NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1965. 2. The property is located in the LR-1C Single Family Lakeshore Residential Zoning District. 3. The Orono Planning Commission reviewed this application on September 19, 1994 and October 17, 1994 and on a vote of 7 to 0 recommended approval of the necessary variances and conditional use permit for construction of a new retaining TRANSFER ENTEREDwall system and stairs based on the following findings: HENNEPIN COUNTY TAXPAYER SERVICES Page 1 of 5 DEC 2 1994 N NN. gy DEPUTY Fo m 5005 Disk Omw ' 1 O CITY of ORONO RESOLUTION OF THE CITY COUNCIL No. 3484 ESS a. The property currently contains an existing deteriorating retaining wall system and stairway at the lakeshore. b. The existing retaining walls are located within 30' of the shoreline but do not extend the full width of the property. The shoreline bank extends approximately 18' above lake level, and is exhibiting slump failure. C. The proposed retaining wall system designed by American Engineering Testing, Inc. has been approved by the City Engineer from an engineering standpoint. d. The existing retaining wall system/stairway hardcover including a 43 s.f. existing shed is approximately 2.5%. The proposed retaining wall system/stairway/shed will comprise approximately 5.5% hardcover in the 0-75' zone. The majority of 0-75' hardcover is the retaining wall system. e. The applicant has provided a suitable planting and revegetation plan which compensates for the necessary.removal of existing juniper type vegetation along the Lakeshore bank, which will be removed in order to facilitate the retaining wall project. Further, the planting plan provides sufficient varieties and quantities of shrubbery to provide adequate screening to the new retaining wall system. f. Planning Commission finds that approval should appropriately be conditioned on proper erosion controls, appropriate vegetation screening, and a finite time period for completion of the project to minimize erosion potential. 4. The Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring properties, would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Page 2 of 5 F=5005 Disk Orono O O CITY of ORONO RESOLUTION OF THE CITY COUNCIL c4 S ogG E 5. The City Council finds that granting a conditional use permit to allow construction of a retaining wall system and stair replacement will not be detrimental to the health, safety or general welfare of the public, would not ajversely affect light, air nor pose a fire hazard or other danger to neighboring property, nor will its use depreciate surrounding property values and that the 1) iijii d 1c'."Cl Cf ibSf (.j." ii; i:•Cl)i;irE wiia iiie tntc'iit and OlJcctiv((s fel' the Zoni ?`, Code i>ia;l oS :he City.
