current ordinanr.e is attached for your review.
According to City records, you purchased the subject property either
clirectly from Eberhardt Company or as a tax forfeit parcel , in 1981.
In 1978 , Eberhard.t Company had been advised of the need for the
license, but never followed through.
Our files also indicate informal discussions between you and Building
Inspector Tom Jacobs in 1986, referencing illegal boats being docked
on the property. There is no clear indication in our file that you
have previously been formally advised of the need for a Joint Use Dock
license.
The license application form has been enc]_osed for your use. Please
submit the complet.ed app]_ication and appropriate fee as soon as
possible. If there is a formal or informal homeowner's association to
which this letter should be copied, please advise.

Re: Illegal Boat Docking at Lot 31, Coffey's Addition to Shadywood
Dear Mr. and Mrs. Rademacher:
Hennepin County tax records indicate you are the owners of the above referenced property upon
which a dock and boat slips have apparently existed since the early 1960s. The City is aware
t:1at at some time in the past, easements may have been created which purport to grant boat
docking rights to the off-lake property owners within the Maplegate Inlet subdivision.
Use of this dock system by the easement holders requires that a joint use dock license be
obtained from the City per Municipal Code Section 5.42 (attached). No joint use dock license
has ever been obtained for this dock system. You are currently in violation of the licensing
requirements.
Further, during a recent lakeshore inspection tour, City staff found that all seven boats docked
at the site are registered to persons other than property owners within the Maplegate Inlet
subdivision. By definition, such use constitutes the "business of docking, mooring, or storing
boats" which is not allowed in residential zoning districts.
You are hereby required to immediately take the following actions:
1. Discontinue the dockage of boats not registered to property owners within the plat
of Maplegate Inlet.
2. Apply for the appropriate joint use dock license for use uf the slips by Maplegate
Inlet homeowners' boats only.
A joint use dock license application is enclosed for your use, plus a listing of the owners of the
boats which were docked at the site on June 2nd.

��t ORDINAi�tCE TO AMEND THE ORONO MUNICIPAL CODE BY REVISING
SECTION 5.42 AND ADDING SECTION 5.43 RELATING TO BUSINESS AND JOINT USE
OF LAKE FACILITIES
The City Council of Orono ordains as follows:
SECTION 1. Section 5.42 is hereby amended as follows:

Subd. l. Definitions. For the purpose of this Section, the following terms
have the meanin�s �iven them:
�,. "Boat Slip, Water" means a structure, space, dock or other thing
designed or used for the docking, moorir.� or storin� of a boat temporarily or permanently in
or on water, including mooring posts, buoys or other devices.
B, "Boat Slip, Land" means a structure, space or other thing designed
or used for storing a boat temporarily or permanently on land adjacent to a lake, whether it is
located on or off the licensed premises.

Subd. 5. Joint Use Standards. Joint uses shall adhere to the followin�
standards:
A. Anv association of riparian and/or non-rinarian landowners within
a subdivision ad'acent to the lake which initiates a new 'oint use shall adhere to LMCD
reQulations and no such use shall have more than one boat sli er 50 feet of shoreline as
measured b a straiQht line between the oints at which the side lot lines meet the OHWL.
Further all such use shall adhere to the Shoreland Mana ement Re lations of Section 10.�6.
B. Anv 'oint use in the RS zonin� district by a not-for-profit
or¢anization or association rovidina transient boat sli s for stakeholders of a ro em used for
dav-use recreation or overniQht cam in� u oses shall be allowed onlv in con�unction with a
valid conditional use ermit for said use issued bv the Council.
C. ParkinQ facilities not allowed No ioint use shall be approved
which necessitates rovision of arkina stalls or which creates the need for arkinQ on anv street
riQht-of-wav.
SECTION 2. Section 5.43 is hereby added as follows:
SEG 5.43. MARINA BUSLNESS LICEtiSE.
Subd. l. Definitions For the purpose of this section the terms "Boat Slip,
Wa[er". "Boat Sli , Land" "Boat Sli , Permanent". and "Boat Sli , Transient shall have the

A. "Business Use" means en�aQinQ in either a marina business or the
business of dockinQ moorinQ or storinQ boats.
B. "Marina Business" means enQaQin�in one or more of the oermitted.

C. "Business of Dockin4 Moorin� or StorinQ Boats" means rentina
or otherwise rovidin s ace includin boat buovs for dockin� moorinQ or storinQ one or more
boats belon7in�to,�ersons other than the owner or occupant of the propertv ercept when
licensed as a joint use.
Subd. 2. License Required It is unlawful for anv persons to enaa�e or

licensed under this section shall be sub�ect to the re uirements and erformance standards of the

�. Insurance Re uired. Each business shall rovide certification of
liabilitv insurance coveraae for the duration of the license eriod.
B, The rimarv business o erator on the ro ertv shall be the
licenseholder. and shall be res onsible for notifvin the Citv of anv and all businesses subleased
on the remises. Such seconda businesses shall not be se aratel licensed but shall be allowed
onlv when in conformance with the rovisions of the B-2 zoninQ district standards.
C. O eration Standards. Each business licensee shall adhere to the
followina minimum operation standards:
1, Parkina facilities on the site shall be mana�ed so as to
eliminate traffic or arkinQ conaestion, etiminate ille al on-street arkina and avoid edestrian
traffic throuah nei�hborin� propertv.
2. Boat enaine testinQ and charQinQ shall be limited to the hours
8•00 a m to 6:00 p.m.
3. Retail sales and service shall be limited to the hours 7:00
a.m. to 10:00 .m. exce t as necessarv to accommodate normal fishina activitv or rivate use
of premises stored boa[s.
4. The site shall be ke t neat and orderlv, and free of Qarbaae.
5. On land storaQe of boats shall be manaaed so as to eliminate
an view obstructions for traffic enterinQ and leavinQ the site.
6. ParkinQ and on-land stora�e of boats, trailers materials and
e ui ment shall be limited to those locations shown on an a roved site o eration lan, which
lan shall be submit[ed or u dated as art of the annual license a lication. Such site o eration
nlan shall also indicate seasonallv variable uses.

�. Liahts shall be shielded from the road, the lake, and adiacent
properties.
Subd. 6. Business Use Licenses Limited to B-2 Zone. No business use shall
be licensed in an zoninQ district other than B-2 exce t that when a business use is allowed bv
ordinance in another zonin� district such use conducted in said district shall not be re uired to
obtain a license.
Subd. 7. License Revocation. Failure to adhere to the business use license
standards of Subd. 5 A throu�h C shall be cause for license sus ension or revocation er the
provisions of this chapter.
SECTION 3. Adoption and Publication. This ordinance shall be published in THE PIONEER
and THE LAKER and shall become effective immediately upon publication. Adopted by the
Ciry Council of Orono on the 28th day of June, 1993 by a vote of 3 ayes, 1 nay and 1
abstention.
