L�'USED PORTION OF FOREST BOLZEVARD

WHEREAS, the Ciry of Orono is a municipal corporation orQanized and existin�
under the laws of the State of Minnesota; and
�`-_�_ _ _��REAS, Gordon N. Nelson and Barbara O. Nelson, husband and wife, of
� 1310 Elmwood Avenue filed a petition with the City of Orono requesting the vacation of a
portion of orest oulevard originally dedicated in the plat of Saaa Hill Revised legally
de�cribed as follows:
That part of vacated Forest Boulevard as dedicated in the plat of "Saga Hill Revised,
Hennepin Co. Minn." which lies between the northwesterly extensi�ns across it of the
northeasterly and southwesterly lines of Lot 3, Block b, "Saaa Hill Revised, Hennepin
Co. Minn."
`�HEREAS, after due published and posted notice, public hearings were h�ld
before the Ciry's PlanninQ Com^Zission on June 20, 1988, March 15, 1993 and April 17, 199�,
regarding said vacation and all interested persons were given an opponunity to be heard; and
W�REAS, after due standing and consideration, the Plannin� Commission
recommended approval of the requested vacation and the City Council of the Ciry of Orono finds
that said vacation as proposed, is in keepina with the public interest and in consideration of the
f011owing filldinas:
l. The vacation does not affect the access or the use of adjoining properties.
'�. The Ciry has not and does not intend to develop, improve, or use the dedicated
riaht-of-way of Forest Boulevard for road purposes nor any other public purpose.
3. The Ciry has not and does not intend to maintain or install utilities within the
dedicated right-of-way of Forest Boulevard.

4. Major porcions of the dedicated riaht-of-way of Forest Boulevard are located
below the 929.4 elevation of Lake Minnetonka.
5. The unimproved dedicated right-of-way as it exists serves no public purpose.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Gordon N.
Nelson and Barbara O. Nelson is hereby aranted by the Council of the Ciry of Orono and that
the portion of Forest Boulevard leaally described above is hereby vacated. Granting of the
petition is subject to the condition that upon vacation, applicant must combine vacated adjacent
portion of Forest Boulevard with their homestead property.
Adopted by the City Council of the City of Orono, Minnesota at a reaular meetin�
held on May 8, 1995.
