HomeMy WebLinkAboutResolution 6636CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6636 A RESOLUTION APPROVING AMENDMENT #4 OF THE 2008-2030 CITY OF ORONO COMMUNITY MANAGEMENT PLAN WHEREAS, the City of Orono is a municipal corporation located within Hennepin County and within the planning jurisdiction of the Metropolitan Council; and WHEREAS, in accordance with the Metropolitan Land Planning Act of 1976 and its amendments, and with Minnesota Statutes Chapters 462 and 473, the City of Orono in September 2010 adopted a comprehensive municipal plan known as the 2008-2030 City of Orono Community Management Plan (also referred to as the 2008-2030 CMP) to provide for the orderly development of the City; and WHEREAS, an integral element of the 2008-2030 CMP is the Land Use Plan, in which specific properties within the Metropolitan Urban Service Area (MUSA) and expected to develop using municipal sewers, are guided for specific development densities in order to meet housing goals established for the City by the Metropolitan Council; and WHEREAS, the property at 425-595 Old Crystal Bay Road North (described in the legal description attached as Exhibit A) within the City of Orono is approximately 17 acres in gross area (12.6 acres of net buildable area) and is currently guided in the 2008-2030 CMP for Medium -High Density Residential Use at a density of 7-10 units per acre; and WHEREAS, the property has been within the Metropolitan Urban Service Area (MUSA) since adoption of the 2000-2020 C'_VIP in November 2001 at which time it was guided for a mix of low-density and medium -density housing at a density of 2-4 units per acre; and WHEREAS, the 2008-2030 CMP guiding of the property for higher density was a result of the City's intent to meet Metropolitan Council goals for housing diversity and affordability while allowing the Shoreland areas of Orono already within the MUSA to be developed at the low densities commensurate with preservation of the water duality of Lake Minnetonka; and WHEREAS, the City has approved a development proposal for the property which will result in construction of 39 single family homes at a net density for the site of 3.1 units per acre, which does not achieve the 7-10 units per acre density for which the property is currently guided; and Page 1 of 3 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6636 WHEREAS, the City Council reviewed the development proposal and found that it meets a number of goals for housing as established within the Housing element of the CMP, including: Provides opportunities for a mix of housing types, locations, and cost ranges which will meet the needs and provide adequate housing for a broader range of ages, family groups, lifestyle needs and levels of income to the greatest extent practical. Provides housing types and residential densities consistent with environmental and land use plans and with the availability of public services and facilities; and WHEREAS, the developer made a formal application to the City for an amendment of the CMP density requirements for this site in order to develop at the proposed density; and WHEREAS, the Orono City Council on March 28, 2016 voted 4-0 to adopt Resolution No. 6599 documenting findings in support of the proposed reguiding to allow a lower density, and granting conditional approval of an amendment of the 2008-2030 Community Management Plan (CMP) to change the guiding of the property at 425-595 Old Crystal Bay Road North from 7-10 units per acre to 3-7 units per acre, subject to Metropolitan Council review and approval, and directed City staff to prepare such an amendment and submit it to the Metropolitan Council for review and approval; and WHEREAS, the proposed amendment was subsequently forwarded to the Metropolitan Council for approval; and WHEREAS, Metropolitan Council staff in a letter dated April 24, 2016 indicated that the proposed amendment meets the comprehensive Plan Amendment Administrative Review Guidelines and does not affect official forecasts. The letter indicated that while the amendment reduces the City's ability to accommodate its share of the region's affordable housing need, the City currently has sufficient land guided at higher densities to accommodate its share of affordable housing need. The letter concluded that the City may place the amendment into effect. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono hereby amends the 2008-2030 City of Orono Community Management Plan Part 3B, General Land Use Plan by revising the guided density for the property at 425-595 Old Crystal Bay Road North from 7-10 units per acre to 3-7 units per acre, and directs that all pertinent CMP text, map, and tables be revised accordingly, finding that: Page 2 of 3 + r. 1. The amendment meets the intent of the basic goals, objectives and policies set forth in the 2008-2030 CMP. 2. The amendment is consistent with the goals, objectives, needs and desires of Orono residents. 3. The amendment is consistent with the planning goals and objectives of Orono's municipal neighbors.
