HomeMy WebLinkAboutResolution 6643CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6641 A RESOLUTION VACATING AN OPEN SPACE EASEMENT WITHIN OUTLOT C, NORTHGATE TWO HENNEPIN COUNTY, MINNESOTA - FILE NO. 16-3834 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the Northgate Two Homeowners Association of Orono, Minnesota, a non-profit corporation (hereinafter the "HOA") is owner of the property within the City of Orono, and legally described as follows: Outlot C, Northgate Two, Hennepin County, Minnesota (hereinafter the "HOA Property"; and WHEREAS, the HOA property is subject to that certain Open Space Easement in favor of the City of Orono dedicated in Article XIV of the Declaration of Covenants, Conditions and Restrictions record with Hennepin County as Document No. 4547677; and WHEREAS, the aforesaid easement prohibits construction of "signs, billboards, accessory buildings, hardcover or roads of any nature whatsoever, or any other structure or improvement inconsistent with the natural state of the Affected Lands."; and WHEREAS, the HOA will no longer own the portion of Outlot C described and depicted as Parcel A within the survey attached hereto as Exhibit A upon completion of a lot line rearrangement with the owners of Lot 1, Block 7, Northgate Two; and Page 1 of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL 6 64 3 NO. WHEREAS, the new owners of said portion of Parcel A plan to construct an addition to their existing residence, making use of Parcel A for said construction. In order to avoid a conflict with the provisions of the Open Space Easement, a vacation of the easement within Parcel A would be appropriate; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on June 20, 2016 regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, on June 20, 2016 the Orono Planning Commission reviewed the application and on a vote of 5-0 recommended approval of vacation of the portion of the Open Space Easement within Parcel A subject to dedication of a replacement easement of equal area within Parcel B as described and depicted in Exhibit A; and WHEREAS, the Orono City Council finds the vacation as proposed is in keeping with the public interest and in consideration of the following findings: The portion of the Open Space Easement to be vacated would be a hindrance to development of the property at 220 Northgate Road if not vacated. 2. The City of Orono will neither gain nor lose in terms of open space because an equal area of open space will be dedicated in conjunction with the aforesaid lot line rearrangement. 3. The City of Orono has no municipal sewer, water or storm sewer facilities within the Easement area to be vacated 4. The City Council finds that the existing Easement area to be vacated has no apparent present or future benefit to the public. 5. The City Council finds that: a) The vacation does not affect access to or use of any adjoining property. The property owner's legal access to the property will not Page 2 of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6643 be affected by the vacation of the Easement and no adjacent or nearby properties will have their access limited by it. No utilities will be affected by vacation of the Easement b) The City has not and does not intend to develop, improve, or use the existing Easement area for open space purposes. c) The unimproved Easement area as it exists serves no public purpose. NOW, THEREFORE, BE IT RESOLVED, that the vacation of the portion of existing Open Space Easement described and depicted as Parcel A in Exhibit A is hereby granted by the City Council of the City of Orono on this 11th day of July, 2016, such vacation to be effective upon City receipt of a replacement Open Space Easement from the owners of 220 Northgate Road, over the aforesaid Parcel B.
