This letter is regarding the cars and debris stored at the above property. You have been in
contact with you off and on over the past year in regards to the appearance of your property. It
appears that your property again has an unlicenced vehicle, an inoperable car and stuff stored
outside in the back yard. We need you to get rid of all the cars that are inoperable and make sure
all the operable cars are licensed. We also need you to stop storing debris in your back yard.
You can only store stuff if it is stored in an enclosed building or shed. You have several items
stored in the back yard that is not in an enclosed building. Please get the property in
compliance by January 2, 2003. If the property does not get in compliance and stay in
compliance you may face fines for the violations. Our goal is to get the property cleaned up and

Background: This property has been a real eye sore for the past several years. I have been
sending him 3 letters a year for the past 2 years. The property starts to get cleaned up and then it
gets real messy again. I have talked to Mr. Rutherford several times and he tells me he is going
to get it taken care of once and for a1L He is making little progress and it looks bad. We are
getting a lot of complaints from the neighbors. We has told me his plan is to demo his 2 falling
down sheds and build a new one to put all his stuff in. He has not done any of this.
Action Requested: I would like you to send this individual a letter stating he has until June
15, 2003 to get a building permit for the new shed or get the property free of the junk by that
date. If he gets the building permit than he needs to get it built within one month and get the
property cleaned up by that date. We need to get the property cleaned up either by building a
shed to put everything in or just remove everything from the property.

City inspectors noticed the lawn has not been mowed and the house number is not displayed at
2755 Ethel Avenue, which are violations of City Code Sections 58-1(b) and 18-8.

This letter will serve as your notice that the property must be brought into compliance
before Mondav, June 13 in order to avoid legal action by the City. In order to bring the
� property into compliance the lawn must be mowed to six (6) inches in length and the house
must display the proper house number.
Please be advised, if you fail to correct the violation prior to the deadline, the City will correct the
violations and the costs to do so will be assessed against the property [Cite: City Code 58-1(c)
and 18-8(c)]. Those costs will be certified to the County Auditor and will be collected in the
same manner as special assessments against the property.

Sec. 58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse,
litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the
property.
(b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds
on the property at a height of not more than six inches, except this provision shall not apply to the
following:
(1) Publicly owned parks, traiis or nature areas.
(2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78.
(3) Residential properties in excess of one acre gross lot size when located in the RR-1A, RR-1B, LR-1A
and RS rural residential zoning districts, provided that such properties or portions of properties shall
be maintained in conformance with this subsection upon notice from the city that lack of such
maintenance has caused complaints from abutting property owners and is thereby creating a public
nuisance.
(4) Wetlands vegetation as defined in chapter 78.
(5) Grass, weeds or underbrush on any slope in excess of 100 percent(45 degrees).
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and
upon seven days' written notice to the owner, as shown by the records of the office of the county auditor,
of private premises on which such material is found or any conditions in violation of this code section
exist, the city may remove such matter or correct any conditions in violation, and certify the cost of such
removals or corrections as any other special assessment.
Sec. 18-8. Numbering of houses and buildings.
(a) Duty of owner or occupant.
(1) The owner or occupant of every occupied property and every house or other building shall place on
such building the proper street number for such building, either by painting or affixing such number so
that the number shall be clearly visible from the sidewalk or street.
(2) Where the house is not visible from the street or private road, or is located more than 300 feet from
such street or road, an additional set of numbers shall be ptaced on a sign at the driveway apron with
numbers visible in both directions of travel on the street.
(3) Where more than one house is served by the same private driveway or unnamed private road,
additional sets of numbers shall be placed at every fork or other driveway as necessary to direct
traffic to every house, including the house farthest from the street.
(4) Numbers placed on mailboxes are insufficient to satisfy the provisions of subsection (a) of this section
except when a mailbox stands on the subject property, not across a public street, and not in a group
of mailboxes more than one in number.

(5) The minimum size for numbers shall be three inches.
(6) Numbers shall be reflective or of color contrasting with background.
(b) Assignment of numbers. The city shall assign numbers in accordance with the standard plan adopted by
the city and shall approve and assign all street names by action of the council.
(c) Unlawful act. It is a misdemeanor for any person to fail to comply with the provisions of subsection (a) of
this section or to post numbers other than the correct city-assigned numbers. If the property owner fails to
comply with the requirements of this section, the city may erect a sign adjacent to the street on which the
number is stated or affixed, and upon completion ascertain the cost and certify the cost to the county
auditor to be collected as any other special assessment.
