a. The proposed replacement sign is approximately the same size as the
existiila si�n.
b. The existinc non-conformin� pylon style siQn will be replaced with a
conformina monument stvle sign encased in briclt �vith a stone cap.
c. The property is located on a busy strzet where a siQn 1? s.f. in size per
Zonin� Ordinance Section 78-1467 would not be visible due to the
hi�h levels of traftic and speed.
d. The applicant llas proposed to remove appro�imately 32 s.f. of
hardco��er�vithin the 2�0'-�00� zone.
4. The City Council has considered this application includin� the tindinas
and recommendation of the PlaiuiinQ Commission. reports by Ci�� staff,
conunents by the applicant and the public, and the effect of the proposed
variances on tize iZeaitil, safety and tivelfare of tile coiruz�uiiit�•.
�. The Ci.ty Council finds that the conditions existinQ on this property are
peculiar to it and do not apply aenerally to other property in this zoning
district; that �rantin� the variances would not adversely� affect traffic
conditions, liQht, air nor pose a fire hazard or other danaer to neiahborin�
property; ti�-ould not nzerelv serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessarv to
preserve a substantial property ri�ht of the applicant; and would be in
l:eepinQ �ti�ith the spirit and intent of the 7onin� Code and Comprehensive
Plan of the City.

l. Council approval is Uased on the site plan submitted by the applicallt and
amlotated by City staff, attached to this Resolution as Exhibit A. Anv
amendments to the site plan which are not in conformity with City codes tivill
require filrther Plannina Commission and City Council revie��-.
2. Hardcover in the 250'-500' zone shall be limited to 2�,9?7 s.f. or 53.8% per ihe
proposed plan and hardcover allo���ance summary as depicted on Exhibit A.
Applicant is advised that any firture requests to increa�e hardcover or chan�e the
nature of existinQ�appro`�ed hardcover shall require City approval. and increases
in hardcover ���ill not likelv be appz�oved tivithout concun�ent reduction in existina
hardcover.
3, Authorities �ranted by this resolution run with the propert� z7ot with the applicant,
but are permissive onlv and i��.ust be e�ercised by obtaining a buildinQ permit for
t1�e new construction «�ithin one year of the date of Council appi•oval, or the
variances will e�pire on that date (Jtine ?7. 2006).
4. Violation of or non-compliance with any of the ternls and conditions of this
resolution shall constitute a violation o2 the zonin, code, shall automatically
tenninate aily authority �ranted herein, and shall be punishable as a misdemeanor.
�. The undersiyned applicant has read. understood and hereby aQrees to the tenns of
this resolution and on behalf of the applicant and the applicant's heirs, successors
and assigns, hereby aQrees to the recordin� of this resolution in the chain of title
of the propert�-.
