WH$R$AS, Mr. & Mrs. St�ven Howells (h�reinafter "th� �� ap�licants") are the own�rs of the property located at 1448 Park Drive within the City of Orono (h�reinafter "City") and legally described as follows: Exhibit A attached (h�r�inaft�r "the property") and WHEREAS, the applicants hav� made application to the City of Orono to permit construction of a fence in sxcess of the . 3�' fenc� height normally al low�d within a required street yard, per Municipal Zoning Cod� Section 10.30, Subdivision 15 (C), (D), • (E) , and (F) and r�quiring a conditional use permit for an accsssory structur� on a through lot locat�d in a residential district Fer Municipal Zoning Code Section 10.03, Subdivision 10. NOW, THEREFORE, BE IT RESOLVED by th� City Counci 1 of Orono, Minnesota: FINDINGS l. This application was reviswed as Zoning File #1398 2. The property is locat�d in th� LR-1B Singl� Family Lak�shor� R�sid�ntial Zoning District. ' 3. The prop�rty is surrounded on all sides by roadways, the southerly boundary abutting County Raad 19. 4. Th� Orano Planning Commission revi�w�d this app licatian on April 17 , 1989 , and recomm�nd�d approval of the conditional uss p�rmit and approval of th� propos�d f�nce hsight variance to allow a 6' high f�nc� along County Road 19 and a 4' high f�nce at th� interiar of the lot, bassd on the following findings: A) The property is unique in that it is surround�d on • all sides by travell�d roadways. Page 1 of 5 Ci.t� of ORONO • RESOLUTION OF THE CITY COUNCIL � NO. 2635 • - • • B) The need for adequate security for the applicants' young children is obvious given the speed and volume of traffic on County Road 19 directly adjacent to the street yard which functions as applicants' rear yard. C) The proposed 6' high f ence a 1 ong County Road 19 i s reasonable given the applicants' dual purpose to reduce traffic noise while providing a barrier that may not be scaled by young children. Likewise, the 4' high fence at the interior of the lot is appropriate to provide adequate security given the proximity to roadways. D) The 6' high fences take on the character of accessory structures on a through lot and require that a conditional use permit be granted. 4. On 5-8-89 the applicants requested that the interior • fences be allowed at a 5' height for visual and safety purposes. The Council finds that such a fence height is appropriate for those areas. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff , comments by the applicants and the effect of the proposed variance on the hea 1 th, saf ety and we 1 f are of the community. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring properties; would not merely serve as a � convenience to the applicants, but is necessary to � alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. • Page 2 of 5 t Cit� o� ORONO • RESOLUTION OF THE CITY COUNCIL � NO. 2635 • � • • � 7. The City Counci 1 f inds that granting a conditiona 1 use permit to allow this fence accessory structure in the rear street yard of this through lot will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will it depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the . intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCLDSIONS, ORDffit AND CONDITIONS � � � E Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision 15 and a conditional use permit per Section 10.03, Subdivision 10 to allow the construction of a 6' ~ • high fence along County Road 19 and a 5' high fence at the interior of the property per Exhibit B attached, subject to the fol lowing conditions: � l. The fence shall be placed within the applicants' � boundaries per Exhibit B. The height of the fence shal 1 not • exceed those heights noted above, nor shall the fence extend � nearer any intersection than as shown in Exhibit B. : � ,. 2. Authorities granted by this resolution run with the property not with the applicants, but are permissive only � and must be exercised by application for a building permit �: within one year of the date of Council approval , or the � special conditions of this resolution will expire on that date (May 8, 1990). � 3. Violation of or non-compliance with any of the terms and . conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any ' authority granted herein, and shal 1 be punishable as a misdemeanor. ; 4.
