Permanent erosion and sediment control plan: Indicates areas to be
seeded and sodded, sediment ponds, storm sewer systems and all other
required permanent erosion and sediment control measures. Permanent
stormwater pollution controis including, but not limited to ponds,
vegetated buffers and structural measures shall be designed and
constructed in accordance with other chapters of the City Code and
requirements of other agencies having jurisdiction.
3� Narrative: Describes, at a minimum, the nature of construction activity,
person(s) responsible for inspection and maintenance of site erosion
and sediment control including contact information, project phasing,
schedules, along with the timing, installation and maintenance of erosion
and sediment control measures and specifications necessary to carry
out the project.
9� NPDES permit documentation: If a national pollution discharge elimination
system (NPDES) general stormwater permit from the Minnesota Pollution
Control Agency (MPCA) is required the owner shall submit to the city a copy of
the MPCA Certificate of Permit Coverage.

Sec. 79-8. Stormwater pollution prevention plan review process.
(a) Process. For any subdivision, the stormwater pollution prevention plan shall be submitted
with the preliminary plat application. For all other applications, the stormwater pollution
prevention plan meeting the requirements of section 79-7 and minimum BMP requirements
of section 79-9 must be reviewed by the city engineer or designated representative who may
approve, approve with conditions, or deny the stormwater pollution prevention plan prior to
any land disturbing activity on the site.
�b) Duration. Approval of a stormwater pollution prevention plan submitted under the provisions
of this article shall expire one single year after the date of approval unless construction has
commenced in accordance with the plan. However, if prior to the expiration of the approval,
the owner makes a written request to the city for an extension of time to commence
construction setting forth the reason for the requested extension, the city engineer may grant
one extension of not more than one single year. Receipt of any request for an extension
shall be acknowledged by the city within 15 days. The city shall make a decision on the
extension within 30 days of receipt. Any plan may be revised in the same manner as
originally approved.
��) Conditions. A stormwater pollution prevention plan may be approved subject to compliance
with conditions reasonable and necessary to ensure that the requirements contained in
these regulations are met. Such conditions may, among other matters, limit the size, kind or
character of the proposed development, require replacement of vegetation, establish
required monitoring procedures, stage the work over time, or require alteration of the site
design to ensure buffering, and require the conveyance to the city or other public entity of
certain lands or interests therein.
�d) Financial security. The adequacy, conditions and acceptability of any financial security shall
be determined by the city.

(a) (Plan standards required.]No stormwater pollution prevention plan that fails to meet the
standards contained in this section shall be approved by the city council or designated
representative.
�b) Site dewatering. Water pumped from the site shall be treated by temporary sedimentation
basins, grit chambers, sand filters, upflow chambers, hydrocyclones, swirl concentrators or
other appropriate controls as appropriate. All water from dewatering must be discharged in a
manner that does not cause nuisance conditions, erosion in receiving channels or on
downslope properties, or inundation in wetlands causing significant adverse impact to the
wetland.
All discharge points must be adequately protected from erosion and scour. The discharge must be
dispersed over natural rock riprap, sand bags, plastic sheeting or other accepted energy dissipation
measures. Adequate sedimentation control measures are required for discharge water that contains
suspended solids.
��) Construction site waste.
��) Wasfe and material disposal:All waste, unused building material (including garbage
debris, cleaning wastes, wastewater, toxic materials or hazardous materials),
collected sediment, asphalt and concrete millings, floating debris, paper, plastic,
fabric, construction and demolition debris and other wastes must be properly
contained on site and disposed of off site, not allowed to be carried by runoff into
receiving channel or storage sewer system.
�2) Hazardous materials:Oil, gasoline, paint and any hazardous substances must be
properly stored, including secondary containment, to prevent spill, leaks or other
discharge. Restricted access to storage areas must be provided to prevent vandalism.
Concrete wash must be limited to a defined area of the site and runoff must be
contained within the defined area. Storage of hazardous waste must be in compliance
with MPCA regulations.
�3) Liquid waste:All non stormwater discharges (concrete truck washout, vehicle
washing, maintenance spills, etc.) conducted during the construction activity must
comply with the newest version of the state NPDES permit.
�4) Sanitary facilities:Adequate on-site sanitary facilities shall be provided in convenient
location(s) for all persons who work on the site.
�d) Tracking. Each site shall have graveled roads, access drives and parking areas of sufficient
width and length to prevent sediment from being tracked onto public or private roadways.
Any sediment reaching a public or private road shall be removed by street cleaning before
the end of each workday.
�e) Drain inlet protection. All storm drain inlets shall be protected during construction with control
measures as approved by the city. These devices shall remain in place until final stabilization
of the site. A regular inspection and maintenance plan shall be developed and implemented
to assure these devices are operational at all times.
(fl Site erosion control.
(�) Channelized runoff from adjacent areas passing through the site shall be diverted
around disturbed areas, if practical. Diverted runoff shall be conveyed in a manner
that will not erode the conveyance at receiving channels. All temporary or permanent
drainage channels must be stabilized within 24 hours of being connected to a water of
the state. Sediment control is required along channel edges to reduce sediment
reaching the channel.
(2) All activities on the site shall be conducted in a logical sequence to minimize the area
of bare soil exposed at any one time.

(3) All disturbed ground left inactive for 14 or more days must have temporary or
permanent stabilization year round.
�4) For sites with more than ten acres disturbed at one time, or if a channel originates in
the disturbed area, one or more temporary or permanent sedimentation basins shall
be constructed. Each sedimentation basin shall have a surface area of at least one
percent of the area draining to the basin and at least three feet of depth and
constructed in accordance with accepted design specifications. Sediment shall be
removed to maintain a depth of three feet. The basin discharge rate shall also be
sufficiently low as to not cause erosion along the discharge channel or the receiving
water.
(5) Perimeter sediment control measures shall be placed along all down gradient
perimeters of the site. If a channel or area of concentrated runoff passes through the
site, perimeter sediment control measures shall be placed along the channel edges to
reduce sediment reaching the channel. All down gradient perimeter sediment control
measures must include a maintenance and inspection schedule.
�6) Any soil or dirt storage piles containing more than ten cubic yards of material should
not be located within 25 feet from a roadway or drainage channel. If remaining for
more than 14 days, they shall be stabilized by mulching vegetative cover, tarps or
other means and enclosed with down gradient perimeter sediment controls. Piles
which will be in existence for less than 14 days shall be enclosed with perimeter
sediment controls.
��) Pipe outlets must have energy dissipation installed within 24 hours of connection to
waters of the state.
�9) Inspections and maintenance. The owner shall be responsible for conducting inspections
and maintenance of all erosion and sediment control BMPs on site.
(�) Inspections, maintenance, and rainfall on site must be documented and readily
available for review. Inspections are required as followed:
a� Once every seven days on exposed soil areas.
b� Wthin 24 hours after a one-half inch or greater rain event over 24 hours.
�� Once every 30 days on stabilized areas.
d� As soon as runoff occurs or prior to resuming construction on frozen ground.
�2) Maintenance is required as follows:
a� When sediment reaches 1/3 the height of the BMP on perimeter control
devices, sediment must be removed within 24 hours of discovery.
b� If the perimeter control device is not functional it must be repaired or replaced
within 24 hours of discovery.
�• Temporary sediment basins shall be maintained when sediment reaches '/2 the
outlet height or'/2 the basin storage volume. Basins must be drained or
sediment removed within 72 hours of discovery.
d� Sediment must be removed from paved surfaces within 24 hours of discovery.
(3) Erosion into streets, wetlands or water bodies. If eroded soils (including tracked soils
from construction activities) enter or appear likely to enter streets, wetlands, or other
water bodies, prevention strategies, cleanup and repair must be immediate with the
appropriate approvals from the DNR, MPCA, or any other state, federal, or local
agencies as necessary. The owner shall provide all traffic control and flagging
required to protect the traveling public during cleanup operations.

Erosion off-site. If erosion breaches the perimeter of the site, the owner shall
immediately develop a cleanup and restoration plan, obtain right-of-entry from the
adjoining property owner and get appropriate approvals from all state, federai, and
local agencies as necessary. Then implement the cleanup and restoration plan within
48 hours of obtaining the adjoining property owner's permission and approval from
any appropriate state, federal, and local agencies.

Sec. 79-10. Completion of work.
Work will be considered complete when all exposed soil areas have undergone final
stabilization, as defined in st:�cticn_7��__.5, is constructed to finish grade, and is in conformance with
all permit conditions of approval to the satisfaction of the city. The owner shall notify the city when
the land disturbing operations are ready for final inspection. Final approval shall not be given until
all work, including installation of all drainage facilities and their protective devices, and all erosion
control measures, have been completed and final stabilization has occurred in accordance with this
chapter.

Following up on our phone conversation, the subject property is within the LR-1 B zoning district. This district
requires a minimum of 43,560 square feet (1 acre) and 140 feet in width for a lot to be considered buildable.
Orono City Code states for this zoning district if the lot area and lot width is at least 80% of the zoning district
requirement, a variance is not required (cite 78-72(b)(1)]. Within the LR-1 B zoning district, 80% of the lot area
is 37,248 square feet and 80% of the width is 112 feet. Your lot does not meet these minimum requirements
and lot width and lot area variances would be required to develop the property.
Alternately, our Code also allows for redevelopment of substandard shoreland lots without variances with
minimum requirements. Your lot is located within the shoreland overlay district and also appears to meet the
additional requirements within Section 78-72(c). Therefore provided the lot does not exceed 25% hardcover a
variance is not required. An application for a building permit should meet all of the requirements identified
within our building permit application packet.

Melanie,
While the survey submitted for the new house at 4055 Elm Street does meet the code requirements, there are some
concerns which could be brought to the attention of the homeowner including:
• The steep driveway and no flat landing areas by the garage and toward the end of the driveway.
o This will make it difficult to access the driveway in the winter and can pose issues with stopping prior to
entering Elm Street in the winter.
o May be difficult to stand on driveway outside of garage in winter.
• The proposed turn around area is relatively steep too.
o May want to consider additional grading to flatten this area out.
• Just north of the house, the applicant could remove grade this area out differently which would result in a flatter
area for the turnaround bay and could reduce the slope in the yard north of the proposed house.
Again, while what is shown on the survey, it may be beneficial for the homeowner to understand this prior to
construction so changes can be made now rather than after the home has been built.

the Gas Line and request for bonding.
Attached is the information from the manufacture on this product - Wardflex.
We have now bonded the line in 2 locations, including @ the meter. The requirements from the
manufacture stat that the bonding is to comply with NEC requirements.
Section 250.104 B has been noted for this, stating that the bonding is to take place @ the
closest location for potential energizing to the line, which is inside the home.
In either case, both locations are bonded as requested at this time.

Electrical Bonding and Grounding
In accordance with NFPA 70 National Elcctrical Codc(NEC),proper bonding and gnounding of gas-piping
systems in a structurc and the structwe's elcctrical system is required by a qualificd electrician. The
requirement providcs un effectivic eloctricatly conlinuvus path in an cfCort to conduct stray voltage%ument
snfely to ground. "Thc NEC also states that it is good practice to bond all metallic systetns und objects. In
accordance with thesc requirements,WARDFLEX�'requires the gas-piping system to be bondod to the
elech-ical earth grounding�ystcm of the swcture thmugh the use of a bonding clamp and wire.
• The bonding point must be in as close proximity to thc cicetrical panel as practical;close pt+oximity of
the bonding point to the gas meter is also desirable.
• The wire gauge for this bond must bc sizcd,at a minimum,for the full amperage available through the
cicctric scrvicc.
• Further minimiZing imEwd�nce over the txmding assembly is desirnble. The NEC should be referred to

WARDFLEX�CSST Electrical Bonding
This technical bulletin supersedes all prior documenu relating to thc electrical bonding of
WARDFLEX�CSST gas piping system and dcfines the mandatory manufacture's requircments for
diiect bonding.
Direct bonding is required for all natural and LP gas piping systems incorporating WARDFLEX�
CSST�vhether or not the piping system is connextod to an elcctrically powcred gas appliance. Dircct !
bonding is included as part of thc manufucturc's requiremcnts for both single family and multi-family ;
, buildings. A person l:nowledgeable about electrical system design,local electrical code,and these
; requirements should spvcify the bonding for commercial applications.
� WARDFLEX� CSST installed insidc or attachc� to thc exterior of a building or structure shall be
electrically continuous and dicectly bondod, by a qualilied person, to the ground system of the
i building. The gas piping is considered to be directly bonded when installed in accordance with the
, following instructions:
� . A bonding jumper is pecmanondy and directly connected to the electrical service grounding
� system. This can be achieved through a connection to the electrical service equipment ,
enclosure,the grounded conductor at the electrical service,the grounding electrnde conductor
(whene of su�cient size)or to the one or more grounding electrodes used.
• A single bond connection is made to the building gas piping downstream of the atility meter I
or sccond stagc rcgulator(LP systcros),but ncar thc gas scrvicc cntrancc(cithcr outdoors or ,
indoors) of the swcture, or downstream of the gas meter of each individual housing unit
�rithin a multi-famity structure. A "daisy chain"configuration of the bonding conductor is
permitted for multi-meter installations. A bonding connection shall not be made to the
anderground,natural Sas utility service line or the underground supply line from a LP storage
tanl:.
• The bonding conductor is not smaller than a #6 AWG copper wire or equivalent. The I
bonding conductor is installed and protected in acoordamce with thc NEC.
. The bonding oonductor is attached in an approved manner in accordance with NEC and the
point of attachment for the bonding conductor is accessible.
• Bonding/grounding clamp used is listed to UL 467 or other accepcable national standards.
• T'he bonding clamp is attached at one point within the piping system to a segment of rigid
pipc or a pipe component such as a nipple, fitring or manifold providod it is manufactured
with an appropriate and Code listed material. The bonding clamp must bc attached such that
metal to metal contact is achieved with thc stecl pipc component. Removc any paint or
appiied coating on thc pipe surface beneath the clamp. See Figures 1 and 2 for guidance. The
corrugated stainless steel tubing portion of the gas piping system shall not be used as the
point of aitacliment of the bonding clamp at any location along its length.

a Minnesota municipal corporation ("City") Matthew ritr ("Owners").
Recitals
1. A building permit application has been filed for a new principal structure located at
4055 Elm Street the("Subject Propert�'), legally described as Lots 7, 8 and 9, Block 9, Minnetonka Summit Park,
Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review} or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with land use application #12�572 and building permit
#2013-00906 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received ftom the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
