A RBSOLIITION GRANTING
VARIANCES TO
MIINICIPAI, ZONING COD}3
SECTION 10.22, SIIBDIVISION 1 (A) AND
SECTION 10.22, SIIBDIVISION 2

WHEREAS, Richard Hollander (hereinafter "the applicant") is
the owner of the property located at 680 North Arm Drive within the
City of Orono (hereinafter "City") and legally described as follows:
See Exhibit A attached Hennepin County, Minnesota (hereinafter
"the property"); and
WHER$AS, the applicant has applied to the City for
variances to Municipal Zoning Code Section 10.22, Subdivision 1 (A)
• and Subdivision 2 to al low a grade level deck and gazebo to remain in
the lakeshore yard located 14' from the shoreline where a 75' setback
is required resulting in additional hardcover at 735 s.f. or 4.9�
where 3,550 s.f. or 23.6$ exists and where none is allowed.
NOW, THER$FORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS .
1. . This application was reviewed as Zoning File #1737. �
2. The property is located in the LR-1B Lakeshore Residential
zoning district requiring 1 acre in area. The property
consists of 19,100 s.f. or .43 acres.
3. The Orono Planning Commission reviewed this application on
May 18, 19 9 2 and October 19, 19 9 2 and recommended approva 1
of the proposed variances as amended based upon the
following findings:
a) The unusal shape of the lot. �
b) The majority of the area of the 19,100 s.f. lot is
located within the 0-75' setback at 15,000 s.f.

c) Approximately 744 s.f. of the hardcover within the 0-
75' setback area has been installed because of the
historic erosion problems of the steep lakeshore bank
which was intensified at the time of the 1987 storms.
d) Applicant has provided written affidavits from
contractors and friends confirming that deck and gazebo
structure was constructed prior to the 1987 storm and
constructed sometime in the early '80s.
4. The City Counci 1 finds that the conditions existing on this
property are peculiar to it and do not apply generally to
other property in this zoning district; that granting the
variance would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate
• a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
5. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by City staff, comments by the applicant and the
effect of the proposed variance on the health, safety and

CONCLIISIONS, ORDffiZ AND CONDITIONS
Based upon one or more of the above findings, the Orono City
Council hereby grants variances to Municipal Zoning Code Sections
10.22, Subdivision 1 (A) and Subdivision 2 to allow grade level
decking constructed without the benefit of a building permit to remain
resulting in an increase of 312 s.f. or 2� of hardcover in the 0-75'
setback area and 14 s.f. for timber retaining walls to border formal
planting area in lakeshore yard, subject to the following conditions:
1. All non-structural and structural hardcover improvements
scheduled for removal as shown on Page 7 of this resolution
shall be completed by June l, 1993. Hardcover within the 0-
75' setback area shall remain at 3 ,799 s.f. or 25.3�.
• Hardcover within the 75-250' setback area shall remain at
1,537 s.f. or 37.4$.

2. Applicant shall obtain a demolition permit from the City
prior to the removal of the screen house/attached deck and
gazebo located within the lakeshore yard.
3. Applicant shal 1 restore natural ground cover with grass seed
or sod to al 1 areas where non-structural improvements are to
be removed.
4. Authorities granted by this resolution run with the property
not with the app licant, but are permissive only and must be
exercised by applicant first obtaining a demolition permit
to complete the removal of the screen house and deck
structure and to finally complete all hardcover removals by
June l, 1993.
5. Violation of or non-compliance with any of the terms and
conditions of this variance shal 1 constitute a violation of
• the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
6. The undersigned applicant has read, understood and hereby
agrees to the terms of this resolution and on behalf of
himself, his heirs, successors and assigns, hereby agrees to
the recording of this resolution in the chain of title of
the property.
