Neveaux: The purpose of this letter is to confirm the telephone � conversaticn we had today regarding the preliminary agr2ement o� August 9 , 1990 relating to Mr . Oberhauser ' s various properti�s in Orono. I discussed with you my concern that we had not yet received a final agreement between Mr . Oberhauser and the City. Certain deadlines are approaching that are the subject of the proposed agreement . For example, Mr . Oberhauser is to demolish the building located at 2405 Dunwoody by October 1, 1990 . Also► by October 1, 1990 , Mr . Oberhauser is to provide separate water service to the property located at 3877 Shoreline. You have agreed to provide me with a copy of the agreement between Mr . Oberhauser and the City by September 27 , 1990 . I hope you will call the October l, 1990 deadlines to Mr . Oberhauser ' s attention; in that I would like to avoid the possibility that, immediately following the execution of the agreement, we have a situation where there is a breach. Oberhauser Oberhauser & Associates, P.A. �E'� 2 6 �.��� 1421 East Wayzata Boulevard, Suite 210 Wayzata, Minnesota 55391 Dear Mr. Oberhauser: RE: Property at 2405 Dunwoody Avenue, Orono, Minnesota Thank you for your letter of December 7, 1990, regarding the open burning of a building located at 2405 Dunwoody Avenue in the City of Orono. The Minnesota Pollution Control Agency (MPCA) continues to hold the position that bona fide fire training cannot be conducted on a toppled structure. MPCA staff contacted the Minnesota State Board of Vocational Technical Education (State Board) staff regarding fire training of toppled buildings. The State Board staff stated that toppling a structure and igniting it does not constitute bona fide fire training. Exposure protection and hydraulic practice, components of fire training, can be accomplished without unnecessary pollution to the environment and endangering neighboring property. The Open Burning Rule also states that open burning may be conducted for the disposal of building material generated by the demolition of noncommercial or noninstitutional structures (Minn. Rules pt. 7005.0750 subp. 1.J. ) if a practical alternative method of disposal of the material is not available (Minn. Rules pt. 7005.0770 A. ) . According to the information MPCA staff received from the Hennepin County Solid Waste Office, landfills are available in Hennepin County for the disposal of demolition debris. They do not feel it is a bona fide fire department training exercise. I am sure that if the Mound Fire Department had known this, they would not have required the house to be knocked down before they burned it. I do feel that if and when you decide to remove the other houses, they are sufficiently spaced and could be burned and provide valuable training to the volunteer fire department. The City of Orono would greatly appreciate it if you would proceed in the removal of the debris and foundation before frost penatration make it too difficult. These applications have been denied because the Minnesota Pollution Control Agency (MPCA) does not believe that bona f'ide' fire training can be conducted. MPCA staff has been in£ormed that the structure at 2425 Dunwoody Avenue in Orono has been demolished. According to the Minnesota State Board of Vocational Technical Education staff, toppling a structure, pushing into a pile and igniting it, is not considered bona fide fire training. The MPCA believes that exposure protection and hydraulic practice can be accomplished without unnecessary pollution to the environment and endangering the neighboring property. Al1 fire departments are required to obtain fire training permits for all training conducted, including fire extinguisher training. To conduct fire training on a structure, a separate permit is required for each structure with a maximum number of four (4) structures per year per fire department. Enclosed are the current fire training permit application forms. The MPC� encourages you to submit a completed application as soon as possible.
