HomeMy WebLinkAboutResolution 6639CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 66 3 A RESOLUTION GRANTING GENERAL DEVELOPMENT PLAN APPROVAL FOR PLANNED UNIT DEVELOPMENT NO. 11 FOR ESTATE DEVELOPMENT CORPORATION AND APPROVING THE PLAT OF ORONO PRESERVE - FILE #16-380713842 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Estate Development Corporation (hereinafter the "Developer") owns or has an interest in the three properties at 425 thru 595 Old Crystal Bay Road North including Hennepin County PINS 33-118-23 24 0001, 33-118-23 24 0002, and 33-118-23 24 0003, said properties legally described in Exhibit A attached hereto (hereinafter the "Property"); and WHEREAS, the City Council has considered the application by the Developer for rezoning the Property to RPUD - Residential Planned Unit Development as well as subdivision and development of the Property by the Planned Unit Development (PUD) process; and WHEREAS, on April 11, 2016 the City Council adopted Resolution No. 6603 granting General Concept Plan Approval and Preliminary Plat Approval for the proposed development, which approval includes the following elements: 1. Subdivision platting of the Property to create 39 developable single family residential building lots to be served by new public roads and municipal sewer and water; 2. Rezoning of the property from RR -1 B Single Family Rural Residential District to RPUD Residential Planned Unit Development District; and 3. PUD conditions for development of single family residences on the thirty-nine residential lots; and WHEREAS, the Developer has agreed to execute the Planned Unit Development No. 11 Agreement providing for the installation of certain improvements as a condition of site plan Page 1 of 7 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. b639 approval for the construction of certain public and private improvements on the Property, and which Agreement documents the general and detailed conditions for development and use of the Property; and WHEREAS, the Developer has agreed to comply with all conditions of Resolution No. 6603 and has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements and conditions of Preliminary Plat Resolution No. 6603. 2. Dedication on the plat of perimeter Drainage and Utility Easements as required in Resolution No. 6603. 3. Designation and dedication on the plat of wetlands subject to City and other agency jurisdiction, and execution of a declaration of covenants for the permanent flowage and preservation of wetlands, and establishment of wetland buffers and buffer maintenance provisions per the requirements of the Minnehaha Creek Watershed District (MCWD). 4. Execution of covenants and easements for stormwater management facilities including establishment of stormwater system maintenance obligations. 5. Granting to the City of a public easement for future trail use within the northerly 10 feet of Block 1. 6. Submittal of Minnehaha Creek Watershed District (MCWD) permits approving the grading, stormwater management facilities, Storm Water Pollution Prevention Plan (SWPPP) and erosion control plan. 7. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. 8. Execution of a Development Contract including provision of financial security including a Letter of Credit and escrow to ensure that all site improvements are installed and maintained to the City's specifications and satisfaction, and to establish conditions for future development of the site. 9. Payment of development fees as established in Resolution No. 6603 or as follows: a. Park Dedication Fee: $140,000.00 b. Stormwater and Drainage Trunk Fee: $102,723.00 C. Municipal Water Connection Charge: $60,500.00 Page 2 of 7 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6639 WHEREAS, City staff and consultants have reviewed the plans for this RPUD application and hereby specify approval of each plan and identify them as part of the official record for Planned Unit Development No. 11 (Plans B thru E shall not be attached to this Resolution): Pian A — Plat of ORONO PRESERVE Plan B — Final Plan Set including the following Sheets: Sheet 1 of 24: Cover Sheet Sheet 2 of 24: Existing Conditions Survey Sheet 3 of 24: Site Signage, Striping and Lighting Plan Sheet 4 of 24: Grading & Drainage Plan Sheet 5 of 24: Pond Details Sheets 6-7 of 24: Erosion and Sediment Control Plan (SWPPP) Sheet 8 of 24: Sanitary Sewer and Watermain Plan Sheets 9-12 of 24: Sanitary Sewer and Watermain Plan and Profiles Sheet 13 of 24: Storm Sewer Plan Sheets 14-16 of 24: Street and Storm Sewer Plan and Profiles Sheet 17 of 24: Street Intersection Details Sheet 18 of 24: Tree Inventory Sheet 19 of 24: Tree Preservation Plan Sheet 20 of 24: Wetland Impact and Buffer Plan Sheet 21 of 24: Landscape Plan Sheet 22 of 24: Landscape Schedule and Notes Sheets 23-24 of 24: Details Plan C — Orono Preserve Side Setback Exhibit dated 5131116 Plan D — Conservation Design Master Plan as incorporated within the Orono Preserve Conservation Development Application by Kjolhaug Environmental Services Co. dated 1120116 Plan E — Sample Building Designs All of the above noted plans are subject to any additional requirements of the Minnehaha Creek Watershed District and subject to any additional requirements and conditions specified by the City Engineer. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 6603, the City Council of the City of Orono does hereby approve the plat of ORONO PRESERVE, Hennepin County, Minnesota (a copy of which is attached as Exhibit B) and does hereby grant General Development" Plan Approval for Planned Unit Development No. 11, subject to the following conditions: Page 3 of 7 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. ,60 6 3 9 1. Development within ORONO PRESERVE is subject to the Conclusions, Orders and Conditions enumerated within General Concept Plan and Preliminary Plat Resolution No 6603, and subject to the provisions of the Development Contract and Residential Planned Unit Development Agreement for ORONO PRESERVE dated , 2016. 2. The City Council hereby approves the proposed public road names are as follows: Wood Duck Trail; Bluestem Way; Sandhill Drive; and Goldenrod Way, as depicted on the final plat drawings. 3. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 4. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Senior Planner and City Engineer that all requirements of the platting regulations have been satisfied. 5. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before December 27, 2016 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. 6. Concurrently with approval of this Resolution the City Council shall adopt an ordinance amending the official zoning map of the City to rezone the property from RR -1B Single Family Rural Residential District to RPUD Residential Planned Unit Development District, such rezoning to not become effective until the Development contract has been fully executed by all parties. 7. Upon approval of this Resolution the City Council shall direct the Mayor and Clerk to execute other documents required by this RPUD rezoning. 8. If substantial development has not occurred within one year after approval of PUD No. 11 as set forth in the Residential Planned Unit Development Agreement, the City Council may declare the approvals granted within this resolution and within said Agreement as null and void. 9. The aforesaid plat shall be filed with the Hennepin County on or before December 27, 2016 together with a certified original copy of this resolution and executed copies of the Agreements, easements, and covenants pertinent thereto. The plat approval granted by this Resolution shall expire if the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Page 4 of 7 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6639 10. The approvals granted in this Resolution shall not become effective until such time that the Developer successfully completes purchase and provides suitable evidence of ownership of the Property. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above.
