U�IUSED PORTION OF FOREST BOULEVARD
�VITHL�T THE PLAT OF SAGA HILL REVLSED,
SECTION 7, TOVV'ivSHIP 117, I�NGE 23, IN THE CITY OF ORONO,
HENIV'EPIN COUN'TY, MINNESOTA

`�HEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
.,,___ WHEREAS, Richard J. Johnson and Katherine A. Johnson, husband and wife,
of�304 Elmwood Avenue filed a petition with the City of Orono requesting the vacation of a
portion of Forest �ulevard oriainally dedicated in the plat of Saga Hill Revised legally
described as follows:
That part of vacated Forest Boulevard as dedicated in the plat of "Saga Hill Revised,
Hennepin Co. Minn.° which lies between the eYtensions across it of the nor�herly line
of Lot 1, Block 6, "SaQa Hill Revised, Hennepin Co., Minn." and the northwesterly
extension of the southwesterly line of Lot 2, said Block 6; and
WHEREAS, after due published and posted notice, public hearings were held
1988 March 15 1993 and April 17, 1995,
before the Ciry's Planning Commission on June 20, , �
reaardinQ said vacation and all interested persons were aiven an opportunity to be heard; and
WHEREAS, after due standina and consideration, the Planning Commission
recommended approval of the requested vacation and the City Council of the City of Orono finds
that said vacation as proposed, is in keeping with the public interest and in consideration of the
followina findings:
1, The vacation does not affect the access or the use of adjoinin� properties.
2. The City has not and does not intend to develop, improve, or use the dedicated
riQht-of-way of Forest Boulevard for road purposes nor any other public purpose.
3. The City has not and does not intend to maintain or install utilities within the
dedicated right-of-way of Forest Boulevard.

4, Major portions of the dedicated riQht-of-way of Forest Boulevard are located
below the 929.4 elevation of Lake Minnetonka.
5. The unimproved dedicated riaht-of-way as it exists serves no public purpose.
�,'pW, THEREFORE, BE IT RESOLVED, that the petition of Richard J.
Johnson and Katherine A. Johnson is hereby aranted by the Council of the City of Orono and
that the portion of Forest Boulevard leaally described above is hereby vacated. Granting of the
petition is subject to the condition that upon vacation, applicant must combine vacated adjacent
portion of Forest Boulevard with their homestead property.
Adopted by the City Council of the City of Orono, ivlinnesota at a reaular meetin�
held on May 8, 1995.
