I've completed a grading review of the proposed plans for the permit/property listed in the subject line and provide the
following comments:
1. Retaining Walls to the north of proposed house and southwest of proposed house are shown at 4ft high. Walls 4' or
greater in height must be designed by a licensed professional, and plans must be submitted to the City for review. Walls
less than 2X the height of the upper wall apart shall be considered one wall.
2. Grading plan appears to direct runoff onto the northern neighbors property off the north corner of the proposed
house. Additional grading detail to be provided along the north property line to define swales directing runoff along the
property line and not toward the adjacent house.
3.A separate utility permit will be required for the sewer connection/reconnection.
4. The silt fence should be installed and inspected by the City prior to any land disturbing activities. The Contractor
must provide a minimum 24 hour notice prior to inspection.

Recitals
1. Construction of the new residence located at 3926 Cherry Avenue, the ("Subject
Propert�'), legally described as Lot 12 and 13, Block 5, Crystal Bay Vfwv, Hennepin
County,Mtnnesota,is the subject of building permft application number#2014-01447 has
been completed.
2. Winter conditions currently prohibit completion of exterior improvement5,final grading,and
vegetation establishment. An as-built survey cannot be accurately conducted at this time.
3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners
so that the Owners may occupy the new residence.

4. The City will issue a TCO only if the Owners establish an escrow to ensure compCetion of ''
exterior improvements, continuation of erosion control and submittal of an as-built survey
t0 the CI�. r,

NOW THEREFORE,THE PARTIES ACiREE A3 FOLLOWS:
i. DEPOSIT OF ESCROW FUND3. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit i10,000 with the City. All accrued interest, if any,shall be paid to the `
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred(including planning,engineering,in excess of$500,
or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with
expenses the Owners would be responsible for under a building permit application. The escrow will also
guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work
is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the woric and to repair any damage to public property or infrastructure that is causec�by the
work(including planning, engineering, or legal consuRant review)associated with buildine permk#201�-
01447 if compliance with the approved building permit is nat accompiished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs,the City will
in turn send a bill to the Owr�ers. Owners shall be responsible for payment to the City within 30 days of the
Owners'receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses inwiced pursuant to ik3. The City may draw from the escrow account without further approval
oi the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSINCi ESCROW. The Balance on deposit in the escrow, ff any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have been
successfully completed and whether it is appropriate to retum the funds. Owner may also request the
release of the funds,and such funds shall be released upon City Staff receiving the appropriate verification
that all requirements of the project have been successiully completed.

6. CERTiFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn.Stat.§§415.01 and 366.012.
7. ACCES3 TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors,the right to enter upon the subject property f�r the specific purpose of
inspecting and completing any exterior improvements, final grading, establishment of vegetation and the
restoration of the subject property should the Owners not complete the work by the specified dates.

4. DtSBUR8EMENT FROM ESCROW ACCOUNT. In the event that the Ovmers do not make payment
to the City within the timeframe outlined in�3 above, shall issue a Stop Work Order until the Owners pay all enpenses
invoiced pursuant to #3. The City may draw from the escrow account wlthout fu�ther approval of the Owners to
reimburse the City for eligible expenses the Cfty has i�unred.
6. CLOSING ESCROW. The galance on deposit in the escrow, i� any, shaH be retumed to the
Owners when atl requirements related to the project are complete. City Staff shall review the terms of this escr�ow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to retum the funds. Owner may aiso request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all r+equirements of the
project have been sutxessfuHy completed.
6. CERTIFY UNPAID CHAR�iES, tf the project is abandoned by Owners,or if the eligible e�enses
incurred by the City exceed the amount in escrow, the City shall have the right to certify�e unpaid balance to the

Dear Mr. Danforth:
This letter is being sent per your request regarding the recently constructed boulder retaining walls at the
above address. This evaluation is based on the Retaining Wall Typical section I prepared dated July 28,
2015, a site visit I performed, and verbal information provided by you regarding construction means and
methods.
The construction of the retaining walis appears to be structurally stable and in general conformance with
boulder retaining wall and construction industry standards. The walls were constructed with stone of
sufficient size and setback. Other typical construction details such as use of drainage elements and filter
fabric also appeared to be followed correctly. As is normal for boulder retaining walls of this type, some
wall movement and soil settlement should be expected. I recommend that concentrated areas of surtace
water should also be directed away from the walis. Numerous photos were taken for documentation,
some of which have been provided as part of this report.
Additionally, the soil conditions at the site met my initial soil bearing capacity requirement of 2000 pounds
per square foot (psf).
This evaluation was performed using the design guidelines presented in the third edition of the"Design
Manual for Segmental Retaining Walls" (DMSRW) published by NCMA in 2009. Direct all surface
drainage away from the retaining walls. If soil conditions, proposed layouts, or other design parameters
vary from that assumed, a revised analysis might be needed. Please call me if you have any questions or

This WALL EVALUATION and ensuing recommendations is expressly made subject to the following terms and
conditions to which all persons that receive and rely thereon agree:
1. Standard of Service—Services performed by ENGINEER under this agreement shall be performed in a manner
consistent with the skill and care ordinarily used by members of the engineering profession practicing under similar
conditions at the time and in the locality the services are performed.
• Client recognizes that interpretations and recommendations of ENGINEER are based solely on the
information available to the company.
• ENGINEER will be responsible for those interpretations and recommendations, but shall not be responsible
for the interpretation by others of the information developed
• Services provided reflect the professional judgment of ENGINEER,to the best of ENGINEER's knowledge,
information,and belief as of the date hereof.
• No other warranty or guarantee, express or implied,is made.
2.Said design is based entirely on and expressly limited by the scope of services ENGINEER has been employed by
Client to perform and as described in WALL PROVISIONS and LIMITATIONS.
3. If the ENGINEER is hired for any construction phase services or site visits, it is understood that the Contractor, not
the ENGINEER, is responsible for the construction of the project,and that ENGINEER is not responsible for the acts
or omissions of any contractor,subcontractor or material supplier;for safety precautions, programs or enforcement;
or for construction means,methods,techniques,sequences and procedures employed by the Contractor.
4. OWNERSHIP OF DOCUMENTS:All reports,field data,field notes,calculations,estimates and other documents
('reports') prepared by Engineer, as instruments of service,shall remain the property of Engineer. Client agrees that
all reports furnished to Client or his agents,which are not paid for,will be returned upon demand and will not be used
by Client for any purpose whatever. Engineer will retain all pertinent records relating to the services performed for a
period of five years following submission of the report,during which period the records will be made available to
Client at all reasonable times.
5.TERMINATION:This agreement may be terminated by either party by written notice. In the event of termination,
ENGINEER shall be paid for services performed and expenses incurred up to the termination notice date. Neither
Client not ENGINEER may delegate,assign,sublet or transfer his/her duties or interest in this Agreement without the
written consent of the other party.
6. To the fullest e�ent permitted by law, Client and ENGINEER(1)waive against each other, and the other's
employees,officers, directors,agents, insurers, partners,and consultants,any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of, resulting from, or in any way related to this wall
design and written report, (2) agree that ENGINEER's total liability to Client shall be limited to the total amount of
compensation received by ENGINEER and (3) if an action is brought against the ENGINEER and the ENGINEER
prevails, ENGINEER shall be entitled to recover costs and expenses, including reasonable attorneys'fees and costs.

We discussed it and the walls within the 75-foot setback appear to be primarily for aesthetics and to facilitate some flattened areas
which could be accomplished with a different grading plan.
The stairs are permitted, and (at maximum)the supporting walls running parallel to the stairs could remain. However,the majority
of the walls should be removed. A VERY minimal number of stabilizing outcroppings would be considered (without a variance).
Before the changes are made I recommend submittal of a revised plan and possibly a site meeting with our engineer to determine
the necessity of the outcroppings.

We have reviewed the as-built survey for the Washuta home and have the following comments or issues needing
resolution:
1. There appears to be a new stair and retaining walls (low borders?) within the 75-foot setback from the lake. The
stair is a permitted encroachment, however the walls are not. The walls within the 75-foot setback require
approval of a hardcover variance from the City Council. Please remove the walls and re-grade, if necessary;
submit a revised as-built.
2. The top of wall and bottom of wall elevations were not provided per the City survey standards (i.e. from the
nearest as built spot elevations) and the survey appears to depict retaining walls in excess of 4 feet. All walls
exceeding 4-feet in height require an engineered plan approved by a licensed engineer. We could not find copies
of approved plans for these wall in the file. The approved plan called out walls��3.8 feet maximum". Please
provide engineered plans or modify the walls and submit a revised as-built.

home. There is a window well indicated however, the low spot elevation appears to be outside of it. Ciarification
is required.
Also, the survey contains a lot of information and the details of the survey are somewhat lost in all of the extra notations,
spot elevations, etc. Please submit a more legible as-built survey showing the as-built topography, improvements, etc
(remove excessive spot elevations, and other notations). The as-built survey should also reflect the changes requested
above.

Sven,
We received a foundation as-built for 3926 Cherry Avenue. We note that the house has increased in size by 160 square
feet over the approved plan. Melanie spoke with Randy Stern about this a few weeks ago. After our review it appears
the hardcover calculations and structural coverage are still in compliance based on the information provided on the
survey. Before framing can commence,we need updated building plans to be submitted and approved.
