Due to the City's request, for a site survey and the additional costs we would assume, we have decided to cancel the entire project. We require additional information to be submitted in order for our review to continue. In 2010 a permit was issued for an expansion of the kitchen and at that time the permitee and property owner were notified that further expansion projects on the property would require submittal of an updated survey. Please see the attached permit detail as well and the most current survey the City has on file for the property. The property is located in the shoreland overlay district and hardcover restrictions apply. I have included a map to illustrate that there may be a Manage 1 wetland on your property. Hardcover regulations can be found under City Code Section 78-1288 and the wetland regulations begin at City Code section 78-1601. Another ball dropped by last year's contractor builder! I do have have some concerns regarding the copies you forward to me. I had not seen these before • The permit# 00410 copy you forward to me, which states that a site survey would be requested if there was additional build, was initialed by "CD" not me or my husband. The contractor builder's name is: Charles from KMS Associates. I question that a "contracted" employee can sign agreements for my property without my consent. This notation is not construed as an agreement. It is a courtesy advisory notification only. The signature is an acknowledgement by the builder that he has seen the advisory comment, not that he agrees to it on the property owner's behalf.The fact that the builder never provided the owner with a copy of the issued permit is between the owner and the builder. The fact that the City issued a permit with this advisory has no bearing on whether the owner is now required to provide a survey in order to obtain a permit for additional work not covered by the prior permit. • The permit# 00410 copy you forward to me has the owner listed as McKee, Mr. & Mrs. Melvin. This is incorrect. At the time of the permit request my husband and I were the property owner. The paperwork I have in my possession from KMS and Charles states "Hyland". The City's permit system defaults to the owner currently listed in Hennepin County tax records at the time of permit issuance. At the time, perhaps less than a month after you purchased the property,the County records probably still showed the prior owners' name. Perhaps we should have noted the inconsistency between what printed out on the permit and who was listed on as owner on the application. Perhaps the contractor should have also noted this inconsistency, as he was acting as the agent for the owners. Nevertheless, a permit was issued to the builder for the kitchen remodel including the addition over the existing deck. � ' Is the City of Orono aware that it is requesting from us to: • Assume additional costs (in the thousands of dollars) which we do not have additional budget for this project • To postpone (or terminate) employment for our new contracted builder and his staff due to the time delay • To deny income to our new contracted builder and his staff due to this delay • To personally incur fuel and additional costs during the interviewing process for a vendor to survey the property • Surveys cost between $2,500 to $5,000! These are not issues the City will address. The City is fully aware of the cost of surveys and how the construction process operates. Those are factors inherent in every project and do not influence administration of the City's building permit requirements. I want to understand the following: 1. What is the full purpose of the survey? The purpose of the survey is to document the existing and proposed conditions and to allow for an analysis of the proposal to ensure it meets code standards. 2. How does this extra paper work support the needs of the City of Orono? This is not'extra paperwork', it is required information needed to accomplish the purpose of ensuring the proposal meets code requirements. 3. Is the City aware that surveys cost between $2,500 to $5,000? The City is aware of the cost of surveys. One way to minimize the cost of survey work is to use the same surveyor that has done prior surveys of the property, to take advantage of existing data they may already have. 4. Who reviews this document once it has been submitted? City staff review the submitted information, involving City consultants (engineer, wetlands specialist, etc) if the nature of the work warrants. 5. If surveys are a norm for the City, then why is it the responsibility of the property owner to pay for a survey? The City does not perform survey work; it requires that property owners provide surveys as part of a building permit application process. 6. Why would I be requested to pay between $1,500 to $5,000 for a survey which goes to your office gratis? The City has ordinances that require a property owner to provide the necessary information to allow for adequate analysis of a building project to ensure that all code requirements are met. An up-to-date, accurate survey is one of those required pieces of information.The City does not do survey work for any private property owners. 7. Perhaps the City would like to share in the cost of the survey? The City will not share in the cost of private survey work. The cost of a survey is borne by the property owner. This deck expansion does not warrant spending double the cost to build,just so the City has more paperwork to file. There must be a simplified process ar compromise. I would like to continue the project and keep the US economy growing - however, your office request, which I did not initial in agreement in 2010, is not assisting.
