HomeMy WebLinkAboutResolution 6641CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. b 6 4 2 A RESOLUTION APPROVING A SUBDIVISION OF A LOT LINE REARRANGEMENT AT 220 NORTHGATE ROAD AND OUTLOT C, NORTHGATE TWO - FILE NO. 16-3834 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Edward J. Dau and Michelle S. Dau, husband and wife (hereinafter "the Daus"), are owners of the property located at 220 Northgate Road within the City of Orono, and legally described as follows: Lot 1, Block 7, Northgate Two, Hennepin County, Minnesota (hereinafter the "Dau Property"); and WHEREAS, Northgate Two Homeowners Association of Orono, Minnesota, a non-profit corporation (hereinafter the "HOA") is owner of the property within the City of Orono, and legally described as follows: Outlot C, Northgate Two, Hennepin County, Minnesota (hereinafter the "HOA Property"; and WHEREAS, the Daus and the HOA (hereinafter jointly the "Applicants") have jointly made application to the City for approval of a lot line rearrangement which would relocate the lot boundary line between the properties; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the proposed lot line rearrangement on June 20, 2016 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon, and on a vote of 5-0 the Planning Commission recommended approval of the lot line rearrangement; and Pagel of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 664 1 - WHEREAS, the Orono City Council reviewed the proposed lot line rearrangement at a regular meeting held on July 11, 2016 and makes the following findings with regards to the proposed lot line rearrangement: FINDINGS 1. This application was reviewed as Zoning File #16-3834. 2. The Dau Property contains 0.17 acre in total area and currently contains a single family residence. 3. The HOA Property contains 4.71 acres in total area and is currently vacant and used as open space for the Northgate Two development. 4. The properties are served by municipal sewer and water. 5. This application contemplates a lot line rearrangement to relocate the common boundary between the two properties via an equal trade of 75 square feet, such that each property maintains the existing parcel areas. 6. The application also contemplates the vacation of a portion of an existing open space easement within the HOA Property, and dedication of an open space easement over a portion of the Dau Property, equal in area to the portion of the HOA Property being vacated. 7. Because this is a lot line rearrangement which results in no additional lots, no park fee or stormwater trunk fee will be required. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the lot line rearrangement survey dated June 24, 2016, by Gregory R. Prasch of Lot Surveys Co. attached as Exhibit A, subject to the following conditions: 1. Following the lot line rearrangement the properties shall be legally described as shown in Exhibit B attached denoting Parcels A and B as the land portions being traded and Parcels 1 and 2 as the final descriptions after the lot line rearrangement has been completed. Upon filing of the lot line rearrangement documents, the HOA shall dedicate an easement over Parcel B similar in scope to that Open Space Easement dedicated in Article XIV of the Declaration of Covenants, Conditions and Restrictions of record as Document No. 4547677. 3. The Applicants shall file the appropriate deeds reflecting the new legal descriptions with the Hennepin County Recorder's Office and/or Registrar of Titles Office on or before July 11, 2017, or the approval granted by this resolution shall expire.
