Harris , (hereinafter "the applicant" ) is the owner of the property located at 3850 Watertown Road within the City of Orono (hereinafter "City") and � Yegally described as Lot 1, Block 1, Hillaway Farm, Hennepin County, Minnesota (hereinafter "property" ) ; and WHEREAS, per Municipal Zoning Code Section 10.03, Subdivision 19, the applicant has applied to the City of Orono for a conditional use permit to permit the instal lation of a pond 10 0' in diameter and 4' deep. �NOW, THEREFORE, BE IT R$SOLVED by the City Counci Y of Orono, Minnesota: • FINDINGS l. This application was reviewed as Zoning File #1367. 2. The property is located in the RR-lA Rural Residential Zoning District requiring 5 acres in area. The property consists of 10+ acres. 3. On ApriY 17 , 1989 , the Orono Planning Commission reviewed the application as proposed and recommended ' approval based on the fol lowing findings: A) The City Engineer has confirmed that the instalYation of the pond wiii have no negative impact upon the drainage to the west nor to the south. B) The instalYation of the pond wi�I have a positive impact on the drainage in the area providing greater retention within the limited watershed. C) The application as proposed will require no variances to the standards of Section 10 . 03 , Subdivision 19. Page 1 of 4 • . � Cit� of ORONO •� � RESOLUTION OF THE CITY COUNCIL .:., � �'� NO. 2629 :��; � • � • • he City Council has considered this application including the findings and recommendations of the Planning Commission, reports by staff and comments of the applicant and the affect of the proposed use on the health, safety, and welfare of the community. � 5. The City Council finds that granting a conditianal use permit to allow the installation of the pond as proposed will not be be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air ' nor pose a fire hazard or ather danger to neighboring properties, nor wi 11 its use depreciate surrounding property values and that the proposed level of use of the property wi11 be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCLDSIONS, ORDER AND CONDITIONS � Based upon one or more of the above findings, the Orona City Council hereby grants a conditional use permit per Municipal • Zoning Code Section 10.03 , Subdivision 19 to permit the installation of a 100' diameter pond at a 4' depth as shown on the survey by Coffin and Gronberg Inc. dated March 17, 1989, subject to the foll.awing conditions: 1. Banks of the pond are to be installed at a 3 :1 slope ta facilitate the regrowth af vegetation. � 2. Vegetatian be restored upon comp letion of the final land alterations. � 3. Applicant to provide a drainage easement over the retention pond and upon the final recommendation of the City Engineer, hereby agrees to grant the City additional drainage easements over existing underground tiles that drains to the sauthern boundaries of the property. 4. Authorities granted by this resolution run with the property not with the app Iicant, but are permissive only and must be exercised by the installation of the pond within one year of the date of Council approval or the special canditions af this resolution wi11 expire on that date (May 8, 1990). Violatian of ar non-compliance with any of the terms and conditions of this resalution shall constitute a violation of the Zaning Code, sha3.1 automatically terminate any autharity granted herein, and sha11 be gunishable as a misdemeanor. 6. The undersigned owner has read, understoad and hereby _ agrees to the terms of this resolution and on behalf of hi;nself, his heirs, successors and assigns, hereby agrees to � the recording af this resolution in the chain of title of the property.
