HomeMy WebLinkAbout04-26-2004 Council Minutes0 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. ROLL The Council met on the above mentioned date with the following members present: Mayor Barbara Peterson; Council members Jim White, Jim Murphy, Lill McMillan, and Bob Sansevere; City Attorney Thomas Barrett; Representing staff were City Administrator Ron Moorse, Planning Director Mike Gaffron, Planners Melanie Curtis and Janice Gundlach, City Engineer Tom Kellogg, Public Service Director Greg Gappa, and Recorder Kristi Anderson. Mayor Peterson called the meeting to order at 7:01 P.M CONSENT AGENDA 1. Approve /Amend While item #5 was removed from Consent, items #13, 14, 16, 17, and 19 were added to the Consent Agenda. Murphy moved, White seconded, to approve the Consent Agenda as amended. Vote: Ayes 5, Nays 0. RECOGNITION 2. Elizabeth Hawn — Planning Commission — Resolution • 3. Sandra Smith — Planning Commission — Resolution 4. Stephanie Zugschwert — Planning Commission — Resolution Mayor Peterson moved, White seconded, to table the three Recognition items #2 -4. VOTE: Ayes 5, Nays 0. FIRE CHIEF'S REPORT Excelsior Fire Chief Mark DuCharme reported that the Navarre Fire Station should be ready for operation by May 1", once the Hennepin County Dispatch has completed the programming for the paging system. He stated that 3-4 more recruits have come forward for scheduled training in July. DuCharme indicated that the next step will be further discussion regarding the utility vehicle, once the financials are in place over the next couple of weeks. Long Lake Fire Administrative Officer Tony Roe added that he had begun talking to several truck suppliers. White asked whether he had seen the Long Lake Fire Department at a fire call in Minnetonka Beach. Roe stated that they had received the call first, and provided mutual aid to Mound who actually covers the area. Moorse complimented the Long Lake Fire Department on a successful pancake breakfast the • previous weekend. On another matter, he reported that resident Sam Marfield donated a 2001 pickup truck with only 7,000 miles to the department, which was greatly appreciated. Murphy stated that, as always, he is impressed by the relationship forged between these three communities and thanked the two for their commitment. He asked how the new firefighters were doing. DuCharme stated that the firefighters had completed their testing and the department is in a holding pattern awaiting the results. He was confident the outcome would be successful. APPROVAL OF MINUTES 5. Regular Council Meeting of April 12, 2004 Page S, paragraph 2, the last line was amended to read, "He stated that in the past there was a lack of coordination efforts from Long Lake." White moved, Mayor Peterson seconded, to approve the Minutes of April 12, 2004, as amended. VOTE: Ayes 5, Nays 0. 0 PARK COMMISSION COMMENTS —,Debora Halvorson Halvorson thanked the Council for their support for increased use of Bederwood Park ball fields. • She stated that the Commission would be meeting next week and continues to focus their efforts on prioritizing park needs and establishing long range park plans. With the likelihood that the conversion of the Dakota line will take place, Murphy suggested the Park Commission begin strategic planning for this trail. Halvorson stated that the Commission has started to identify areas for potential rest stops along the trail, including Old Crystal Bay Park and the planned park area north of the Navarre Fire Station. When available, Murphy suggested the Council and Commission hold a joint meeting to discuss these options. PLANNING COMMISSION COMMENTS — Jim Leslie Although he had nothing to report, Leslie stated that he would be available for questions. LMCD REPORT — Debora Halvorson Due to the imminent threat of zebra mussels contaminating Lake Minnetonka, Halvorson stated that an exotics subcommittee has determined with the DNR that increased inspections will take place over the summer months at many landings, including Gray's Bay, Maxwell Bay, North Arm Bay, and Wayzata Bay landings. Halvorson explained that the subcommittee has prepared a power point presentation to present to the 14 City Councils of the Lake area, which will educate and inform them of proposed action plans and ask for their support. White urged the LMCD and DNR to be proactive in this initiative. He was concerned that little enforcement accompanied the inspections and suggested that further signage be posted to educate the public. Sansevere commented that, although sad, he could foresee zebra mussels in the lake's future. Halvorson stated that efforts are being made to lobby for more money to further programs, create more education, and get the word out. McMillan stated that this is the best program that has been undertaken by the LMCD and DNR and will target high visibility weekends and traffic times. Although not 100% preventative, she was hopeful that the public would cooperate with the inspection process. Murphy suggested that further publicity be sought to educate the public about the threat posed by zebra mussels in our lakes. He felt that local television stations would be interested in broadcasting this message. McMillan added that, at a recent mayor's meeting she'd attended, the subject of milfoil harvesting • was broached by Deephaven, who'd like to see the Watershed District take over the harvesting effort. She continued, noting that John Barton, of Hennepin Parks, was currently examining phosphorous levels. She commented that, in addition to City funding, it would be nice if the Watershed would contribute financially to the harvesting effort. McMillan reported that, at the mayor's meeting, Deephaven also expressed concern about boat density on the lake. • Halvorson stated that a new committee is studying the boat density study performed in the 1970's , and will compile a new density study based on counts during fly -overs at peak times this summer. Murphy suggested that the City develop some type of action plan to address the numbers of trailers parking at launch sites during the Memorial Day weekend, before the police department is bogged down writing traffic tickets over the holiday. PUBLIC COMMENTS Charles and Gerry Timm, 2885 6"' Avenue North. Mr. Timm stated that his lawyer had recently received a letter from his neighbor about an Ordinance that would be in effect in the near future prohibiting him from keeping his commercial vehicle in his driveway. He asked the Council for an explanation, stating that he was merely trying to make a living as he'd always done. Moorse explained that the City had adopted this Ordinance, and given Mr. Timm a 6 month stay, which will soon expire and compliance will be expected. He stated that he had not received any requests to reconsider the Ordinance. PAGE 3 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING , Monday, April 26, 2004 7:00 o'clock p.m. PUBLIC COMMENTS, Continued • Sansevere expressed his concern that this Ordinance was put into place very quickly without consideration of how it might impact this resident's right to make a living. While he felt keeping a commercial vehicle in a tightly packed neighborhood was inappropriate, White suggested amending the Ordinance with an acreage minimum, acknowledging that Timm has several acres. Timm stated that 5 years ago his wife contacted the City and was told that they were in compliance and allowed to keep their dump truck on their property. Now the Ordinance has suddenly changed and they have been told they are out of compliance. Moorse stated that a 5 acre minimum was applied. Gaffron stated that staff had discussed 2 -5 acre minimums. He added that either way, the City may not be able to resolve the issues between the two neighbors. He suggested the dump truck be kept less visible. Timm stated that the neighbor's views are not obstructed by the truck, nor can he hardly see it. It is only when Timm drives past the neighbor's home via an easement that it is noticed. He maintained that he had been granted a 30' easement for a driveway across the neighbor's property, which the neighbor has been increasingly narrowing to 10' in order to prohibit his access via the dump truck. Sansevere asked whether there was a potential to move the driveway. • Mrs. Timm stated that the garages and driveway are set up to face the current access. She pointed out that they have 2 %z acres of land and this has caused them quite a hardship. McMillan asked if others had complained about the Ordinance. Gaffron stated that, while only one has come forward to date, he would not be surprised that others come forward due to the recent change in the Ordinance. He acknowledged that, in the past, people were told they could have these vehicles on their property, and now the new Ordinance prohibits this. White noted that the resident had been granted an easement and is not being allowed to use it to the allotted allowance. White suggested that the Council consider an Ordinance appeal until they have had adequate time to address this issue. Sansevere indicated that it seems the neighbor is taunting the Timm's, and their attorney, with the City's Ordinance. Murphy asked Timm what he wished the Council to do. Timm stated that he would just like to keep his livelihood in tact. n LJ PAGE 4 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. • PUBLIC COMMENTS, Continued Since there is an apparent easement issue, Murphy asked staff what it would take to get a new driveway access solely on their property. Although the expense might be too much for them, Mrs. Timm stated that the Department of Transportation would also have to accept the request. Murphy stated that the Timm's need to take a hard look at how to get off the neighbor's land, taking away his leverage, and the City needs to reconsider the Ordinance. Sansevere suggested the Timm's run their driveway along the length of the easement and work with staff to figure out the details. Mayor Peterson asked staff to assemble the Ordinance information and try to obtain comment from the DOT regarding a new access to discuss at the next work session. McMillan suggested getting the two parties together to air their differences. Moorse agreed, stating that the two parties view the situation completely differently, and it would behoove them to try to mediate the problems. Sansevere pointed out that a formal action must be taken prior to May 25, when the Ordinance • takes effect, to extend the grace period while they discuss the Ordinance. Mayor Peterson asked that staff keep the Timm's posted of extensions, meetings, and moratoriums. • ZONING ADMINISTRATOR'S REPORT *6. #04 -2968 CUSTOM STRUCTURES LTD., 440 STUBBS BAY ROAD NORTH — FINAL PLAT — RESOLUTION NO. 5159 Murphy moved, White seconded, to adopt RESOLUTION NO. 5159, a Resolution approving a 2 -lot subdivision in the RR -1B zoning district for the property located at 440 Stubbs Bay Road North. VOTE: Ayes 5, Nays 0. 7. #04 -2993 CHRIS VALERIUS AND PHIL FISK, 2377 SHADYWOOD ROAD — CONDITIONAL USE PERMIT, COMMERCIAL SITE PLAN REVIEW, VARIANCES — RESOLUTION NO. 5160 Gundlach reported that the applicants request the following to convert the existing residence into a coffee shop/bakery/restaurant: 1. Commercial site plan review in order to obtain a building permit to construct an addition to the existing building and to convert it from a residential use to a commercial use. 2. Parking setback variance to allow a drive through lane and parking spaces to be located within the required 30' rear yard and within the required 20' front yard. Building setback variance to allow a north side setback of 24' when 35' is required and 24' currently exists. 4. Hardcover variance to permit 56% hardcover in the 500' -1000' zone when 35% is normally allowed. 5. Conditional use permit in order to operate a coffee shop/bakery /restaurant. While much of the Planning Commission discussion of March 15`" centered on whether the applicant should be granted the variance needed to incorporate a drive - through, ultimately, the Commission approved the alternate site plan, which didn't include a drive- through. For clarification, Sansevere asked what the hardcover would be with and without the proposed drive - through. Gundlach pointed out that with the drive - through the hardcover is 56 %; whereas, without the proposed drive - through the hardcover is 35% and a variance is unnecessary. Valerius stated that their current drive - through plan uses pavers instead of blacktop, since they are permeable, requires no curb and gutter, and is therefore narrower than the original drive - through plan. She indicated that this plan would reflect 45% hardcover, thus allowing them to retain more greenspace and making the drive - through less conspicuous. Sansevere asked the applicant what their hardship was to justify a hardcover variance. Valerius insisted that the site was a peculiar property, and the neighbor was allowed 50% • hardcover. Sansevere asked what the hardship to their land was, versus that of the neighbor. Valerius referred to other properties across the street which were granted greater hardcovers. Mayor Peterson stated that she did not support the neighbor's hardcover requests, nor would she support theirs. Fisk stated that the hardship to their property is that they do not have parking close to their business, and in fact, have an easement and pay to use the shared parking behind the residence. Since they only have two spots adjacent to their site, Fisk stated that they would like to give customers better access. Attorney Barrett concluded that in a conversion from residential to commercial, the City can require that all requirements be met. He pointed out that the property may have worked as a single family residence, but may not be appropriate as a business. Gaffron interjected, stating that it would be a hardship if adequate parking was not available; however, they do have the ability to use the shared parking lot. • PAGE 6 of 12 ` MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. • 7. #04 -2993 CHRIS VALERIUS AND PHIL FISK, 2377 SHADYWOOD ROAD — Continued White stated that he did not like the plan which includes a drive - through circling around a home in Orono. He didn't feel it looked good, did not fit there, and no hardship could warrant the request. He reiterated that a drive - through was inappropriate for this site. Murphy agreed, stating that there was no hardship to grant additional hardcover of 10 -20 %. He indicated that he was present during the Planning Commission discussion and found their recommendation to be well thought out. Sansevere reiterated that the city is bound by law to find a hardship to warrant the hardcover request. McMillan stated that, while she could empathize with their desire for a drive - through in the competitive coffee house industry, the logistics of this site just won't work. Mark Cox, 3509 Ivy Place, urged the Council to not lose sight of the fact that the community of Navarre would unlikely support another coffee house. He objected to the applicant trying to skirt the letter of the law, especially when the need is not there and could cause both businesses to fail. While Murphy questioned their choice to locate in Navarre, he stated that no one knows whether one of the shops would fail or not. • Cox reiterated that hardcover, hardship, adequate parking, and the question of the drive - through are great issues. In addition, he asked where a dumpster pad would be placed. U Gundlach stated that the applicants would have parking in the lot behind the site; however, the hardcover and setback variances would still apply. She indicated that adequate square footage would remain for the dumpster pad if the applicant's were granted the plan without the drive - through. Jeremy Thompson, Mound resident, stated that as a customer of Lake Country Coffee, he believed that a drive - through would be a great plus and advantage for him. He pointed out that Culvers has a drive - through that circles the entire building and he didn't feel this should be such a big issue for this odd house. Fisk added that most McDonalds have drive - through lanes that circle the entire building past their entryways. Mayor Peterson polled the Council members and found that none objected to the first request for the addition; however, all objected to the second request for the drive - through and parking setback. McMillan felt that the applicants would need more than three designated parking spaces upfront. Fisk maintained that during their peak hours of 5a.m. to 9 a.m., use of the shared parking lot would not be problem. He did not feel they would require any dedicated parking. She continued, acknowledging that item 4, the hardcover request, would be unnecessary since the drive - through was moot. Finally, item 5, although some of the Council members questioned the City's responsibility to other businesses versus free enterprise, seemed acceptable. Cox agreed that everyone deserves a chance to have a business; however, objected to granting the potential business owners variances to do so. Based on 19 years experience in the business, Fisk stated that they were well aware of what it takes to succeed and were not concerned about the level of risk or the economy. McMillan reiterated her concern about adequate parking. Fisk suggested signage be incorporated at a later date which encourages the park and ride users to park along the back row. Mayor Peterson moved, Sansevere seconded, to adopt Resolution No. 5160 approving the Commercial Site Plan Review in order to obtain a building permit to construct an addition to the existing building and to convert it from residential use to commercial use; to approve the CUP to operate a coffee shop /bakery /restaurant; to deny the hardcover variance for 56% hardcover; to approve the building setback variance of 24'; and to deny the parking setback variance to allow the drive - through lane and parking spaces to be located within the required 30' rear yard and within the required 20' front yard for the property at 2377 Shadywood • Road. VOTE: Ayes 3, Nays 2. 8. #04 -2977 MIKE KEAVENY ON BEHALF OF RICHARD M. KEAVENY REV. TRUST, 3425 SHORELINE DRIVE — CONDITIONAL USE PERMIT, COMMERCIAL SITE PLAN REVIEW, VARIANCES — RESOLUTION NO. 5161 Although the applicant could not be present, Moorse relayed his wish for action on the item. White moved, Sansevere seconded, to adopt RESOLUTION NO. 5161, a Resolution denying the request for a CUP approval for a Class 11 restaurant, commercial site plan review, and associated variances. VOTE: Ayes 5, Nays 0. Murphy stated that Mr. Keaveny had asked the Planning Commission to provide him with a list of businesses he could put in his building, which the Planning Commission supplied him with based on zoning code. *9. #04 -2999 GEORGE AND MARILY MILEUSNIC, 3243 CASCO CIRCLE — VARIANCES — RESOLUTION NO. 5162 Murphy moved, White seconded, to adopt RESOLUTION NO. 5162, a Resolution granting a hardcover variance in order to rebuild their 483 s.f. deck which is rotted and to add a screened porch beneath the new deck at 3243 Casco Circle. VOTE: Ayes 5, Nays 0. • PAGE 8 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. • *10. #04 -3000 WAYZATA COUNTRY CLUB, 200 WAYZATA BOULEVARD WEST — CONDITIONAL USE PERMIT AND COMMERCIAL SITE PLAN REVIEW — RESOLUTION NO. 5163 Murphy moved, White seconded, to adopt RESOLUTION NO. 5163, a Resolution amending the original conditional use permit and subsequent site plan review to allow two minor additions to the existing building, all in conjunction with a complete renovation of the main structure located at 200 Wayzata Boulevard West. VOTE: Ayes 5, Nays 0. *11. #04 -3001 STEVAN AND MARCIA TIFFANY, 1325 REST POINT LANE — VARIANCES — RESOLUTION NO. 5164 Murphy moved, White seconded, to adopt RESOLUTION NO. 5164, a Resolution granting lot area, lot width, and side street setback from an alley right -of -way in order to build a new single family residence at 1325 Rest Point Lane on a lot 15,425 s.f. (.35 acre) in area where 43,560 s.f. (1 acre) is required, 75' in width where 140' is required and setback of 29' from the alley where 35' is required. VOTE: Ayes 5, Nays 0. 12. #04 -3002 G &L LAND INVESTMENT, LLC., 740 NORTH ARM DRIVE — VARIANCES Gundlach explained that the applicant requests a variance to allow an existing non - conforming accessory structure, referred to as the boathouse, to remain on the lot in conjunction with a rebuild of the principal structure. She pointed out that the Planning Commission voted unanimously to recommend that the boathouse be removed as the applicant provided no valid hardships to justify • the granting of a variance. • Sansevere voiced his concern that the City feels it must remove every boathouse from the lake. He argued that it is many of these boathouses that add to the charm and allure of the lake; therefore, should not all be removed. White concurred, urging staff to create an inventory of the boathouses that remain in the City in order to evaluate what is left, what is historically significant or part of our heritage, and should remain. He indicated that he was pleased that other Council members felt the same inclinations. Murphy agreed, though acknowledged that this particular boathouse had no significant character worth preserving. On the other hand, he stated that the son of the previous owner came to the Planning Commission Meeting and gave an impassioned plea as to why the boathouse should remain, which was attributed to the fact that his parents had contributed a great deal to the community of Orono. Murphy emphasized the importance of being particularly sensitive to mandating that all boathouses be removed or retained. Gaffron concurred, stating that the Planning Commission, too, would like to get a handle on what is out there with regard to boathouses, and begin to evaluate standards to determine which should be retained. Gaffron stated that an inventory could be accomplished relatively easily with little staff input. Sansevere suggested that the Park Commission be urged to inventory boathouses that remain. PAGE 9 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. *13. #04 -3005 SIGN ORDINANCE AMENDMENT, SECTION 78 -1466 — ORDINANCE NO. 6,3 rd SERIES Murphy moved, White seconded, to adopt ORDINANCE NO. 6,3 d Series, a Sign Ordinance Amendment, Section 78 -1466, which defines pylon and monument signs, and amends language regarding the signs allowed within Business and Industrial Districts. VOTE: Ayes 5, Nays 0. *14. #04 -2997 CITY OF ORONO — BIG ISLAND ACCESS — VARIANCES /CONDITIONAL USE PERMIT — RESOLUTION NO. 5165 Murphy moved, White seconded, to adopt RESOLUTION NO. 5165, a Resolution approving the necessary variances and CUP for the proposed wetland alteration to improve Big Island access between Lots 38 and 39, Morse Island Park. VOTE: Ayes 5, Nays 0. *15. ACCESSORY STRUCTURE RETENTION AGREEMENT — 25 ORONO ORCHARD ROAD NORTH Murphy moved, White seconded, to authorize the execution of an agreement that would allow the garage to remain at 25 Orono Orchard Road North. VOTE: Ayes 5, Nays 0. MAYOR/CITY COUNCIL REPORT • N Mayor Peterson stated that she'd received a letter from Representative Barb Sykora's office offering a briefing. She asked if the Council would be interested. • White stated that he would like to hear from her office, especially on issues related to education, etc. Sansevere reported that the power squadron had inquired about removing metal from the property adjacent to theirs, which he believed was Hennepin Parks land. McMillan invited the Council members to attend a workshop Thursday evening at St. George regarding the turn back of Highway 12. Moorse indicated that he had also extended the invitation to both Park and Planning Commissions. White questioned the apparent clear cutting along the Luce Line by the DNR. Murphy stated that he'd met with a representative from Xcel Energy about the tree `trimming', and left believing that he made little dent in their philosophy. Essentially, they have been and will be clear cutting under and near their power lines to eradicate exotics and reclaiming an area 15' from the power lines. McMillan added that it is the DNB's opinion that Xcel is doing them a favor by removing exotics, but many other varieties are being impacted as well. She stated that she was terribly concerned about the cedar and spruce along the Luce Line. L' PAGE 10 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o'clock p.m. • MAYOR/CITY COUNCIL REPORT, Continued White suggested that the newspapers get out to the trail and take before and after pictures of the clear cutting. He asked whether the cities had any control over this. Murphy stated that the clear cutting began in Wayzata and the City Hall fielded many calls regarding this issue. While the paper reported that tree trimming would ensue, no one pictured the level of clear cutting which would be the result. PUBLIC SERVICE DIRECTOR'S REPORT - There was none. CITY ADMINISTRATOR'S REPORT *16. ORONO WOODS NON - PROFIT SUBSTITUTION— RESOLUTION NO. 5166 Murphy moved, White seconded, to adopt RESOLUTION NO. 5166 authorizing the substitution of owner, and authorizing the Mayor and City Clerk to sign the required documents. VOTE: Ayes 5, Nays 0. *17. MHFA REFUND Murphy moved, White seconded, to approve the refund of $8,400 of unused grant funds to MHFA. VOTE: Ayes 5, Nays 0. • 18. CREDIT CARD POLICY Murphy expressed his concern with regard to credit card deals that go astray. He suggested that the City finance department review the policy and set certain limits. Moorse stated that the credit card will be used for background checks mostly and should never really have to leave the office. He indicated that a limit would be set and that the finance department would be responsible for any reviews. Murphy moved, White seconded, to approve and adopt the Credit Card Policy, as presented. VOTE: Ayes 5, Nays 0. CITY ATTORNEY'S REPORT Attorney Barrett reported on pending litigation to the Council in a closed 5 minute session. 19. LICENSES SPECIAL EVENT PERMIT 1.
