WHEREAS, James L,ear (hereinafter the "applicant") is owner of the property
located at 2525 Dunwoody Avenue within the City of Orono (hereinafter "City") and legally
described as follows:
Lot 9, Block 8, Townsite of Lan�don Park, Hennepin County, Minnesota
(hereinafter the "property"); and
WHERE�S, the applicant has made application to the City of Orono to permit
the construction of retaining walls and stairway at the lakeshore, requirina variances to
Municipal Code Sections 10.22, Subdivision 2, 10.55, Subdivision 8, and 10.56, Subdivision
16 (L) to allow hardcover in the 0-75' lakeshore setback zone, and a variance to Section 10.56,
Subdivision 16 (C) to allow retaining walls which are prohibited in the shore setback zone, and
a conditional use permit for lakeshore alterations per Section 10.03, Subdivision 19.
NO`'�', THEREFORE, BE IT RESOLVED by the City Council of Orono,

FINDINGS
l. This application was reviewed as Zonin� File #196�.
2. The property is located in the LR-1C SinQle Family Lakeshore Residential Zoning
District.

wall system and stairs based on the following findings:

a, The property currently contains an existin� deterioratinQ retaininQ «�all
system and stairway at the lakeshore.
b. The existing retainina walls are located within 30' of the shoreline but do
not extend the full width of the property. The shoreline banl: extends
approximately 18' above lake level, and is e�ibitin� slunip failure.
�. The proposed retaining wall system desi�ned by American Engineering
Testing, Inc. has been approved by the Ciry Engineer from an engineerinQ
standpoint.
d. The existing retaining wall system/stairway hardcover including a 43 s.f.
existing shed is approximately 2.5`7�. The proposed retaining wall
svstem/stairway/shed will comprise approximately 5.5 o hardcover in the
p-7�' zone. The majority of 0-75' hardcover is the retainina wall system.
e. The applicant has provided a suitable planting and reveaetation plan ��hich
compensates for the necessary removal of existing juniper type vegetation
along the lakeshore bank, which will be removed in order to facilitate the
retaining wall project. Further, the planting plan provides sufficient
varieties and quantities of shrubbery to provide adequate screening to the
new retaining wall system.
f. Plannin� Commission finds that approval should appropriately be
conditioned on proper erosion controls, appropriate vegetation screeninQ,
and a finite time period for completion of the project to minimize erosion
potential.
4. The Council finds that the conditions existina on this property are peculiar to it
and do not apply generally to other property in this zoning district; that aranting
the variance would not adversely affect traffic conditions, light, air nor pose a
fire hazard or other danger to neighboring properties, would not merely serve as
a convenience to the applicant, but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property riQht of the
applicant; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.

j_ The Ci[y Council finds that gi�anting a conditional use E�ermit to allow
cons[ructioil of a retaining �vall systern and stair replacemcnt ���ill not be
detrimental to the health, safery or general welfare of the public, would not
adversely affect light, air nor pose a fire hazard or other danger to nei`�hborin�
property, nor will its use c3epreciate surrounding property values and �hat the
pi-opo�ed level of use of the propeity wil( be in keeping with the intent and
objectives of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDFR AND CONDITIONS
Based upon oile or more of the above findings, the Orotlo City Council hereby
�rants variances to Municipal Zoning Code Sections 10.22, Subdivision 2, 10.55, Subdivision
8, and 10.56, Subdivision 16 (L) to allow Ilardcover in the 0-75' lakesllore setback zone of 5.2%
w}iere no hardcover is tlormally allowed, and �rants a variance to Sec[ion 10.56, Subdivisioil
16 �C) (5) to allow constluction of retaining walls �vhere they are normally prohibited in the
shore setback zone, and �ralits the corlditional use pern�it required for lakeshore alterations per
Scction 10.03, Subdivision 19, subject to thc follo�ving conditions:
1 , I-Iardcover in tl�e 0-75' zone shall not exceed J.2 0 (490 s.f.), and construction
shall adhere to the approve�i design by American Engineering Testin�, Inc. and
the site plan and planting schedule att�ched as Exhibit A.
2. Applicant shall obtain the ilecessary lan� alteration perrl7it prioi' to construction.
Further, applicants shall obtain the a�propriate Nlinnehaha Creek �Vatershed
District Permit for ript�ap at t}ie shoreline pi-ior to ripr�lpping.
3. Applicant shall remove shed at 43 s.f. �vithin 0-75' setback area. "I�he block �vall
to rear of structure that serves as a retention wall s}�all remain. A lockbox at 20
s.f. shall be constructed at the same location per site plaii attached as Exhibit t�.
4. Proper erosion control procedures shall be established and inaintained durin�
construccion activity in accord with i�IPCA's "Best Nlanaaement Practices for
ProtectinQ Water Quality iii Urban Areas", and in accord with the provisions of
Orono Shoreland Regulacions, Section 10.56, Subdivi�ion 16 (J).

5. In order to minimize the period during which the shoreline is disrup[ccl, the
retaininQ «�all system construction shall continue to comple[ion without delay once
constiuction has commenced. Completion of plantings per Exhibit A shall be
completed as soon as weather permits after retaining �vall consti�uction.
6. A representative of t}ie retaining wall design firm (American Engineering Testing,
Inc.) shall hc on Sitc cluring c��nstrucli��n t�� ��hscrve c��nclitic�ns.
7. Authorities granted by this resolution iun with the property not with the owners,
but are permissive only and must be exercised by application fer a building
permit �vithin one year of the date of Council approval, or the special conditions
of this resolution will expire on that date (October 24, 1995).
8. Violation o� or non-compliance �vith any of the terms and conditions oF this
resolution shall constitute a viola[ion of the Zoliing Code, shall automatically
terrninate am� authority �ranted herein, and shall be punishable as a misdemeanor.
9. The undersi�ned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, theii- heirs, successors an�i assigns,
hereby a`,ree to the recording of this resolution in the chain of title of the
pro�erty.
