MIINICIPAL ZONING CODE
SECTION 10.55, SDBDIVISION 8 AND
GRANTING A CONDITIONAL DS$ P$RMIT PER
SECTION 10.03, SDBDIVISION 19

WHER$AS , Loren Butterfield (hereinafter "the
applicant" ) is the owner of the property located at 3925
Watertown Road within the City of Orono (hereinafter "City") and
legally described as follows:
Exhibit A (hereinafter "the property"); and
WHEREAS, per Section 10.03, Subdivision 19, Section
10.55, Subdivision 8 and Orono Resolution #2610 (Condition No.
15 ) , the applicant has made application to the City of Orono to
� permit the annual excavation/removal of peat from the wetlands
located within the property on the south of the Luce Line Trail.
NOW, THERSFOR$, BE IT RESOLV$D by the City Council of
Orono, Minnesota:
FINDINGS
l. This application was reviewed as Zoning File #1433
2. The property is located in the RR-lA Single Family
Lakeshore Residential Zoning �District requiring 5 acres of
area, 2 acres of which must be contiguous. The property
consists of a total of 20.56 acres.
. 3. The Orono Planning Commission reviewed this application
on August 21, 1989 and recommended approval of the proposed
variance and conditional use permit, based on the following
findings:
A) Per Orono Resolution #2610, Condition 15, the
applicant was directed to file a conditional use permit
for the annual removal of peat used in the commercial
growing of plants on the property.
� B) In a report dated August 17, 1989 by Glenn Cook, he
noted that "the continued excavation of the wetland . .
. on a limited scale (300 cubic yards) will have a
minimal effect on the marsh" .

C) In that same report, Cook notes that the excavation
will enhance wildlife habitat.
D) Approximately 3,000 cubic yards of peat has been
removed from the wetlands over the past 30 years with-
out any negative impact on the wetland or the wildlife
habitat.
E) The excavation of ponding areas wil 1 enhance
wildlife habitat and improve water storage.
4. The City Counci 1 f inds that the conditions exi sting on
this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
variance would not adversely affect traffic conditions,
� light, air nor pose a fire hazard or other danger to
neighboring properties ; would not merely serve as a
convenience to the applicant, but is necessary to alleviate
• a demonstrable hardship or difficulty; is necessary to
. preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
� 5. The City Council finds that granting a conditional use
permit to allow the continued annual excavation of peat from
the wetland on a limited scale will not be detrimental to
the health, safety or general welfare of the public, would
not adversely affect light, air nor pose a fire hazard or
other danger to neighboring properties , nor will it
depreciate surrounding property values and that the proposed
level of use of the property will be in keeping with the
intent and objectives of the Zoning Code and Comprehensive
Plan of the City.
CONCLDSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono
City Council hereby grants a variance to Municipal Zoning Code
Sections 10.55, Subdivision 8, grants approval of a conditional
use permit per Section 10.03, Subdivision 19 and per Orono
Resolution #2610 (Condition 15) , subject to the fol lowing
conditions:
• l. The annual excavation of peat from the wetland located to
the south of the Luce Line shall be limited to 300 cubic
yards.

2. Applicant must obtain an annual land alteration permit
from the City of Orono specifying amount of peat to be
removed, a plan for the work to be completed that year, and
a plan for erosion control.
3. Upon final approval of the proposed platting of this
property (Ap�plication #1366) , applicant shall agree to
execute a Conservation and Flowage Easement that shall set
forth the special conditions of this conditional use permit.
If applicant has not filed for final plat approval by the
deadline date of March 27, 1990 (per Orono Resolution
#2610), applicant shall execute a Conservation and Flowage
Easement with the City no later than June 1, 1990 or this
conditional use permit shall be null and void.
• 4. Authorities granted by this resolution run with the
property not with the applicant, but are permissive only and
must be exercised by application for a building permit for
the retaining walls within one year of the date of Council
approval, or the special conditions of this resolution wil 1
expire on that date (August 28, 1990).
5. Violation of or non-compliance with any of the terms and
conditions of this resolution shal 1 constitute a violation
of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a
misdemeanor. �
6. The undersigned applicant has read, understood and
hereby agrees to the terms of this resolution and on behalf
of himself, his heirs, successors and assigns, hereby agrees
to the recording of this resolution in the chain of title of
the property.
