A RESOLIITION GRANTING
VARIANCES TO
MQNICIPAL ZONING CODE
SECTION 10.22, SDBDIVISIONS 1 & 2
FILE #1415
WHEREAS, Robert and Cheryl Humphrey (hereinafter "the
a�plicants") are owners of the property located at 669 Minnetonka
Highlands Lane within the City of Orono � (hereinafter "City") and
legally described as follows:
Lot 3, Block 2, Minnetonka xighlands Estates, Hennepin
County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicants have applied to the City for
variances to Municipal Zoning Code Section 10.22, Subdivisions 1
• and 2 to permit the construction of a deck and swimming pool ,
encroaching into the average lakeshore setback zone where no
encroachment is normally allowed, and comprising hardcover in
excess of the 25� normally allowed in the 75-250' lakeshore
setback zone.
NOW, TH$REFORE, BE IT R}3SOLVED by the City Counci 1 of
Orono, Minnesota: �
FINDINGS
l. This application was reviewed as Zoning File #1415.
2. The property is located in the LR-1B Single Family
Lakeshore Residential Zoning District.
3. The Orono Planning Commission reviewed this application
on June 19, 1989, and recommended partial approval of the
proposed variances on a vote of 4-1 , based upon the
following findings:
A) The applicants indicate the pool plan as submitted
is not the final plan, and was intended to alert the
Planning Commission as to the applicants' intent for
f uture deve 1 opment of the property. The poo 1 i s not
intended to be constructed within the one year time
• frame of this variance request. _
- B ) The Planning Commission finds it would be
inappropriate to grant approval of the variance for the
pool without having a final plan on file. �

G) The proposed variances for hardcover and average
setback are required in order to reconstruct the
i
existing deck, which is in poor condition and must be
` replaced for safety of the occupants of the property.
The applicants also propose to construct an additional
; deck adjacent to the existing deck. Both the existing
�� and proposed deck encroach past the average lakeshore
� - setback line but due to topography on the adjacent
properties, combined with the configuration and site
! � layouts of neighboring lots, the proposed decks will
f cause no reduction in views of� the lake enjoyed by
( � either neighboring property.
� `
�, •� D) All the proposed deck construction is in the 75-
� 250 ' zone. There is no hardcover in the 0-75 ' zone.
� E) Applicants can remove existing plastic from beneath
E, existing decorative rock beds to result in no net
�' increase in hardcover on the property the 37.1�
hardcover which exists now in the 75-250' zone.

i�� 4.` The City Council ° has considered this application
I including the findings and recommendations of the Planning
� Commission, reports by City staff , comments by the
( applicants and the effect of the proposed variances on the
f health, safety and welfare of the community.
# 5. The City Counci 1 f inds that the conditions exi sting on
� this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
� variances would not adversely aff.ect traffic conditions,
� light, air nor pose a fire hazard or other danger to
; neighboring property; would not merely serve as a
� convenience to the applicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to
� preserve a substantial property right of the applicants; and
would be in keeping with the spirit and intent of the Zoning
r ��, Code and Comprehensive P1an of_ the City.
