'�• � • • �' � � � , ; ' EMINENT DOMAIN RESOLIITION WHEREAS, the City of Orono proposes to construct sewer and water utilities, and WHEREAS, the installation of such utilities is necessary to provide city services, and WHEREAS , the City of Orono has authority to acquire � right of way by eminent domain pursuant to Minn. Stat. Sec. . 465. 01, and � WHEREAS, a portion of said lands required for permanent � easement purposes are owned by the Orono Plaza Partnership . , c]escribed in Exhibit E, together with the temporary easement required for construction shown at Exhibit F. � • WHEREAS, the City of Orono has been unable to date to negotiate the acquisition of the required easements; � NOW THEREFORE BE IT RESOLVED, that the City Council of � the City of Orono hereby authorizes the acquisition of said land � described in Exhibits E anci F, by eminent domain and to take title and possession of that lana prior to the filing of an award E by the court appoin�ted commissioner , pursuant to Minn. Stat. '� 117.011, and 117.042. , � BE IT FIIRTHER RESOI,VED; that the City Attorney is � requested to file the necessary Petition therefor, and to . prosecute such action to a successful conclusion or until it is abandoned, dismissed, or terminated by the City or the Court.
