New lots created in the LR-1 C district must be at least 0.50 acre in area and 100 feet in width. If you are considering constructing a driveway corridor to access a lot to the south (making a front lot/back lot configuration) that corridor must be platted as an outlot, must be at least 30' in width, and does not count toward the minimum lot acreage requirement. Further, in a front lot/back lot configuration, the back lot is required by Orono Zoning Code to have 150% of the minimum zone acreage requirement, i.e. 0.75 acres (click here for City Code section 82-256). It appears unlikely to City staff that your property containing approximately 1.15 acres can meet the minimum area requirements for a conforming front lot/back lot configuration, and at 132' in total width does not contain enough width to accomplish a conforming side-by-side split. You indicated you possibly will be contacting a surveyor to determine if a subdivision is a possibility. Attached are our survey requirements. As you are aware the sewer servicing 3800 Dickenson Ave Extension was made possible by a special agreement with Spring Park. MEMORANDUM To: Scott Oberaigner, Public Works Supervisor From: Mike Gaffron, Planning Director Date: September 7, 2006 Subject: 3800 Dickson Extension You asked me for information regarding the further developability of 3800 Dickson extension, to assist Spring Park in determining how to best proceed with serving the property with municipal utilities. The property includes two separate tax parcels both zoned LR-1C, single family, 1/2 acre minimum, 100' width minimum. "Main Parcel": PINS 17-117-23 31 0020, with existing residence Lot size 90' x 378' = 34,020 s.f= 0.78 acre This lot could be re-built on without variances per Orono Zoning Code (lot area is conforming, width meets 80% of standard). "Secondary Parcel": PINS 17-117-23 31 0021, with a smaller building (shown on a 1989 survey on file as "existing work shop") Lot size 42' x 378' = 15,876 s.£ = 0.36 acres This lot is substandard in area and width and would need area and width variances in order to construct a residence on it. Neither lot includes wetland that we know of. It would be difficult under Orono's subdivision ordinances to do a lot line rearrangement between these two parcels to result in two completely conforming lots, due to elongated shape of the site and the limited frontage on a public road. There isn't quite enough acreage to do a front lot/back lot layout without variances. However, the easterly smaller lot abuts the rear portion of the property at 3760 Togo Road (Glassco). That property is large enough that it could potentially give up acreage to allow the Secondary Parcel to become conforming. Therefore, it is not beyond comprehension that a total of two homes could require utilities from Spring Park in this area in the future. That would require cooperation between the property owners, but is not an impossibility.
