Thank you for supplying this information back in February. Everything is moving ahead now so I want to apply for the
City permit. I have attached a separate application for each culvert/driveway and the engineering plans. For the permit
fee,what payment options do you accept?
Submission Requirements
• Survey/grading plan attached
• If necessary, 50cy of fill will be brought onto the site
• Haul route will be Creekwood Trail to County Road 6
• The existing driveways and culverts will be removed,the culverts replaced, and the driveways replaced
• Erosion control notes are on listed sheet G-102;floating silt curtain is noted on page C-301; erosion control
blanket details are noted on page C-801
• The MCWD permit was approved at the January 28, 2016 MCWD Board Meeting. MCWD was waiting to receive
a Declaration from the landowner for maintenance of the culverts before issuing the permit.That Declaration
has been received and MCWD plans to issue the MCWD permit tomorrow.

Yes, i will plan on scheduling your presentation for the 8th (not the 7th—oops!).
It would be useful to have the plans for the easement boundaries, although not sure if the attorney will need them.
I'm assuming the Council will have to authorize signature of the easements.

Thanks for getting back to me today, I really appreciate it. I would be more than happy to make a short presentation to
the City Council at the beginning of the February 8th meeting. I will be touch base with you next week on that.
I have attached the Olsen easement document as it has been updated since I sent it last,Orono subordination signature
block is on page 9. I now have site plans indicating the potential easement boundaries for each property, please let me
know if those would be useful for the attorney to have during their review. Assuming acceptance by the City Attorney
on the easement documents,will the City Council also need to authorize signature of the easements?
Who is the best person to contact at the City to apply for the land alteration permit?

First, I apologize for not having gotten back to you sooner—my schedule has been full the past two weeks. However,
I've now had a chance to briefly review this with the City Administrator and we agree that staff would support a wetland
restoration project as well as the culvert replacement. We do not see any reason why the City Council would object to
allowing the work to occur within the areas covered by existing wetland easements granted in the past to the City. That
being said, it would be helpful to solidify this if you could make a short presentation to the City Council at the beginning
of its February 7 meeting to introduce the nature and scope of the restoration project. I will be asking the City Attorney
to review the proposed acceptance/subordination documents and advise whether they are acceptable.
Once the general nature of the project is presented to the Council, we expect the Council would be willing to authorize a
letter of support for the project.
Regarding the culvert replacement,the flooding problem is an issue the neighborhood brought to the City some time
ago, and we are pleased that MCWD is planning to resolve it. The City will merely require a $50.00 land alteration
permit(administrative) be issued for each property to document for City files the work being done.

meeting next week.A few questions for you:
1. Is their support from the City to sign the relevant easements to indicate acceptance/subordination?
2. If there is support to sign, is City Council action need to authorize signature of the consents?
3. Are any City approvals needed for the culvert replacements?
4. Would the City be willing to sign a letter of support to the District for the project? (Project includes solving a
local drainage issue while leveraging land rights for a potential partnership with the United States Army Corps of
Engineers to implement a large scale wetland restoration.)

I left you a voicemail regarding this item. MCWD is working on a partnership with several residents who live around
South Katrina Marsh and along Painter Creek.As part of the partnership, nine residents have agreed to convey
conservations easement to MCWD in return for MCWD replacing two undersized driveway culverts which caused
flooding for the area in 2014. I have attached a map which shows where the proposed wetland and Painter Creek
easements are located. In doing a title records search of these properties,five of them noted City encumbrances that
include wetland/buffer, drainage &flowage, and open space easements.Those five properties are:
1. Rudd; PID 3011823310004, 4575 Spruce Way
2. Deakins; PID 3011823320007; 100 Town Line Road
3. Olsen; PID 3011823330005; 4680 Creekwood Trail
4. Chelberg; PID 3111823210005; 4490 Watertown Road
5. Huntington Farm HOA; PID 3011823440006; Outlot A
The Districts interest in acquiring these easements is to allow the District the right to implement wetland and creek
improvements. I have attached a draft version of the easement the District is looking to implement. I want to ensure
that the rights be pursued by the District are not in conflict with or diminished by the City's encumbrances on these
properties. I would appreciate the City's review to determine this. If the City concludes there are no conflicts then the
District's legal counsel would like the City to formally recognize that and have the City sign the relevant easements
indication acceptance/subordination. If the City has different ideas on how to document that please let me know.
District staff is looking to get MCWD Board approval on the proposed easements on January 28th. If possible, I would
appreciate your input and guidance on how to proceed with the easement acceptance by January 2152
As for the culvert replacement I am wondering if a City permit is needed?The culverts are on private property under the
driveways at 4680 Creekwood Trail &4650 Creekwood Trail. Each culvert is a 18-inch CMP and were determined to be
undersized during a modeling analysis the District performed.The District is proposing to replace each culvert with a 36-
inch round culvert. I can send more information on this if needed.
There are more details that I can fill you in on over the phone but thought it would be helpful to get you the map and
easement details first. I look forward to hearing your response.
