Dear Steven &Tammara,
The City of Orono has received a complaint regarding the condition of your property at 3435 East Lake Street. In
response, a City of Orono official inspected your property at June 17, 2015 at 2:00 pm which revealed violations
of Orono City Code. Your immediate attention to this matter is required.
The violation cited on the above premises is grass and/or weeds in excess of 6 inches in height which is in
violation of City Code Section 58-1. Maintenance of Private Property. There is also violation of garbage and
debris in the front yard which is in violation of City Code Section 58-1. Maintenance of Private Property. Also
the building is unsecured and appears to be abandon and could be hazardous to people in the area which is a
violation of Minnesota Statute 463.251 Securing Vacant Buildings. In order to correct the violation, the grass
and/or weeds must be cut to a height of less than 6 inches, the garbage/ debris removed, and secure the
building to make it safe. This work must be completed by luly 15, 2015.
Please be advised, if you fail to correct the violation prior to the deadline, the City will correct the violation and
the costs to do so will be assessed against the property [Cite: City Code 58-1(cJJ. Those costs will be certified to
the County Auditor and will be collected in the same manner as special assessments against the property.

A follow up inspection was conducted regarding the code violations on your property at 3435 East Lake Street.
A City of Orono official inspected your property on luly 16, 2015 at 11:OOam, which revealed that one of the
violations previously cited on July 1, 2015 had not been completed. The debris in the center of the property
between the lake and the cabin is considered hazardous and has not been removed.
The violation cited on the above noted premises is in violation of City Code Sec. 58-1. Maintenance of Private
Property. In order to correct the violation, please remove all debris on the property. This work must be

Frequently Asked Questions
What is code enforcement?
The Orono City Council has established goals and expectations for the general health, safety, welfare, and
aesthetic standard of the community.
These expectations are adopted as law in the City Code. Planning, zoning, building staff and police officers
provide enforcement services for violations of the City Code that impact the safety and quality of life of the
community. While code enforcement primarily maintains quality of life standards, it also plays an important
role in the early identification and mitigation of unsafe exterior hazards, public health hazards, and compliance
with humane pet standards.
How is the complaint process initiated?
The code enforcement process is typically initiated in one of several ways: 1) in response to a complaint by an
individual, 2) as a consequence of an action (i.e. an application for a building permit or a zoning variance); or 3)
observation of a code violation by the staff.
Minnesota state law prohibits the release of the identity of individuals who make a complaint. Minn. Stat.§
13.44 states: The identity of individuals who register complaints with government entities concerning vio/ations
of stare or local ordinances concerning the use of real property are classified as confidential data, pursuant to
section 13.02, subdivision 3.
Why am I receiving a formal letter and not a courtesy phone call?
Your property has one or more city code violations. The city, in most circumstances, is required to provide a
written notification to the owner of the property.
What happens if I ignore this order?
Additional penalties including criminal prosecution are possible. Your immediate attention is required. Do not
i�nore this order.
What if my tenant is the party responsible for creating the violation?
You are receiving this notice because you are the owner of record and are ultimately responsible for ensuring
that the violation(s) listed in this notice are corrected. You may also be subject to fees for corrective action
initiated by the city and/or fines for failure to comply.

Sec. 58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris,
refuse, litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from
the property.
(b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and
weeds on the property at a height of not more than six inches, except this provision shall not apply to
the following:
(1) Publicly owned parks, trails or nature areas.
(2) Property actively being farmed or used for agricultural purposes in conforrnance with chapter 78.
(3) Residential properties in excess of one acre gross lot size when located in the RR-1A, RR-16, LR-1A
and RS rural residential zoning districts, provided that such properties or portions of properties shall
be maintained in conformance with this subsection upon notice from the city that lack of such
maintenance has caused complaints from abutting property owners and is thereby creating a public
nuisance.
(4) Wetlands vegetation as defined in chapter 78.
(5) Grass, weeds or underbrush on any slope in excess of 100 percent (45 degrees).
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and
upon seven days' written notice to the owner, as shown by the records of the office of the county
auditor, of private premises on which such material is found or any conditions in violation of this code
section exist, the city may remove such matter or correct any conditions in violation, and certify the cost
of such removals or corrections as any other special assessment.

463.251 SECURING VACANT BUILDINGS.
Subdivision 1. Definitions. The following terms have the meanings given them for the purposes of this
section.
(a) "City" means a statutory or home rule charter city.
(b) "Neighborhood association" means an organization recognized by the city as representing a
neighborhood within the city.
(c) "Secure" may include,but is not limited to, installing locks, repairing windows and doors,boarding
windows and doors, posting "no-trespassing" signs, installing exterior lighting or motion-detecting lights,
fencing the property,and installing a monitored alarm or other security system.
Subd. 2. Order; notice. (a) If in any city a building becomes vacant or unoccupied and is deemed
hazardous due to the fact that the building is open to trespass and has not been secured and the building could
be made safe by securing the building, the governing body may order the building secured and shall cause
notice of the order to be served upon the owner of record of the premises or the owner's agent,the taxpayer
identified in the property tax records for that parcel, the holder of the mortgage or sheriffs certificate, and
any neighborhood association for the neighborhood in which the building is located that has requested
notice, by delivering or mailing a copy to the owner or agent, the identified taxpayer, the holder of the
mortgage or sheriffs certificate, and the neighborhood association, at the last known address. Service by
mail is complete upon mailing.
(b)The notice under this subdivision must include a statement that:
(1) informs the owner and the holder of any mortgage or sheriff s certificate of the requirements of
subdivision 3 and that costs may be assessed against the property if the person does not secure the building;
(2)informs the owner and the holder of any mortgage or sheriffs certificate that the person may request
a hearing before the governing body challenging the governing body's determination that the property is
vacant or unoccupied and hazardous; and
(3)notifies the holder of any sheriff s certificate of the holder's duty under section 582.031, subdivision
1, paragraph (b), to enter the premises to protect the premises from waste and trespass if the order is not
challenged or set aside and there is prima facie evidence of abandonment of the property as described in
section 582.032, subdivision 7.
Subd. 3. Securing building by city; lien. If the owner of the building or a holder of the sheriffs cer-
tificate of sale fails to either comply or provide to the governing body a reasonable plan and schedule to
comply with an order issued under subdivision 2 or to request a hearing on the order within six days after the
order is served,the governing body shall cause the building to be properly secured and the cost of securing
the building may be charged against the real estate as provided in section 463.21. In the metropolitan area,
as defined in section 473.121,subdivision 2,the governing body may work with neighbarhood associations
to develop and implement plans to secure vacant buildings in a timely and cost-effective fashion. The city
may use rehabilitation and revitalization funds in implementing this section.
Subd. 4. Emergency securing. A city may provide by ordinance for emergency securing of a building
that presents an immediate danger to the health and safety of persons in the community.

City inspector noticed the lawn not mowed and the house number not displayed at
3435 Eastlake Street, which are violations of City Code Sections 58-1(b) and 18-8.
This letter will serve as your notice that the property must be brought into compliance
before Thursdav, Julv 14 in order to avoid legal action by the City. In order to bring the
property into compliance the lawn must be mowed to six (6) inches in length and the house
. must display the proper house number.
Please be advised, if you fail to correct the violations prior to the deadline, the City will correct
' the violations and the costs to do so will be assessed against the property [Cite: City Code 58-
1(c) and 18-8(c)]. Those costs will be certified to the County Auditor and will be collected in the

Sec. 58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse,
litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the
property.
(b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds
on the property at a height of not more than six inches, except this provision shall not apply to the
following:
(1) Publicly owned parks, trails or nature areas.
(2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78.
(3) Residential properties in excess of one acre gross lot size when located in the RR-1A, RR-1 B, LR-1A
and RS rural residential zoning districts, provided that such properties or portions of properties shall
be maintained in conformance with this subsection upon notice from the city that lack of such
maintenance has caused complaints from abutting property owners and is thereby creating a public
nuisance.
(4) Wetlands vegetation as defined in chapter 78.
(5) Grass, weeds or underbrush on any slope in excess of 100 percent (45 degrees).
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and
upon seven days' written notice to the owner, as shown by the records of the office of the county auditor,
of private premises on which such material is found or any conditions in violation of this code section
exist, the city may remove such matter or correct any conditions in violation, and certify the cost of such
removals or corrections as any other special assessment.
Sec. 18-8. Numbering of houses and buildings.
(a) Duty of owner or occupant.
(1) The owner or occupant of every occupied property and every house o[ other building shall place on
such building the proper street number for such building, either by painting or affixing such number so
that the number shall be clearly visible from the sidewalk or street.
(2) Where the house is not visible from the street or private road, or is located more than 300 feet from
such street or road, an additional set of numbers shall be placed on a sign at the driveway apron with
numbers visible in both directions of travel on the street.
(3) Where more than one house is served by the same private driveway or unnamed private road,
additional sets of numbers shall be placed at every fork or other driveway as necessary to direct
traffic to every house, including the house farthest from the street.
(4) Numbers placed on mailboxes are insufficient to satisfy the provisions of subsection (a) of this section
except when a mailbox stands on the subject property, not across a public street, and not in a group
of mailboxes more than one in number.

(5) The minimum size for numbers shall be three inches.
(6) Numbers shall be reflective or of color contrasting with background.
(b) Assignment of numbers. The city shall assign numbers in accordance with the standard plan adopted by
the city and shall approve and assign all street names by action of the council.
(c) Unlawfu/act. It is a misdemeanor for any person to fail to comply with the provisions of subsection (a) of
this section or to post numbers other than the correct city-assigned numbers. If the property owner fails to
comply with the requirements of this section, the city may erect a sign adjacent to the street on which the
number is stated or affixed, and upon completion ascertain the cost and certify the cost to the county
auditor to be collected as any other special assessment.
