Re: Vacating Alley adjacent to 2705 Ethel Avenue
Dear Mr. Pillar:
I have reviewed the file from your variance. At that time all that was being indicated was that
the Planning Commission would look favorably on vacating the alley. There is a formal process
that must be followed, similar to the variance process, to actually complete the vacation:
1. Submit an application consisting of:
a. Completed application form (enclosed). This form must be signed by the majority
of property owners who abut the axea to be vacated. As an alternative you could
submit consent letters from these property owners. You would need signatures of
the owner of three of the following properties:
• 2705 Ethel Avenue - yourself
• 279� Ethel Avenue - G. Gordon Amundson
• 2700 Casco Point Road - Daniel Buesing or Linda Running
• 2684/2686 Casco Point Road (Two parcels but counts only once because they
are in the same ownership.)-D. L. Runkle or L. F. Runkle
b. A legal description of the area to be vacated. Usually this comes from a surveyor.
c. Processing fee of$700.
d. Certified property owners list. Directions for obtaining this list are highlighted on the
back of the application form.
2. Post the sibn you will be given at the time of application.
3. City Staff will contact utility companies and City Engineer to obtain consent to the vacation.
Utility companies or City Engineer may request a utility easement over all or part of the
alley. They alley would still be yours but you can't put buildings within a utility easement.

4. The Planning Commission will hold a public hearing and make a recommendation to the City
Council. This usually occurs at one meeting.
5. The City Council will make a decision after considering the Planning Commission's
recommendation, comments made at the public hearing, and the interests of the City. This
usually takes one or two meetirigs.
6. If Council approves vacation the City records a resolution setting out Council's decision with
the Hennepin Country Recorder or Registrar of Titles.
Also enclosed are a schedule with the application deadlines highlighted and map that may help
you explain the situation to the neighbors when you ask them to sign the application. If you or

and advise the Buiiding & Zoning Office of this change prior to the meeting.
