Dear Ms. Feyo:
We are in receipt of your request for renewal of variances last reviewed and approved in
1995 for your property at 4055 Elm Street. While the zoning for the property in question
has not changed, the last variance approval expired in October 1996, nearly ten years ago.
City fees have increased, forms have changed, and the Planning Commission does not
normally review lot area and width variances unless a complete proposed house plan
including floor plans and elevations, is submitted.
I am enclosing the current variance application package for your use. Your application
will be considered as a new application, not a renewal, and the fee for that application is
$600. You should set up a pre-application meeting with me or City Planner Melanie
Curtis to discuss what new materials will be required. As a minimum you should expect
to have to provide house plans and elevations, a site grading and drainage plan, and the
labels required for the public hearing process.
I note that your letter indicated a $75 check was enclosed. No check was included with
your letter when it was opened, so I assume it was inadvertently omitted.

2. The property is served by municipal sewer and has been assessed for
one sewer unit on the three lots (1/3 unit per parcel).
3 . The lot is all high ground which drains to the ditch along Elm Street.
A culvert would be required along Elm Street when the driveway is
constructed.
4. The lot has sufficient depth and width so that the normal setbacks of
35 ' front, 30 ' rear, and 10 ' either side can be met.
5. The property is located in the 250-500' lakeshore setback zone, which
would allow 30$ hardcover maximum, or 5,976 s.f. This is more than
sufficient to construct a single family residence with the normal
driveways, decks, etc.
6. This property is comparable in size to neighboring developed
properties. No other land is available for purchase to make this lot
any larger.

Discussion
Please review the staff inemo of September 13, 1995. Briefly, the request is for renewal of the
previously granted lot area variance for construction of a single family residence. A residence
can be constructed on the property meeting all the required setbacks and hardcover standards.
The property is similar in size to neighboring developed properties, and there is no adjacent
undeveloped land to make the property any larger.
A concept site plan and grading plan submitted in 1994 was reviewed by the City Engineer, who
concluded that the site development as proposed was acceptable from an engineering standpoint
subject to the installation of gutters and downspouts on the proposed residence which connect
to a drainpipe extending north to the edge of the existing roadway ditch. This will be required
as part of a final grading plan which must be submitted prior to building permit approval.

COUNCIL ACTION - MOTION:
To approve per the findings and conditions of the resolution previously mailed to you.
Please anange to sign the 3 original resolution copies at the City Offices (Monday through
Friday, 8:00 to 4:30). All persons with an interest must sign the resolutions. Please note that
building permits for new construction cannot commence until the resolutions have been fully
executed. Applications involving penalty building pernaits where structures have already been
installed, applicants are asked to proceed immediately with execution of the resolutions and filing
of the building permit application. If applicants are unable to visit the office between the regular
business hours, you are asked to contact Lin Vee, the Deputy Clerk, 473-7357 to make other
arrangements.
Variance Approval is limited to the extent shown on approved plan and as noted in the approval
resolution. Changes in approved plans are subject to further review by the City. Variance
approval expires one year after date of approval. A building permit application must be
submitted no later than September 12, 1995.
Based on the comments of Tim Feyo at the Council meeting of September 12th advising that
both Schoell & Madson and DeMars-Gabriel surveyors met at the site and conf'u�med that the
cunent survey submitted by you for this review was the most accurate survey. Any future
property boundary disputes between neighbors should be resolved through possible
registration/torrens of property.
