Minnetonka Beach the lakeshore for purpose of regulation by the LMCD, is at elevation

Victoria g29.4 National Geodetic Vertical Datum. The survey of the property by
Hew odl nd Gronberg & Associates, Inc. shows that the OHWL does not lie on your
Dick Woodruff client's properry. Therefore, the property is not a lakeshore lot. Under
Shorewood LMCD Code, docks and watercraft storage must occur within a permitted
dock use area that is associated with a lakeshore lot. The property
shown on the survey does not have lakeshore at the OHWL. Therefore,
no dockage rights would be associated with that property under the
LMCD Code.
Your e-mail indicates that the landowner has had a dock at that location
for many years. Whether your client either owns or shares the dockage
rights on the adjacent property that is a lakeshore lo# (i.e. the property
that does have the lakeshore at the OHWL), is a question that cannot be
resolved by the LMCD, but is a matter of real estate rights between the
owner of the lakeshore lot and your client.
